COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 5:30 p.m., April 26, 2004, Joint City/County meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Forkel, Klabo, Omland and Richardson.

            County Commissioners present were Feickert, Wiese and Hansen.  Commissioners Knecht and Fischbach were absent.

ORDINANCE NO. 04-03-01-290

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Section 701 (A-1) to Section 714 (M-Ag) property described as:  Lots 1, 3 and 4 of Hansen Subdivision in the NE ¼ of Section 17, T123N-R64W of the 5th P.M. Brown County, South Dakota, and extending to the centerline of all public right-of-way located adjacent thereto, was presented.  Commissioner Forkel moved, Commissioner Omland seconded to approve first reading of Ordinance No. 04-03-01.  Upon roll call, all voting aye, motion carried.

            Commissioner Wiese moved, Commissioner Hansen seconded to approve first reading of Ordinance No. 04-03-01-290.  All present voting aye, motion carried.

ORDINANCE NO. 04-04-01-291

            An Ordinance amending Section 502 (Accessory Building or Use), Section 502 (Building Accessory) 703.2.8, 704.2.1, 705.2.1, 706.5.14, 707.2.10, 708.2.19, 715.2.2 and 716.2.7 of Ordinance No. 1164, as amended, known as the Zoning Ordinance of the City of Aberdeen, South Dakota, amending definitions and residential and commercial regulations pertaining to Accessory Buildings and or Structures, was presented.  Commissioner Richardson moved, Commissioner Klabo seconded to approve first reading of Ordinance No. 04-04-01.  Upon roll call, all voting aye, motion carried.

            Commissioner Wiese moved, Commissioner Hansen seconded to approve first reading of Ordinance No. 04-04-01-291.  All present voting aye, motion carried.

ORDINANCE NO. 04-04-02-292

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Section 701 (A-1) to Section 715 (R-2A) property described as:  The North 660’ of the East 660’ of the NW ¼ of Section 5, T122N-R63W of the 5th P.M., Brown County, South Dakota, was presented.  Commissioner Omland moved, Commissioner Forkel seconded to approve first reading of Ordinance No. 04-04-02.  Upon roll call, all voting aye, motion carried.

            Commissioner Wiese moved, Commissioner Hansen seconded to approve first reading of Ordinance No. 04-04-02-292.  All present voting aye, motion carried.

            There being no further business before the Joint Commission, Commissioner Forkel moved, Commissioner Omland seconded to adjourn to the regular City Commission Meeting.  All voting aye, motion carried.

            Mayor Hopper led the Pledge of Allegiance.

MINUTES

            Commissioner Richardson moved, Commissioner Omland seconded to approve the minutes of April 19, 2004, as circulated.  All voting aye, motion carried.

REQUEST – NE REGIONAL HEALTH & FITNESS CENTER

            Commissioner Richardson moved, Commissioner Klabo seconded to continue for one week the request/proposal from the Northeast Regional Health & Fitness Center.  All voting aye, motion carried.

PROCLAMATION

            Mayor Hopper read and proclaimed May 2, 2004 as “Loyalty Day”.

RECOGNITION

            Dale Jorgensen was recognized for attaining his Class II Water Treatment Operator Certification.  Commissioner Klabo explained the program and offered congratulations.

ORDINANCE NO. 04-04-03

            Ordinance No. 04-04-03 – That the Revised Ordinances, City of Aberdeen, South Dakota, is hereby amended by revising a Section Numbered 16-61. Nuisance Defined and Prohibited, was presented.  Commissioner Richardson moved, Commissioner Omland seconded to approve first reading of Ordinance No. 04-04-03.  Upon roll call, all voting aye, motion carried.

ORDINANCE NO. 04-04-05

            Ordinance No. 04-04-05 – That the Revised Ordinances, City of Aberdeen, South Dakota, is hereby amended by adding sections to be numbered 16-62, 16-63, 16-64, 16-65, 16-66, was presented.  Commissioner Klabo moved, Commissioner Richardson seconded to approve first reading of Ordinance No. 04-04-05.  Upon roll call, all voting aye, motion carried.

            Commissioner Omland moved, Commissioner Forkel seconded to set a hearing date of May 17, 2004 at 5:30 p.m. for Petitions to Vacate Public Right-of-Way:  A public alley, 16’ wide, 47’ East and West, located East of State Street South between Railroad Avenue SE and First Avenue SE; A public alley 16’ wide, 75’ North and South, located East of State Street South between vacated Fourth Avenue SE and Vacated Fifth Avenue SE.  All voting aye, motion carried.

PERMISSION TO PURCHASE

            A request from the Fire Department for permission to purchase $28,495.00 in equipment using funds from a US Department of Justice Grant was presented.  Commissioner Richardson moved, Commissioner Forkel seconded to approve the request.  All voting aye, motion carried.

CONTRACT AND BOND

            Commissioner Richardson moved, Commissioner Omland seconded to approve and authorize the Mayor to sign contract and bonds for Third Avenue SW Street Improvements (Project ST-2004-2) – B & B Contracting.  All voting aye, motion carried.

CONTRACT

            Commissioner Klabo moved, Commissioner Richardson seconded to approve and authorize the Mayor to sign contract/agreement for Water Quality Improvement in Elm Lake Watershed.  All voting aye, motion carried.

REQUESTS FOR WATER

            Commissioner Forkel moved, Commissioner Richardson seconded to approve the following plats:  Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing Crompton First Addition in the NW ¼ of Section 23, T123N R63W of the 5th P.M., Brown County, South Dakota, having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing Volk/Johnson Subdivision in NE ¼ Sec. 4-T123N-R64W of 5th P.M., Brown County, South Dakota, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing Burdette’s First Subdivision in Aberdeen, South Dakota, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            Commissioner Klabo moved, Commissioner Forkel seconded to vacate prior motion for Burdette’s First Subdivision in Aberdeen, South Dakota.  All voting aye, motion carried.

            Commissioner Klabo moved, Commissioner Richardson seconded to approve Burdette’s First Subdivision in Aberdeen, South Dakota, contingent upon staff stipulations.  All voting aye, motion carried.

            Commissioner Richardson moved, Commissioner Forkel seconded to approve the following plats contingent upon stipulations recommended by the Planning Commission:  Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing Hagerty and Lloyds Third Subdivision in the SE ¼ of Section 13- T123N-R64W of the 5th P.M., Aberdeen, South Dakota having been examined is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing Swanhorst First Subdivision in Aberdeen, South Dakota, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3 and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing Droog’s First Subdivision in S1/2 Sec. 22-T123N-R64W of 5th P.M., Brown County, South Dakota, having been examined is hereby approved in accordance with provisions of SDCL of 1967, Chapter 11-3 and any amendments thereof. 

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing Gross 3rd Subdivision in NW ¼ Sec. 34-T124N-R64W of 5th P.M., Brown County, South Dakota having been examined, is hereby approved in accordance with provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            Commissioner Richardson moved, Commissioner Klabo seconded to approve the following plat contingent upon staff recommendation to be rezoned as C-3/R-4:  Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing Hagerty and Lloyds Second Subdivision in the SE ¼ of Section 13-T123N-R64W of the 5th P.M. Aberdeen, South Dakota, having been examined, is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof.  All voting aye, motion carried.

BOND

            Commissioner Richardson moved, Commissioner Forkel seconded to receive and place on file a Excavator’s Bond for Thomas Hanson dba TC’s Lawn Care.  All voting aye, motion carried.

TRAVEL

            Commissioner Klabo moved, Commissioner Forkel seconded to approve a travel request for Dan Ostrander, Forester.  All voting aye, motion carried.

PAY ESTIMATES

            Commissioner Richardson moved, Commissioner Forkel seconded to approve and authorize the Mayor to sign and approve payment of Pay Est. #3 – WW SCADA System – Design Solution & Integration - $117,361.20; Pay Est. #5 – Engineering for WW Facilities Plan – Banner Associates - $2,769.50.  Upon roll call, all voting aye, motion carried.

DEPARTMENT REPORTS

            Commissioner Richardson moved, Commissioner Omland seconded to receive and place on file the following department reports:  Aberdeen Regional Airport Board Minutes; Alexander Mitchell Library Minutes; Mayor’s Committee for People with Disabilities Minutes; Park & Recreation Board Minutes; Board of Zoning Adjustment Minutes; Brown County/Aberdeen City Planning Commission Minutes; Riverside & Memorial Cemeteries Burial Report.  All voting aye, motion carried.

            Commissioner Forkel moved, Commissioner Omland seconded to approve the following audited claims for supplies, service, repairs and maintenance:  Postmaster 1,500.00; United Parcel Service 39.17; First Administrators Inc 39,772.98.  Upon roll call, all voting aye, motion carried.

RESIGNATION

            Commissioner Klabo moved, Commissioner Omland seconded to receive and place on file the resignation from Steven Sawyer from the Housing and Redevelopment Commission.  All voting aye, motion carried.

EXECUTIVE SESSION

            Commissioner Omland moved, Commissioner Klabo seconded to move into executive session to discuss personnel.  All voting aye, motion carried.

            Commissioner Forkel moved, Commissioner Richardson seconded to move out of executive session.  All voting aye, motion carried.

POLICE DEPARTMENT

            Commissioner Forkel moved, Commissioner Klabo seconded to table the discussion of Police Department matters with Harvey Oliver.  All voting aye, motion carried.

POLICE CHIEF HIRING TIMELINE

            Commissioner Forkel moved, Commissioner Omland seconded to adopt a timeline to interview and select the new Police Chief during the weeks of June 7 – June 18, 2004 with the Mayor Elect and Commissioner Elect participating as non-voters.  Upon roll call Commissioners Forkel, Omland and Mayor Hopper voting aye, Commissioner Klabo and Richardson voting nay, 3 ayes, 2 nays, motion carried.

ENDOWMENT

            Commissioner Richardson moved, Commissioner Klabo seconded to provide a $50,000 endowment at Northern State University to provide a scholarship fund for Brown County Students as funding becomes available.  All voting aye, motion carried.

STATEWIDE TRANSPORTATION IMPROVEMENT PROGRAM

            Commissioner Richardson moved, Commissioner Omland seconded to add Brown County #19 to the Statewide Transportation Improvement Program for 2009 and authorize the Mayor to sign any necessary documents.   All voting aye, motion carried.

AGREEMENT

            Commissioner Richardson moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign Agreement with BNSF Railroad for repair of railroad crossing at Main Street.  All voting aye, motion carried.

APPLICATION

            Commissioner Omland moved, Commissioner Forkel seconded to approve and authorize the Mayor to sign notice of intent application with the South Dakota Department of Environment and Natural Resources to obtain coverage under a storm water permit for Third Avenue SW Street Improvements Project (ST-2004-2).  All voting aye, motion carried.

FUNDING REQUEST

            Commissioner Klabo moved, Commissioner Richardson seconded to approve a funding request for a Paralegal Intern for Mark A. Anderson.  All voting aye, motion carried.

REQUEST PERMISSION

            Commissioner Richardson moved, Commissioner Omland seconded to approve a request to use Ampride Station for the purchasing of E85 Fuel for the Police Department Chevy Tahoe’s.  All voting aye, motion carried.

            Commissioner Richardson moved, Commissioner Forkel seconded to approve a request to purchase new radios for Eyestone, North Well and Plant Telemetry in the amount of $3,077.25.  All voting aye, motion carried.

EXTENSION REQUEST

            An extension request for an additional one year to May 13, 2005 on Building Permit #26771 for Mrs. Chuck Blumhardt, owner of property at 124 South Fourth Street, was presented.  Commissioner Omland moved, Commissioner Forkel seconded to approve request.  All voting aye, motion carried.

REQUESTS PERMISSION

            A request from the Public Works Department for permission to purchase gasoline and diesel fuels off the state contracts, was presented.  Commissioner Richardson moved, Commissioner Forkel seconded to approve as recommended by Clarence Fjeldheim.  All voting aye, motion carried.

CONTRACTS AND BONDS

            Commissioner Richardson moved, Commissioner Omland seconded to approve the following contracts and bonds:  Watermains, Gate Valves, Coupling, Manholes & Inlets – Sioux Pipe, Inc.; 3,500 Tons of Crushed Gravel Base & 3,000 Tons of Pea Gravel – Lien Transportation; 1,500 Tons of Crushed Chip Seal Aggregate – Lien Transportation; and 7,000 Tons of Asphaltic Concrete Mix, Glass G Type II – Lien Transportation.  All voting aye, motion carried.

PAY REQUEST

            Commissioner Omland moved, Commissioner Richardson seconded to approve payment for pay request for 2004 Ford E-450 Ambulance – Wheeled Coach in the amount of $82,920.00.  Upon roll call, all voting aye, motion carried.

PAY ESTIMATES

            Commissioner Klabo moved, Commissioner Richardson seconded to approve and authorize the Mayor to sign and approve payment for Pay Est. #17 – Engineering for WTP Improvements – Banner & Associates $343,224.23; and Pay Est. #5 – Work on 2nd Street Improvements – Upper Plains Contracting $61,552.51.  Upon roll call, all voting aye, motion carried.

LICENSE

            Commissioner Forkel moved, Commissioner Omland seconded to approve a transient merchant license for Daniel Joseph Fabian, contingent upon recommendation from the Police Department.  All voting aye, motion carried.

            Commissioner Richardson moved, Commissioner Omland seconded to receive and place on file a lottery notices for NSU Foundation and Knights of Columbus and Presentation Sisters.  All voting aye, motion carried.

ABERDEEN REGIONAL AIRPORT

            Commissioner Richardson moved, Commissioner Omland seconded to approve a recommendation from the Airport Board to accept a proposal from Jim Sandvig for a bar and grill at the Airport.  All voting aye, motion carried.

            Commissioner Richardson moved, Commissioner Forkel seconded to approve and authorize the Transportation Director to sign Agreement between Brown County Communications and the Airport.  All voting aye, motion carried.

            Commissioner Richardson moved, Commissioner Klabo seconded to approve recommendation to award the bid for Taxiway “C” and ARFF Building Access Improvements to Sherbrooke Asphalt, Inc.  All voting aye, motion carried.

NOMINATING PETITIONS

            Commissioner Klabo moved, Commissioner Richardson seconded to receive and place on file nominating petitions for Jim Gohn, Jay Omland and Allan Wellman that have been determined to be legally sufficient.  All voting aye, motion carried.

WARRANTY DEED

            Commissioner Omland moved, Commissioner Forkel seconded to approve and authorize the Mayor to sign and transfer property for Warranty Deed to H & H Office Building Partnership.  All voting aye, motion carried.

RESOLUTION NO. 04-04-04 R

            Commissioner Richardson moved, Commissioner Forkel seconded to approve resolution authorizing Mayor to sign execute and deliver documents to deed interests to S.D. Broadcasting Company, contingent upon approval of documents by City Attorney:

            WHEREAS, the Aberdeen Board of Commissioners passed a resolution on October 25, 1977 with an effective date of November 27, 1977; and

 

            WHEREAS, the purpose of said resolution was to approve the issuance of industrial revenue bonds (hereinafter referred to as “the Bonds”), to help pay for financing costs for the construction of a new television studio by the South Dakota Broadcasting Company; and

 

            WHEREAS, the Bonds are paid off and the City of Aberdeen’s interest in the property securing the Bonds will extinguish; and

 

            WHEREAS, the property securing the Bonds is legally described as:

 

            Lot Nine (9) B, of the Replat of Lot Nine (9), Auto Plaza Addition, Brown County, South Dakota, located in the Northeast Quarter (NE1/4) of Section Fourteen (14), Township 123, Range Sixty-Four (64), West of the Fifth P.M., Brown County, South Dakota, and all easements, rights of way and appurtenances thereto;

 

            It is hereby resolved that the Mayor, on behalf of the City of Aberdeen, is hereby authorized to sign, execute and deliver by the appropriate deed any interest in the above described property, upon the completed payment of said Bonds.

 

            All voting aye, motion carried.

 

AMENDED INTERGOVERNMENTAL AGREEMENT

            Commissioner Richardson moved, Commissioner Forkel seconded to approve and authorize the Mayor to sign Amended Intergovernmental Agreement with Brown County Regional Communications Council with Brown County and City of Aberdeen.  All voting aye, motion carried.

CONTRACT

            Commissioner Richardson moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign contract with Northern Water Works Supply for Fernco Couplings, Sewer Pipe and PVC Elbows.  All voting aye, motion carried.

PLATS

            Commissioner Richardson moved, Commissioner Omland seconded to approve the following plats with stipulations recommended by the Planning Commission:  Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing Erickson & Meier 1st Subdivision in Aberdeen, South Dakota, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            Be it resolved by the Board of Commissioners of Aberdeen, South Dakota, that the plat showing Wagner Holdings Second Addition in the W1/2 of Sec. 17, T. 123 N., R. 63 W. of the 5th P.M., Brown County, South Dakota, having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

TRAVEL REQUEST

            Commissioner Omland moved, Commissioner Richardson seconded to approve a travel request for Brent Koens to attend an Advanced SRO Class in Sioux Falls.  All voting aye, motion carried.

A RESOLUTION SUPPORTING THE CONSTRUCTION OF A TURKEY PROCESSING FACILITY IN BROWN COUNTY

 

BE IT RESOLVED by the Aberdeen City Commission, Brown County, Aberdeen, South Dakota as follows:

 

WHEREAS, there is discussion and planning taking place at the current time regarding a turkey processing facility to be located within Brown County or the surrounding area;

 

WHEREAS, the Aberdeen City Commission has always maintained a strong cooperative effort and commitment with the Aberdeen Development Corporation to ensure high quality jobs in the community of Aberdeen, Brown County and surrounding Counties;

 

WHEREAS, the Aberdeen City Commission recognizes the benefits this turkey processing facility will produce for Aberdeen and surrounding communities in the way of increased jobs and quality of life;

 

WHEREAS, the Aberdeen City Commission recognizes the strong work ethic of the people of this area and that this work ethic will be a benefit to the turkey processing facility;

 

WHEREAS, a decision will be made shortly as to the location of the facility;

 

THEREFORE, the Aberdeen City Commission, Brown County, South Dakota, wants to maintain it’s commitment to the industrial and economic success of Aberdeen, Brown County, and surrounding areas, by wholeheartedly supporting the construction of the turkey processing facility in or near Aberdeen, South Dakota and urges the representatives of the facility to realize that support and to make an affirmative decision by selecting a site beneficial to the turkey processing facility and the citizens of this area.

            Commissioner Forkel moved, Commissioner Richardson seconded to receive and place on file the nominating petitions that have been determined to be legally sufficient:  Michael Erickson, Tony Janusz and Roland “Walt” Walter.  All voting aye, motion carried.

INITIATIVE PETITION

            Commissioner Omland moved, Commissioner Klabo seconded to receive and place on file a Petition for an Ordinance amending Sec. 4-53 of Chapter of the Revised Ordinances of Aberdeen, SD relating to sale of alcoholic beverages on Sundays (petition determined to be legally sufficient).  All voting aye, motion carried.

            Commissioner Forkel moved, Commissioner Richardson seconded to approve the Initiative Petition to the voters of the City of Aberdeen at the June 1, 2004 Municipal Election for its approval or rejection.  All voting aye, motion carried.

ORDINANCE NO. 04-03-02

            Ordinance No. 04-03-02 – An Ordinance amending Sec. 24-229 of the Revised Ordinances of the City of Aberdeen No. 1567 Amended to change early morning parking, was presented.  Commissioner Richardson moved, Commissioner Omland seconded to approve first reading of Ordinance No. 04-03-02.  Upon roll call, all voting aye, motion carried.

ORDINANCE NO. 04-04-04

            Ordinance No. 04-04-04 – An Ordinance amending Section 23-32 and Section 23-35 of the Revised Ordinance, City of Aberdeen, South Dakota as amended, setting forth the rates and uses of taxes allowable by South Dakota Codified Law, was presented.  Commissioner Richardson moved, Commissioner Forkel seconded to approve first reading of Ordinance No. 04-04-04.  Upon roll call, all voting aye, motion carried.

RESOLUTION NO. 04-04-01 R

            Commissioner Forkel moved, Commissioner Richardson seconded to approve the following resolution:

RESOLUTION SETTING THE TIME OF

THE ANNUAL ELECTION FOR THE YEAR 2004

 

            WHEREAS, the first Tuesday of June of each year is by law designated as the time for holding the combined City of Aberdeen, Aberdeen School District 6-1, and Brown County Primary Election and said date in 2004 is the 1st day of June, 2004, and

 

            WHEREAS, it has been determined that the regular City of Aberdeen, Aberdeen School District 6-1, and Brown County Primary Election will be held in conjunction therewith, and

 

            WHEREAS, initiative petitions have been filed with the Finance Office, City of Aberdeen, regarding a proposed Ordinance amending Section 4-53 of Chapter 4 of the Revised Ordinances of Aberdeen, South Dakota, relating to Sale of Alcoholic Beverages on Sundays between 11:00 a.m. and 12:00 midnight with the serving of food, and

 

            WHEREAS, referendum petitions have been filed with the Finance Office, City of Aberdeen, regarding Resolution No. 03-10-06R, the Creation of Tax Incremental District No. 3, and

 

            NOW THEREFORE, BE IT RESOLVED, by the Aberdeen City Commission, Aberdeen, South Dakota, that the election for the Offices of City Commissioner and Mayor, and the election on the initiated measure and referendum measure, as identified above, shall be held at the time set for the combined City of Aberdeen, Aberdeen School District 6-1, and Brown County Primary Election, being the 1st day of June, 2004, and

 

            BE IT FURTHER RESOLVED, that pursuant to SDCL 9-13-25, the person receiving the highest number of votes for the Offices of Commissioner and Mayor shall be declared elected and no secondary election shall be held, and

 

            BE IT FURTHER RESOLVED, that the Brown County Auditor, Aberdeen School District 6-1 Business Manager, and the Municipal Finance Officer shall be in charge of said election and shall conduct the election pursuant to SDCL 9-13 and 9-20, and

 

            BE IT FURTHER RESOLVED that the Board of Aberdeen City Commissioners, Aberdeen School Board, and the Board of Brown County Commissioners shall meet on the Thursday immediately following the election, on the 3rd day of June, 2004 at 4:00 p.m., for the purpose of canvassing the return and taking such other and further action relative to the matter voted on as may be deemed necessary and expedient.

 

            IT IS FURTHER RESOLVED that this resolution being necessary for the immediate preservation of the public heath and safety, and support of the municipal government and its existing public institutions, shall take effect upon passing and publication thereof.

 

            All voting aye, motion carried.

 

RESOLUTION NO. 04-04-02 R

            Commissioner Richardson moved, Commissioner Omland seconded to approve the following resolution:

RESOLUTION FOR ANNEXATION OF CERTAIN PROPERTY TO

THE CITY LIMITS OF THE CITY OF ABERDEEN

 

            BE IT RESOLVED by the Aberdeen City Commission, Brown County, Aberdeen, South Dakota that the Voluntary Petition to annex the following described property filed by Lucian E. Jones is hereby granted and the following described property is hereby added to the municipal boundaries of the City of Aberdeen, South Dakota and shall be within the city limits of said city.  Said property described as follows:

 

            Lot 2 of L & M Subdivision in the SE ¼, Sec. 16, T123N-R63W of the 5th P.M., Brown County, South Dakota, including all public right-of-way located adjacent thereto, said plat is recorded as hanging plat number 1864H, at the Register of Deeds of Brown County, South Dakota.

 

            BE IT FURTHER RESOLVED by the Aberdeen City Commission, Brown County, Aberdeen, South Dakota that the Mayor of the City of Aberdeen shall cause an accurate map of such territory together with a copy of this Resolution duly certified to be recorded in the Office of the Register of Deeds, Brown County.

 

            All voting aye, motion carried.

 

APPOINTMENT

            Commissioner Klabo moved, Commissioner Forkel seconded to appoint Mark Malchow as new BID Board Member.  All voting aye, motion carried.

SEVERANCE AGREEMENT

            Commissioner Forkel moved, Commissioner Richardson seconded to approve Severance Agreement.  Upon roll call, Commissioners Forkel, Klabo, Omland and Richardson voting aye, Mayor Hopper voting nay, 4 ayes, 1 nay, motion carried.

STATEWIDE TRANSPORTATION PROGRAM

            City Engineer Robin Bobzien discussed the timeline on the street improvement schedule.  No action was taken.

ADVERTISEMENT FOR BIDS

            Commissioner Klabo moved, Commissioner Forkel seconded to set a bid date of April 28, 2004 at 2:00 p.m. for bid for Aberdeen Water Treatment Plant Well Field Expansion and Raw Water Pipeline.  All voting aye, motion carried.

            Commissioner Forkel moved, Commissioner Richardson seconded to set a bid date of April 21, 2004 at 2:00 p.m. for bid for Ride Line Fuel System (Project TR-2004-1).  All voting aye, motion carried.

PETITIONS TO VACATE

            Commissioner Richardson moved, Commissioner Omland seconded to refer to the City Attorney, Engineer and Planning/Zoning Director for review, the following petitions to vacate public right-of-way:  A public alley, 16’ wide, 75’ north and south, located east of State Street South, between vacated Fourth Avenue SE and vacated Fifth Avenue SE; A public alley, 16’ wide, 47’ east and west, located east of State Street South, between Railroad Avenue SE and First Avenue SE; A public alley, 16’ wide, 100’ east and west, located west of Fourth Street South, between Fifth Avenue SW and Sixth Avenue SW.  All voting aye, motion carried.

SET HEARING DATE

            Commissioner Klabo moved, Commissioner Forkel seconded to set a Joint Hearing Date of April 26, 2004 at 5:30 p.m. for Proposed Amendment to Zoning Ordinance No. 1164: Amending Sec. 502 (Accessory Building or Use), Sec. 502 (Building Accessory) 703.2.8, 704.2.1, 705.2.1, 706.5.14, 707.2.10, 708.2.19, 715.2.2 and 716.2.7 of Ordinance No. 1164, as amended, known as the Zoning Ordinance of the City of Aberdeen, SD, amending definitions and residential and commercial regulations pertaining to accessory buildings and or structures.  All voting aye, motion carried.

SET HEARING DATE

            Commissioner Omland moved, Commissioner Richardson seconded to set a Joint Hearing Date of April 26, 2004 at 5:30 p.m. for Petition to Rezone: Rezone from Sec. 701 (A-1) to Sec. 715 (R-2A) property described as: The North 660’ of the East 660’ of the NW ¼ of Sec. 5, T122N-R63W of the 5th P.M., Brown County, South Dakota (38945 136th Street).  All voting aye, motion carried.

CONTRACTS & BONDS

            Commissioner Richardson moved, Commissioner Forkel seconded to approve and authorize the Mayor to sign contracts and bonds for Traffic Signal System – Melgaard & Roosevelt Street (ST-2004-1) – Muth Electric, Inc.; and 2004 Annual Concrete Work – Wright & Sudlow, Inc.  All voting aye, motion carried.

REQUEST TO ACCEPT QUOTE

            Commissioner Omland moved, Commissioner Klabo seconded to approve a request to accept quote from Quality Quick Print to print 2004 Aberdeen Water Consumer Confidence Reports.  All voting aye, motion carried.

RECOMMENDATION ON BIDS

            The following bids were opened and read for Elevated Tank Painting (Fairground Water Tower – Project W-2004-1):  H & H Contracting, Scotland, SD - $164,700.00; Maquire Iron, Inc., Sioux Falls, SD - $169,930.00; TMI Coatings, St. Paul, MN - $236,200.00; Utility Service Co., Perry, Georgia - $236,442.00; Tenyer Coatings, Inc., Badger, MN - $257,800.00.  Commissioner Forkel moved, Commissioner Richardson seconded to award low bid to H & H Contracting.  All voting aye, motion carried.

            Commissioner Richardson moved, Commissioner Omland seconded to approve payment for the following pay requests:  Boxes & Hoists – Northern Truck Equipment $27,988.00; 2004 International Truck – Crawford Truck Sales $46,660.00; 2004 International Tandem – Crawford Truck Sales $42,660.00.  Upon roll call, all voting aye,  motion carried.
