COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 4:00 p.m., August 25, 2003, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Forkel, Kirkpatrick, Klabo and Omland.

EXECUTIVE SESSION

            Commissioner Klabo moved, Commissioner Omland seconded to move into executive session to discuss personnel.  All voting aye, motion carried.

            Commissioner Forkel moved, Commissioner Klabo seconded to move out of executive session.  All voting aye, motion carried.

MINUTES

            Commissioner Forkel moved, Commissioner Omland seconded to approve the minutes of August 18, 2003, as circulated.  All voting aye, motion carried.

ORDINANCE NO. 03-08-02

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Sec. 710 (I-2) to Sec. 707 (C-2) property described as:  Lot 1 of “Ragels Addition to the City of Aberdeen, South Dakota” and extending to the centerline of all public right-of-way located adjacent thereto (621 Sixth Avenue SW), was presented.  Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve first reading of Ordinance No. 03-08-02.  Upon roll call, all voting aye, motion carried.

ORDINANCE NO. 03-08-03

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Sec. 705 (R-3) and Sec. 704 (R-2) to Sec. 704 (R-2) property described as:  Lot 1 of Forest Acres Tenth Addition to the City of Aberdeen, Brown County, South Dakota and extending to the centerline of all public right-of-way located adjacent thereto (610 Melgaard Road SW), was present.  Commissioner Omland moved, Commissioner Forkel seconded to approve first reading of Ordinance No. 03-08-03.  Upon roll call, all voting aye, motion carried.

ORDINANCE NO. 03-08-08

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Sec. 705 (R-3) to Sec. 707 (C-2) property described as:  Lot 2 of Schriver’s First Addition, Lots 1 & 2 to Aberdeen, in the NW ¼ of Sec. 13, T123N-R64W of the 5th P.M., Lots 2, 3, 4 and 33’ North of and adjacent to the North Lot Line of Lots 2, 3 and 4, Block 57 of Bennett and Thomas Addition to North Aberdeen and extending to the centerline of all public right-of-way located adjacent thereto (414 and 424 – 5th Avenue NW), was presented.  Commissioner Klabo moved, Commissioner Forkel seconded to approve first reading of Ordinance No. 03-08-08.  Upon roll call, all voting aye, motion carried.

ORDINANCE NO. 03-08-10

            Ordinance No. 03-08-10 – that the Revised Ordinances, City of Aberdeen, South Dakota, is hereby amended by adding a section, to be numbered 24-58 Powers and Duties Generally, was presented.  Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve first reading of Ordinance No. 03-08-10.  Upon roll call, all voting aye, motion carried.

RESOLUTION NO. 03-08-02 R

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve the following resolution:

            Whereas, the Aberdeen Board of Commissioners has adopted various parking offenses and pursuant to Section 24-221 of the Revised Ordinances of the City of Aberdeen the fines for said offenses are to be established by resolution:

 

            It is hereby resolved that the fines for the following offenses shall be revised to be established as indicated hereafter:

 

            Prohibited Parking                                $5.00

            Parked Against Traffic                5.00

            Improper Parking                                   5.00

 

            All voting aye, motion carried.

 

RESOLUTION NO. 03-08-03 R

            Commissioner Kirkpatrick moved, Commissioner Omland to approve Resolution No. 03-08-03 R – Resolution relating to the lease and leaseback of part or all of the Municipal Wastewater System; authorizing the execution and delivery of various agreements to effect such transaction; fixing certain terms and details thereof and ratifying and authorizing the actions of certain officers of the city; authorizing the refunding of certain state revolving fund loans and the issuance of taxable refunding bonds in evidence thereof.  Upon roll call, all voting aye, motion carried.

RESOLUTION NO. 03-08-04 R

            Commissioner Klabo moved, Commissioner Forkel seconded to approve the following resolution:

RESOLUTION NO. 03-08-04 R

            Whereas, Ordinance No. 1862 was approved by the Aberdeen Board of Commissioners on March 12, 1990 with an effective date of April 5, 1990; and

 

            Whereas, the purpose of Ordinance No. 1862 was to approve the issuance of industrial revenue bonds (hereinafter referred to as “the Bonds”), for the expansion of a building by the Aberdeen Development Corporation; and

 

            Whereas, the Bonds are ready to be paid off and when said payment is completed, the City of Aberdeen’s interest in the property securing the Bonds will extinguish; and

 

            Whereas, the property securing the Bonds is legally described as:

 

            Outlot 3 Aberdeen Industrial Park, in the Northeast Quarter (NE ¼) Section 17, Township 123 North, Range 63, West of the Fifth P.M., according to the plat thereof of record, Brown County, State of South Dakota;

 

            It is hereby resolved that the Mayor, on behalf of the City of Aberdeen, is hereby authorized to sign, execute and deliver by the appropriate deed any interests in the above described property, upon the completed payment of said Bonds.

 

            All voting aye, motion carried.

 

SET HEARING DATE

            Commissioner Omland moved, Commissioner Klabo seconded to set a hearing date of September 15, 2003 at 5:30 p.m. for petition to vacate public right-of-way: A 16’ wide public alley located east of Washington Street South between Third Ave. SE and Fourth Ave. SE.  All voting aye, motion carried.

SET HEARING DATE

            Commissioner Omland moved, Commissioner Forkel seconded to set a hearing date of September 8, 2003 at 5:30 p.m., for the following applications for Alcoholic Beverage Licenses:  Transfer of Retail On-Off Sale Malt Beverage License: From Rivett Group LLC dba Aberdeen East Super 8 Motel, 2401 6th Avenue SE to JCW Investments, LLC dba Aberdeen East Super 8 Motel, 2401 6th Avenue SE; Special One Day Retail On-Off Sale Malt Beverage License for October 4, 2003: Presentation College dba Presentation College Strode Center, 1500 North Main; Special One-Day Retail On-Off Sale Malt Beverage Licenses for September 11, 2003 – Aberdeen Area Chamber of Commerce dba Western Printing Co., 701 N.             Commissioner Kirkpatrick moved, Commissioner Forkel seconded to approve the following plats:  Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing Taylor’s First Subdivision in the NE ¼ of Section 22, T123N T63W of the 5th P.M., Brown County, South Dakota, having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof. 

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “Christopher Addition to the City of Aberdeen, Brown County, South Dakota, having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing Franz Outlot 1 in the NW ¼ Sec. 33-T124N-R63W of the 5th P.M., Brown County, South Dakota, having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve the following plat with stipulations as recommended by the City Planning Commission:  Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing First Replat of Lakeview Addition to the City of Aberdeen, Brown County, South Dakota, having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.  All voting aye, motion carried.

CONTRACT

            Commissioner Omland moved, Commissioner Forkel seconded to approve and authorize the Mayor to sign contingent upon City Attorney’s review, contract for construction engineering services with Helms and Associates for the North 2nd Street Project.  All voting aye, motion carried.

LICENSE

            Commissioner Forkel moved, Commissioner Omland seconded to approve an Advertising/Sign Hanging License for Indigo Signworks, Inc., contingent upon recommendation from Planning/Zoning Director.  All voting aye, motion carried.

LOTTERY

            Commissioner Klabo moved, Commissioner Omland seconded to receive and place on file lottery notices for Scotty Lynn Hinman Benefit and Zion Lutheran Church Women.  All voting aye, motion carried.

COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 5:30 p.m., August 18, 2003, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Forkel, Kirkpatrick, Klabo and Omland.

            Mayor Hopper led the Pledge of Allegiance.

MINUTES

            Commissioner Omland moved, Commissioner Forkel seconded to approve the minutes of August 11, 2003, as circulated.  All voting aye, motion carried.

RECOGNITION

            Mayor Hopper presented Special Olympians April Cease and Jarod Markley with Honorary Citizen Certificates.

BID BOARD

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to receive and place on file the resignations of Todd Forkel and Raphael Mack from the Business Improvement District Board.  All voting aye, motion carried.

            Commissioner Omland moved, Commissioner Forkel seconded to appoint Dan Rux, Sr. to the Business Improvement District Board.  All voting aye, motion carried.

ABERDEEN POLICE DEPARTMENT

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve and authorize the Mayor to sign Memorandum of Understanding between the City of Aberdeen and Brown County regarding the sharing of 2003 Local Law Enforcement Block Grant Funds.  All voting aye, motion carried.

            This being the time and place set for a public hearing regarding the possible uses of the LLE Block Grant Funds, no one was present to testify, Mayor Hopper closed the hearing.

ALEXANDER MITCHELL PUBLIC LIBRARY

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to approve a request from Alexander Mitchell Library to supplement $20,000.00 for Library Temporary Salaries.  All voting aye, motion carried.

            Recognition of Library Accreditation received from the South Dakota library Association was received and placed on file.

            Commissioner Forkel moved, Commissioner Klabo seconded to receive and place on file the 2003 Library Strategic Plan.  All voting aye, motion carried.

PARKS, RECREATION AND FORESTRY

            Commissioner Omland moved, Commissioner Klabo seconded to approve a request from the Forestry Department to declare as surplus property, a 1983 Ford F250 Pickup, FA #2444, Serial #1FTHF2619DPA74656.  All voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Forkel seconded to approve a request from the Forestry Department to purchase a 1992 Ford F150 Pickup for $5,725.00 from the SD Federal Surplus Center.  All voting aye, motion carried.

SET HEARING DATE

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to set a hearing date of September 2, 2003, 9:00 a.m. for application for Transfer of Package Off-Sale Malt Beverage License from James S. & John A. Kokales dba Kokales Fishing Gallery, 624 S. 16th St., to Kenneth D. & Florence W. Kraus dba Kraus Fishing Gallery., 624 S. 16th St.  All voting aye, motion carried.

SURPLUS

            Commissioner Klabo moved, Commissioner Omland seconded to approve a request to declare as surplus property scrap metal at the Water Treatment Plant.  All voting aye, motion carried.

ABERDEEN FIRE DEPARTMENT

            The Aberdeen Fire Department has been awarded a $305,000.00 Grant from the U.S. Department of Justice.  Commissioner Forkel moved, Commissioner Omland seconded to approve acceptance of this Grant.  All voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve a Budget Supplement Request in the amount of $5,000.00 to build a kitchen addition to the east side of the North Fire Station.  All voting aye, motion carried.

CONTRACT & BONDS

            Commissioner Omland moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign contract and bonds for design solutions and integration for Wastewater Treatment plant Supervisory Control and Data Acquisition System.  All voting aye, motion carried.

PAY ESTIMATES

            Commissioner Omland moved, Commissioner Forkel seconded to approve and authorize the Mayor to sign and approve payment for Pay Est. #3 – engineering services for N. 5th St. Project – Helms & Associates $11,543.57; #6 – engineering services for S. 5th St. Project – Helms & Associates – $2,536.02; #10 – work on S. 5th St. Project – Upper Plains Contracting – $126,704.27; Pay Est. #5 – work on N. 5th St. Project – T&R Contracting, Inc. – $189,442.35; Pay Est. #10 – engineering services for WTP Improvements – Banner Associates – $94,350.00.  Upon roll call, all voting aye, motion carried.

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve the minutes of August 4, 2003, as circulated.  All present voting aye, motion carried.

ORDINANCE NO. 03-08-01

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to approve second reading of Ordinance No. 03-08-01, as amended.  Upon roll call, all present voting aye, motion carried.

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve final adoption of Ordinance No. 03-08-01, as amended.  Upon roll call, all present voting aye, motion carried.

ORDINANCE NO. 03-08-09

RESOLUTION NO. 03-08-01 R

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve Resolution No. 03-08-01 R – Resolution relating to Tax Incremental District Two; authorizing the issuance and sale of Tax Incremental Revenue Bonds, Series 2003A and Series 2003B pursuant to South Dakota Codified Laws, Chapter 11-9 to pay the project costs thereof; providing for the security for said bonds; and providing for execution of other documents.  All present voting aye, motion carried.

REQUEST TO PURCHASE

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to approve a request to purchase a replacement vehicle for the Mosquito Abatement Department through the State Surplus Department and to approve a supplement to their budget not to exceed $8,000.00.  All present voting aye, motion carried.

ABERDEEN REGIONAL AIRPORT

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to accept the recommendation from the Airport Board and award the Wildlife Fencing Improvements for AIP Project 3-46-0001-23 Schedule B – to low bidder FM Fence, Inc. of Fargo, ND in the amount of $212,681.71.  All present voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to reject the bid for AIP Project 3-46-0001-23 Bid Schedule A – Taxiway “C” and ARFF Building Access Improvements and authorize to re-bid the project.  All present voting aye, motion carried.

            Commissioner Klabo moved, Commissioner Omland seconded to approve payment of Pay Request – AIP 3-46-0001-21 to American Engineering Testing in the amount of $3,888.35 for asphalt testing.  Upon roll call, all present voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign and approve payment for Pay Est. #1 to Helms & Associates in the amount of $29,913.87 for design of plans for AIP #3-46-0001-23; and Pay Est. #16 to Gray Construction in the amount of $18,252.00 for work on AIP #3-46-0001-21 Project.  Upon roll call, all present voting aye, motion carried.

MINIATURE GOLF LEASE

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to approve a Miniature Golf Course Concession Lease Agreement with Wylie Go-Kart Inc.  All present voting aye, motion carried.

SET BID DATE

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to set a bid date of August 20, 2003 at 2:00 p.m. for advertisements for bids for Sewer Improvements – Lawson Street South Project S-2003-1 and Drainage Improvements – North 3rd Street Project SS-2003-2.  All present voting aye, motion carried.

RECOMMENDATION ON BID

            The following bids were opened and read for 2003-2004 Deicing Salt (1200 Tons):  L & O Acres - $43,488.00; Cargill - $61,800.00; Thorstenson Trucking - $47,530.00; Jensen Feed & Grain - $39,840.00.  Commissioner Omland moved, Commissioner Klabo seconded to award the bid to low bidder Jensen Feed & Grain.  All present voting aye, motion carried.

STREET USE

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve a street use request for Carquest.  All present voting aye, motion carried.

PAY ESTIMATES

            Commissioner Klabo moved, Commissioner Omland seconded to approve and authorize the Mayor to sign and approve payment of Pay Est. #1 – Upper Plains Contracting in the amount of $65,124.30 for 2nd Street Sanitary Sewer Improvements; and Pay Est. #1 – Wright & Sudlow, Inc. in the amount of $62,874.32 for concrete parking lot repairs.  Upon roll call, all present voting aye, motion carried.

LICENSE

            Commissioner Klabo moved, Commissioner Omland seconded to approve a transient merchant license for Fabian Seafood Company.  All present voting aye, motion carried.

PUBLIC HEARING – ORDINANCE NO. 03-08-01

                This being the time and place set for a public hearing held to hear testimony on Ordinance No. 03-08-01, an ordinance to levy an annual general occupation tax within the Business Improvement District, Georgia Smith and Troy McQuillen were present to support the ordinance and no one was present to oppose.  Mayor Hopper closed the hearing.  Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve first reading of Ordinance No. 03-08-01.  Upon roll call, all voting aye, motion carried.

ENVIRONMENTAL REVIEW – ABERDEEN HOUSING AUTHORITY

                Ordinance No. 03-08-09 – An Ordinance amending Section 23-32 and Section 23-35 of the Revised Ordinances, City of Aberdeen, South Dakota as amended, setting forth the rates and uses of taxes allowable by South Dakota Codified Law, was presented.  Commissioner Omland moved, Commissioner Forkel seconded to approve first reading on Ordinance No. 03-08-09.  Upon roll call, all voting aye, motion carried.

HOME RULE

                Commissioner Forkel moved, Commissioner Omland seconded to move forward with Home Rule by selecting a committee to develop a charter to be presented and voted on.  All voting aye, motion carried.

SET HEARING – POLICE GRANT

                Commissioner Omland moved, Commissioner Klabo seconded to approve a request from the Police Department to apply for a 2003 LLEBG Grant and to set a date for a public hearing on possible uses of the Block Grant Funds for August 18, 2003 at 5:30 p.m.  All voting aye, motion carried.

SET BID DATE

                Commissioner Kirkpatrick moved, Commissioner Omland seconded to set a bid date of August 27, 2003 at 2:00 p.m. for advertisement for bids for six (6) 4500 PSIG 60 Minute Self Contained Breathing Apparatus and six (6) 4500 PSIG 60 Minute SCBA Bottles.  All voting aye, motion carried.

CHANGE ORDER

                Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign Change Order #1 – NW Aberdeen Drainage SS Holding Pond (SS-2002-1) Dahme Construction – increase of $115,418.66.  All voting aye, motion carried.

PAY ESTIMATE

                Commissioner Forkel moved, Commissioner Omland seconded to approve and authorize the Mayor to sign and approve payment of Pay Estimate #7 (Final) – NW Aberdeen Drainage SS Holding Pond (SS-2002-1) Dahme Construction - $34,634.31.  Upon roll call, all voting aye, motion carried.

LEASE

                Commissioner Klabo moved, Commissioner Omland seconded to approve and authorize the Mayor to sign and approve payment of snow dump lease with Don Gisi for $250.00 and Joanne Bollwerk for $250.00.  Upon roll call, all voting aye, motion carried.

TRAVEL REQUEST

                Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve a travel request for Ben Stucke to attend Hardware and Software Training in Sioux Falls September 24 – 29, 2003.  All voting aye, motion carried.

LICENSE

                Commissioner Kirkpatrick moved, Commissioner Forkel seconded to approve a Sewer Builder License for Slaight Construction.  All voting aye, motion carried.

LOTTERY NOTICES

                Commissioner Klabo moved, Commissioner Omland seconded to receive and place on file lottery notices for Sacred Heart Bazaar; Bethesda Home of Aberdeen; and Candlelight Quilt Guild.  All voting aye, motion carried.

                Commissioner Omland moved, Commissioner Forkel seconded to approve and authorize the following audited claims for services, supplies, repairs and maintenance:  Aberdeen Chamber of Commerce 317.00; United Parcel Service 49.52; Painters Touch 1,124.58; First Administrators Inc 28,964.04; Sioux Pipe Inc. 67,343.66; Johnson Controls 9,250.00.  Upon roll call, all voting aye, motion carried.

                Commissioner Klabo moved, Commissioner Forkel seconded to approve a bill from New Trends School and Office Supplies for YEP Equipment in the amount of $23,593.27.  Upon roll call, all voting aye, motion carried.

STREET USE

                Commissioner Omland moved, Commissioner Klabo seconded to approve a street use request to hold a block party for Grant Street Neighborhood Watch.  All voting aye, motion carried.
