Present at roll call were Commissioners Forkel, Klabo, Omland and
Richardson.
County Commissioners present were Feickert, Wiese and Hansen.

NO. 04-03-01-290
An Ordinance amending Ordinance No. 1164 to rezone certain
described property from Section 701 (A-1) to Section 714 (M-Ag) property
described as: Lots 1, 3 and
4 of Hansen Subdivision in the NE ¼ of Section 17, T123N-R64W of the 5th
P.M. Brown County, South Dakota, and extending to the centerline of all
public right-of-way located adjacent thereto, was presented.
Commissioner Forkel moved, Commissioner Omland seconded to
approve first reading of Ordinance No. 04-03-01.

An Ordinance amending Section 502 (Accessory Building or Use),
Section 502 (Building Accessory) 703.2.8, 704.2.1, 705.2.1, 706.5.14,
707.2.10, 708.2.19, 715.2.2 and 716.2.7 of Ordinance No. 1164, as
amended, known as the Zoning Ordinance of the City of Aberdeen, South
Dakota, amending definitions and residential and commercial regulations
pertaining to Accessory Buildings and or Structures, was presented.

approve first reading of Ordinance No. 04-04-01.

continue for one week the request/proposal from the Northeast Regional
Health & Fitness Center. All

Dale Jorgensen was recognized for attaining his Class II Water

approve resolution authorizing Mayor to sign execute and deliver
documents to deed interests to S.D. Broadcasting Company, contingent
upon approval of documents by City Attorney: WHEREAS, the Aberdeen Board of Commissioners passed a resolution on October 25, 1977 with an effective date of November 27, 1977; and
WHEREAS, the purpose of said resolution was to approve the
issuance of industrial revenue bonds (hereinafter referred to as “the
Bonds”), to help pay for financing costs for the construction of a new
television studio by the South Dakota Broadcasting Company; and
WHEREAS, the Bonds are paid off and the City of Aberdeen’s
interest in the property securing the Bonds will extinguish; and
WHEREAS, the property securing the Bonds is legally described as:
Lot Nine (9) B, of the Replat of Lot Nine (9), Auto Plaza
Addition, Brown County, South Dakota, located in the Northeast Quarter
(NE1/4) of Section Fourteen (14), Township 123, Range Sixty-Four (64),
West of the Fifth P.M., Brown County, South Dakota, and all easements,
rights of way and appurtenances thereto;
It is hereby resolved that the Mayor, on behalf of the City of
Aberdeen, is hereby authorized to sign, execute and deliver by the
appropriate deed any interest in the above described property, upon the
completed payment of said Bonds.

approve the following resolution: A RESOLUTION SUPPORTING THE CONSTRUCTION OF A TURKEY PROCESSING FACILITY IN BROWN COUNTY BE IT RESOLVED by the Aberdeen City Commission, Brown County, Aberdeen, South Dakota as follows: WHEREAS,
there is discussion and planning taking place at the current time
regarding a turkey processing facility to be located within Brown County
or the surrounding area; WHEREAS,
the Aberdeen City Commission has always maintained a strong cooperative
effort and commitment with the Aberdeen Development Corporation to
ensure high quality jobs in the community of Aberdeen, Brown County and
surrounding Counties; WHEREAS,
the Aberdeen City Commission recognizes the benefits this turkey
processing facility will produce for Aberdeen and surrounding
communities in the way of increased jobs and quality of life; WHEREAS,
the Aberdeen City Commission recognizes the strong work ethic of the
people of this area and that this work ethic will be a benefit to the
turkey processing facility; WHEREAS,
a decision will be made shortly as to the location of the facility; THEREFORE,
the Aberdeen City Commission, Brown County, South Dakota, wants to
maintain it’s commitment to the industrial and economic success of
Aberdeen, Brown County, and surrounding areas, by wholeheartedly

Ordinance No. 04-04-04 – An Ordinance amending Section 23-32

NO. 04-04-01 R
Commissioner Forkel moved, Commissioner Richardson seconded to
approve the following resolution: RESOLUTION SETTING THE TIME OF THE
ANNUAL ELECTION FOR THE YEAR 2004
WHEREAS, the first Tuesday of June of each year is by law
designated as the time for holding the combined City of Aberdeen,
Aberdeen School District 6-1, and Brown County Primary Election and said
date in 2004 is the 1st day of June, 2004, and
WHEREAS, it has been determined that the regular City of
Aberdeen, Aberdeen School District 6-1, and Brown County Primary
Election will be held in conjunction therewith, and
WHEREAS, initiative petitions have been filed with the Finance
Office, City of Aberdeen, regarding a proposed Ordinance amending
Section 4-53 of Chapter 4 of the Revised Ordinances of Aberdeen, South
Dakota, relating to Sale of Alcoholic Beverages on Sundays between 11:00
a.m. and 12:00 midnight with the serving of food, and
WHEREAS, referendum petitions have been filed with the Finance
Office, City of Aberdeen, regarding Resolution No. 03-10-06R, the
Creation of Tax Incremental District No. 3, and
NOW THEREFORE, BE IT RESOLVED, by the Aberdeen City Commission,
Aberdeen, South Dakota, that the election for the Offices of City
Commissioner and Mayor, and the election on the initiated measure and
referendum measure, as identified above, shall be held at the time set
for the combined City of Aberdeen, Aberdeen School District 6-1, and
Brown County Primary Election, being the 1st day of June,
2004, and
BE IT FURTHER RESOLVED, that pursuant to SDCL 9-13-25, the person
receiving the highest number of votes for the Offices of Commissioner
and Mayor shall be declared elected and no secondary election shall be
held, and
BE IT FURTHER RESOLVED, that the Brown County Auditor, Aberdeen
School District 6-1 Business Manager, and the Municipal Finance Officer
shall be in charge of said election and shall conduct the election
pursuant to SDCL 9-13 and 9-20, and
BE IT FURTHER RESOLVED that the Board of Aberdeen City
Commissioners, Aberdeen School Board, and the Board of Brown County
Commissioners shall meet on the Thursday immediately following the
election, on the 3rd day of June, 2004 at 4:00 p.m., for the
purpose of canvassing the return and taking such other and further
action relative to the matter voted on as may be deemed necessary and
expedient.
IT IS FURTHER RESOLVED that this resolution being necessary for
the immediate preservation of the public heath and safety, and support
of the municipal government and its existing public institutions, shall
take effect upon passing and publication thereof.

approve the following resolution: RESOLUTION FOR ANNEXATION OF CERTAIN PROPERTY TO THE
CITY LIMITS OF THE CITY OF ABERDEEN BE IT RESOLVED by the Aberdeen City Commission, Brown County, Aberdeen, South Dakota that the Voluntary Petition to annex the following described property filed by Lucian E. Jones is hereby granted and the following described property is hereby added to the municipal boundaries of the City of Aberdeen, South Dakota and shall be within the city limits of said city. Said property described as follows:
Lot 2 of L & M Subdivision in the SE ¼, Sec. 16, T123N-R63W
of the 5th P.M., Brown County, South Dakota, including all
public right-of-way located adjacent thereto, said plat is recorded as
hanging plat number 1864H, at the Register of Deeds of Brown County,
South Dakota.
BE IT FURTHER RESOLVED by the Aberdeen City Commission, Brown
County, Aberdeen, South Dakota that the Mayor of the City of Aberdeen
shall cause an accurate map of such territory together with a copy of
