COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 6:30 p.m., August 27, 2001, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Klabo, Omland, and Pfeifer.  Commissioner Kirkpatrick was absent.

MINUTES

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve the minutes of August 20, 2001, as circulated.  All present voting aye, motion carried.

CONTINUED - PETITION TO VACATE PUBLIC RIGHT-OF-WAY

            Commissioner Omland moved, Commissioner Klabo seconded to refer the following petition to vacate public right-of-way to City Attorney, City Engineer, and City Planning/Zoning Director for their review and recommendation:  Fourth Avenue, SE from Illinois Street South to Montrose Street and Kenmore Street from Third Avenue, SE to Fourth Avenue, SE (2700 and 2800 Blocks of Fourth Avenue, SE).  All present voting aye, motion carried.

ORDINANCE NO. 01-08-04

            Ordinance No. 01-08-04 - An Ordinance amending Ordinance No. 1164 to rezone certain described property from Section 705 (R-3) to Sections 706 (C-1)/711 (R-4) property described as:  Lots 16, 17, and 18, Block 5 of “Hagerty and Lloyd’s Corrected Plat to Aberdeen” said plat is recorded as Hanging Plat Number 11 at the Register of Deeds of Brown County, South Dakota and extending to the centerline of all public right-of-way located adjacent thereto (724 North Kline Street), was presented for first reading.  Commissioner Klabo moved, Commissioner Pfeifer seconded to approve first reading of Ordinance No. 01-08-04.  Upon roll call, all present voting aye, motion carried.

ORDINANCE NO. 01-08-06

            Ordinance  No. 01-08-06 - An Ordinance amending Ordinance No. 1164 to rezone certain described property from Section 704 (R-2) to Section 706 (C-1) property described as:  Lot 8, Block 1 of “Ladner’s Replat” said plat is recorded as Hanging Plat Number 249 at the Register of Deeds of Brown County, South Dakota and extending to the centerline of all public right-of-way located adjacent thereto (802 Eighth Avenue, NE), was presented for first reading.  Commissioner Omland moved, Commissioner Pfeifer seconded to approve first reading of Ordinance No. 01-08-06.  Upon roll call, all present voting aye, motion carried.

ORDINANCE NO. 01-08-07

            Ordinance  No. 01-08-07 - An Ordinance amending Ordinance No. 1164 to rezone certain described property from Section 705 (R-3) to Sections 708 (C-3)/711 (R-4) property described as:  Lots 13, 14, and 15, Block 36 of “Second Addition to the Town of Aberdeen” said plat is recorded as Hanging Plat Number 5 at the Register of Deeds of Brown County, South Dakota and extending to the centerline of all public right-of-way located adjacent thereto (218 Seventh Avenue, SW), was presented for first reading.  Commissioner Klabo moved, Commissioner Omland seconded to approve first reading of Ordinance No. 01-08-07.  Upon roll call, all present voting aye, motion carried.

ORDINANCE NO. 01-08-09

            Ordinance No. 01-08-09 - An Ordinance amending Ordinance No. 1164 to rezone certain described property from Section 707 (C-2) to Section 705 (R-3) property described as:  Lot 9, Block 1 of “Garden Park Addition” said plat is recorded as Hanging Plat Number 142 at the Register of Deeds of Brown County, South Dakota and extending to the centerline of all public right-of-way located adjacent thereto (627 South Ninth Street), was presented for first reading.  Commissioner Pfeifer moved, Commissioner Omland seconded to approve first reading of Ordinance No. 01-08-09.  Upon roll call, all present voting aye, motion carried.

EASEMENT

            Commissioner Pfeifer moved, Commissioner Klabo seconded to continue for one week the right-of-way/access easement regarding the Lee Park Golf Course Parking Lot.  All present voting aye, motion carried.

PLATS

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve the following plats:  Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “Plat of St. Pauls Subdivision of Block 36 of Second Addition to Aberdeen in NW ¼ of Section 24-T123N-R64W of the 5th P.M., Brown County, South Dakota”, having been examined, is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “Nelsons 1st Consolidation Addition in Aberdeen, South Dakota”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-6, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “Breckenridge 1st Consolidation Addition in Aberdeen, South Dakota”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-6, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “Fry’s 1st Consolidation Addition in Aberdeen, South Dakota”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-6, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “Merrifield’s First Addition in Aberdeen, South Dakota”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-6, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “Aberdeen Development Corporation 2001-1 Subdivision in Aberdeen, South Dakota”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-6, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “Rivett’s First Camelot Estates Subdivision in Aberdeen, South Dakota”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-6, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing  “Malsam Outlot 1 in the NE ¼ of Section 28-T124N-R64W of the 5th P.M., Brown County, South Dakota”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-6, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “South Dakota Wheat Growers Addition in the NE ¼ of Section 21-T123N-R64W of the 5th P.M., Brown County, South Dakota”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-6, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “Lang Addition in the NE ¼ of Section 33-T124N-R63W of the 5th P.M., Brown County, South Dakota”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “E & J Addition in SE ¼ of Section 16-T123N-R63W of the 5th P.M., Brown County, South Dakota”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-6, and any amendments thereof.

CONTRACTS & BONDS

            Commissioner Omland moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign contracts and bonds for sodium chloride - L & O Acres Transport, Inc. and for sodium chloride - Thorstenson Trucking.  All present voting aye, motion carried.

RECOMMENDATION ON BID

            One bid was received for removal of Dutch Elm Diseased Trees - John’s Tree Service in the amount of $84,665.00.  Commissioner Pfeifer moved, Commissioner Klabo seconded to award the bid to John’s Tree Service.  All present voting aye, motion carried.

SUPPLEMENT REQUEST   

            A request from Forestry Division for a supplement to complete the Dutch Elm Diseased Trees removal process totaling $84,665.00 was presented.  Commissioner Pfeifer moved, Commissioner Omland seconded to approve the request.  All present voting aye, motion carried.

PAY REQUEST

            Commissioner Klabo moved, Commissioner Pfeifer seconded to approve payment request #1 for Digester Cover Replacement - KHC Construction - $252,088.00.  Upon roll call, all present voting aye, motion carried.

LOTTERY

            Commissioner Omland moved, Commissioner Klabo seconded to receive and place on file lottery notices for SPURS Therapeutic Riding Center and Sacred Heart Parish.  All present voting aye, motion carried.

DEPARTMENT REPORTS

            Commissioner Klabo moved, Commissioner Omland seconded to receive and place on file the following department reports:  Aberdeen Regional Airport Board minutes; Alexander Mitchell Library minutes; Riverside & Memorial Cemeteries Burial Report; Aberdeen City Planning Commission minutes; Brown County/Aberdeen City Planning Commission minutes; and Zoning Board of Adjustment minutes.  All present voting aye, motion carried.

            County Commissioners present were Feickert, Fischbach, and Hansen.  Commissioners Knecht and Wiese were absent.

COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 5:30 p.m., August 20, 2001, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Omland and Pfeifer.

EXECUTIVE SESSION

            Commissioner Omland moved, Commissioner Klabo seconded to move into executive session to discuss legal matters.  All voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to move out of executive session.  All voting aye, motion carried.

MINUTES

            Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to approve the minutes of August 13, 2001, with the following correction:  Page 12771 – BID ASSESSMENT – motion should read “Commissioner Kirkpatrick moved, not Commissioner Klabo”.  All voting aye, motion carried.

RECOGNITION

            Mayor Hopper presented Sherrie Gray with a Honorary Citizen Certificate for being selected as Wal-Mart State Teacher of the Year.

COMMUNITY YOUTH CENTER – YAPA

            A request from Youth-Adult Partnership of Aberdeen (YAPA) for funding and administration of a Community Youth Center, was presented.  After discussion, Commissioner Omland moved, Commissioner Pfeifer seconded to approve sponsorship under the Parks, Recreation and Forestry Department.  All voting aye, motion carried.

RESOLUTION

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to approve the following resolution:

RESOLUTION NO. 01-08-05R

RESOLUTION FOR ANNEXATION OF CERTAIN PROPERTY TO

THE CITY LIMITS OF THE CITY OF ABERDEEN

 

            BE IT RESOLVED by the Aberdeen City Commission, Brown County, Aberdeen, South Dakota, that the Voluntary Petition to annex the following described property filed by Helen Fry is hereby granted and the following described property is hereby added to the municipal boundaries of the City of Aberdeen, South Dakota and shall be within the city limits of said city.   Said property described as follows:

 

            Lot 35A of “Hall Nichols Replat of a Portion of Lot 4, Culbert’s Subdivision of the NW ¼ of Sec. 25, T123N-R64W of the 5th P.M., Brown County, South Dakota”, said plat is recorded as Plat Book 3 Page 262 at the Register of Deeds of Brown County, South Dakota.

            BE IT FURTHER RESOLVED by the Aberdeen City Commission, Brown County, Aberdeen, South Dakota that the Mayor of the City of Aberdeen shall cause an accurate map of such territory together with a copy of this Resolution duly certified to be recorded in the Office of the Register of Deeds, Brown County.

PETITION TO VACATE PUBLIC RIGHT-OF-WAY

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to continue for one week the petition to vacate public right-of-way: Fourth Avenue SE from Illinois Street South to Montrose Street; Kenmore Street from Third Avenue SE to Fourth Avenue SE (2700 & 2800 Blocks of Fourth Avenue SE).  All voting aye, motion carried.

SET HEARING DATE

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to set a hearing date of September 4, 2001 at 9:00 a.m. for applications for Transfers of Retail On-Sale Liquor, Package Off-Sale Liquor, and Retail On-Sale Wine Licenses from River Oakes, Inc. dba The Aspen Room, 715 Lancelot Drive to The Refuge Lounge, Inc. dba The Refuge Lounge, 715 Lancelot Drive.     All voting aye, motion carried.

RECOMMENDATION ON BID - LAND

            One bid was received for the surplus land located at Lot 1, Block 1 of Woolverton’s Addition to the City of Aberdeen”, except the East 50’ adjoining the East lot line of Lot 1, Block 1 of “Woolverton’s Addition to the City of Aberdeen” - $200.00 – Bank of Hoven.  Commissioner Pfeifer moved, Commissioner Klabo seconded to accept the above bid.  All voting aye, motion carried.

RECOMMENDATION ON BIDS – LIBRARY

            Bids for Library Asbestos Abatement Project were opened and publicly read August 15, 2001.  Low bidder was K.M.B. Diversified Services – Bid Item I Base Bid - $48,315.00; Bit Item II – Add Alternate - $1,650.00.  A detailed bid list is on file in the Finance Office.  Commissioner Pfeifer moved, Commissioner Omland seconded to award the low bid to K.M. B. Diversified Services in the amount of $49,965.00.  All voting aye, motion carried.

ABERDEEN REGIONAL AIRPORT

            Commissioner Pfeifer moved, Commissioner Klabo seconded to set a bid date of September 6, 2001 at 11:30 a.m. at Airport Manager’s Office for 2001-2002 Snow Removal at the Airport.  All voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign Agreement for Professional Services for Airport AIP #3-46-0001-21 with Helms and Associates.  All voting aye, motion carried.

APPOINTMENT

            Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to approve appointment of Robin Bobzien as Voting Delegate and Clarence Fjeldheim as Alternate to vote at Annual or Special Meetings of Northern Electric Coop.  All voting aye, motion carried.

PAY REQUESTS

            Commissioner Klabo moved, Commissioner Omland seconded to approve and authorize the Mayor to sign and approve payment of the following Pay Requests:  #5 & #6 – Banner Associates  - 1,843.20; #4 & #5 – Banner Associates -  410.77; #7 & #8 – Banner Associates - $975.00; #17 – Banner Associates 1,347.14; #3 & #4 – Banner Associates – 4,375.00.  Upon roll call, all voting aye, motion carried.

LICENSE

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve Taxi Cab Driver License for Katrina Ackerman, contingent upon Police Department recommendation.  All voting aye, motion carried.

COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 6:30 p.m., August 13, 2001, regular meeting of the Board of Commissioners, Commissioner Pat Klabo presiding.  Present at roll call were Commissioners Kirkpatrick, Omland and Pfeifer.  Mayor Hopper was absent.

MINUTES

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve the minutes of August 6, 2001 as circulated.  All voting aye, motion carried.

BID ASSESSMENT

            Lori Cope, representing the Business Improvement District (BID) was present to discuss the 2202 assessment of $45,000.00.  After discussion, Commissioner Klabo moved, Commissioner Pfeifer seconded to set a hearing date of October 1, 2001 at 6:30 p.m.  All present voting aye, motion carried.

ABERDEEN AREA CRISIS CALL-OUT PROTOCOL (AACCOP)

            Jay Rossman and Assistant Police Chief VanMeter presented Lindsey Gerdes with the Presidential Award for her work in the Peer Ministry Program.

EMPLOYEE ASSISTANCE PROGRAM

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign City’s Employee Assistance Program Contract with Lutheran Social Services.  All present voting aye, motion carried.

PERMISSION TO PURCHASE - FIRE

            A request from the Fire Department for permission to purchase a containment type fill station (used to contain the air bottles used on breathing apparatus while they are being filled), was presented.  The Brown County Fire Chiefs have agreed to provide $4000 towards the purchase with the remaining $4,277.00 to be paid by the City.  Commissioner Pfeifer moved, Commissioner Omland seconded to approve the purchase.  All present voting aye, motion carried.

PERMISSION TO PURCHASE - FIRE

            A request from the Fire and Ambulance Department to supplement their budget for the purchase of nine (9) VHF Radios, was presented.  The State of South Dakota is providing a 50% match.  The total cost for the City would be $18,450.00 and radios will be compatible with the new State Radio System.  Commissioner Omland moved, Commissioner Pfeifer seconded to approve the request.  All present voting aye, motion carried.

PERMISSION TO PURCHASE – POLICE

            A request from the Police Department to supplement their budget for the purchase of fifteen (15) VHF Radios, was presented.  The State of South Dakota is providing a 50% match.  The total cost for the City would be $30,750.00 and radios will be compatible with the new State Radio System.  Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve the request.  All present voting aye, motion carried.

PETITION – VOLUNTARY ANNEXATION

            A Petition of Voluntary Annexation for “Lot 35A of Hall Nichols Replat of a Portion of Lot 4, Culbert’s Subdivision of the NW ¼ of Sec. 25, T123N-R64W of the 5th P.M., Brown County, South Dakota, said plat is recorded as Plat Book 3 Page 262 at the Register of Deeds of Brown County, South Dakota (1887 Eisenhower Circle)”, was presented.  Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to refer this petition to the City Attorney, Engineer and Planning/Zoning Director for review and recommendation.  All present voting aye, motion carried.

RECOMMENDATION ON BIDS

            The following bids for Wastewater Disinfection System Improvements were opened and publicly read:  KHC Construction Inc. - $184,700.00; Schwan Electric Inc. - $238,600.00; Gridor Construction Inc. - $208,900.00; Moorhead Construction Co., Inc. - $201,179.00; Swanberg Construction Inc. - $207,300.00.  Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to award the bid to low bidder KHC Construction Inc. in the amount of $184,700.00.  All present voting aye, motion carried.

PAY ESTIMATE

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign and approve payment of Pay Estimate #7, S. State St. Reconstruction (ST-2000-1) – Lien Transportation -  $2,750.01.  Upon roll call, all present voting aye, motion carried.

PAY REQUESTS

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve payment for the following pay requests:  Utility Services Associates - $5,067.00; Connor & Son Construction - $2,986.72; and Clark Engineering - $2,193.41.  Upon roll call, all present voting aye, motion carried.

ABERDEEN REGIONAL AIRPORT

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign renewal of Airport Hangar Lease #38 with Roger Werth and Pat Retterath.  All voting aye, motion carried.

            Commissioner Omland moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign Federal Assistance Project Application 3-46-0001-21 – Development of Airport.  All present voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign Change Order #3 – AIP 3-46-0001-20 Taxiway Lighting and Electrical Upgrades – Ringgenberg Electric Inc. – increase of $172.00.  All present voting aye, motion carried.

COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 6:30 p.m., August 6, 2001, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Omland and Pfeifer.

MINUTES

            Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to approve the minutes of July 30, 2001, as circulated.  All voting aye, motion carried.

CITY’S COMP PLAN

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to table the City’s Comprehensive Plan – Aberdeen Chamber of Commerce.  All voting aye, motion carried.

EASEMENT – THOMAS PRICE

            Continued discussion was held regarding the Right-of-Way Easement for Thomas L. Price at 923 North Main Street.  After considerable discussion, Commissioner Pfeifer moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign an amended easement.  Upon roll call, Commissioners Omland, Klabo, Pfeifer and Mayor Hopper voting aye, Commissioner Kirkpatrick voting nay, 4 ayes, 1 nay, motion carried.

RESOLUTION NO. 01-08-04 R

      Commissioner Klabo moved, Commissioner Omland seconded to approve the following resolution:

RESOLUTION NO. 01-08-04 R

            WHEREAS, the City Commission of the City of Aberdeen, South Dakota on June 20, 1988, created by resolution Tax Increment District Number One of the City of Aberdeen with boundaries designated as follows:

            The West One-Half (W1/2) of the Southeast Quarter (SE ¼) of Section Seventeen (17) of Township One Hundred Twenty-Three (123) North, Range Sixty-Three (63) West, lying South of the South Boundary of the right-of-way of the Chicago, Milwaukee & St. Paul Railroad; and

            WHEREAS, the City Commission of the City of Aberdeen, South Dakota did by resolution authorize the issuance and sale of not to exceed $2,896,900 Tax Incremental Revenue Bonds, Series 1988; and

            WHEREAS, the creation of said Tax Increment District did significantly enhance the value of substantially all real property within the district and immediately adjacent thereto; and

            WHEREAS, all project costs have been paid and all outstanding tax incremental revenue bonds have been retired;

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ABERDEEN, SOUTH DAKOTA AS FOLLOWS:

            That Tax Incremental District Number One be dissolved in accordance with South Dakota Codified Law (SDCL) 11-9-46 and any moneys remaining be allocated as specified by SDCL 11-9-45.

            All voting aye, motion carried.

HEARING

            This being the time and place set for a hearing on Special One-Day Retail On-Off Sale Malt Beverage Licenses for August 9, 2001 – Aberdeen Area Chamber of Commerce dba Hub City, Inc., 2914 Industrial Ave. and September 13, 2001 – Aberdeen Area Chamber of Commerce dba Presentation College, 1500 North Main, no one was present to testify, Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign application.  All voting aye, motion carried.

GROUP HEALTH INSURANCE

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve the following recommended group health insurance premium changes effective January 1, 2002:  SINGLE – from $200/month to $260/month; 2-PARTY – from $330/month to $430/month; and FAMILY - $400/month to $520/month.  All voting aye, motion carried.

SW DRAINAGE EASEMENT OFFER

            Commissioner Omland moved, Commissioner Klabo seconded to approve payment for SW Drainage Easement Offer and Statement of Compensation for K.O. Lee Company property (.30 acres) in the amount of $210.00.  Upon roll call, all voting aye, motion carried.

APPROPRIATION FOR WATER TREATMENT PLANT

            Senator Tim Johnson was present to inform the Commission of the $2,000,000 Appropriation for the Water Treatment Plant.  No action was taken.

RECOMMENDATION ON BIDS

            The following bids were opened and publicly read for 2001-2002 Deicing Salt, bids are per ton:  Thorstenson Trucking – 34.95; L & O Acres – 34.95; Johnson Feed – 40.50.  Commissioner Pfeifer moved, Commissioner Omland seconded that the two low bidders be awarded one-half the contract amount, as recommended by Clarence Fjeldheim.  All voting aye, motion carried.

PERMISSION TO PURCHASE

            A request from the Public Works Department for permission to purchase a Water Truck Tank, was presented.  Commissioner Omland moved, Commissioner Pfeifer seconded to approve the request.  All voting aye, motion carried.

BOND

            Commissioner Klabo moved, Commissioner Pfeifer seconded to receive and place on file an Excavation Bond for Brian Wolff.  All voting aye, motion carried.

STREET USE

            Commissioner Klabo moved, Commissioner Omland seconded to approve a street use request from Bill Gerdes to hold a block party – 1200 – 1400 Block of North Penn on August 11, 2001.  All voting aye, motion carried.

REQUEST FOR WATER

            A request for water from Helen Brick – Lot 2 of Auditor’s 2nd Subdivision located in the SE ¼ of Section 27, Township 123 North, Range 64 West of the 5th P.M., Brown County, South Dakota, was presented.  Commissioner Pfeifer moved, Commissioner Klabo seconded to notify WEB Water that the City does not intend to service this property at this time.  All voting aye, motion carried.

BILLS

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve the following audited claims for services, supplies, repairs and maintenance:  United Parcel Service 56.87; First American Administrators 40,049.82; Keith Nerison 529.25; Cellularone 813.33; Robert Bradley 275.00.  Upon roll call, all voting aye, motion carried.

LICENSE

            Commissioner Klabo moved, Commissioner Omland seconded to approve a Taxi Cab Drivers License for Chad A. Madsen.  All voting aye, motion carried.

SIRENS

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve donating nine (9) Outdoor Warning System Sirens to Brown County Emergency Management.  All voting aye, motion carried.

OTHER

            The chip sealing process was explained by City Engineer Bobzien.  No action was taken.
