COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 6:30 p.m., December 30, 2002, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Pfeifer. Commissioner Omland was absent.

            Mayor Hopper led the Pledge of Allegiance.

MINUTES

            Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to approve the minutes of December 23, 2002, as circulated.  All present voting aye, motion carried.

PROFIT/LOSS REPORT

            Dave Osborn, Transportation Director, presented the Jefferson/Ride Line profit/loss report to the city commission.  No action taken.

DISCUSSION - PURCHASE PAINT MACHINE

            Discussion was held on the purchase of a paint machine for the airport runway and taxiway striping.  No action taken.

RECOMMENDATION ON CHEMICAL BIDS

REQUEST TO PURCHASE PRESSURE WASHER

            A request to purchase a water pressure washer from Master Blaster, Inc. in the amount of $3,095.00 for the Water Treatment Plant, was presented.  Commissioner Klabo moved, Commissioner Pfeifer seconded to approve the request.  All present voting aye, motion carried.

ORDINANCE NO. 02-12-01

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to approve second reading of Ordinance No. 02-12-01.  Upon roll call, all present voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve final adoption of Ordinance No. 02-12-01.  Upon roll call, all present voting aye, motion carried.

ORDINANCE NO. 02-12-02

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve second reading of Ordinance No. 02-12-02.  Upon roll call, all present voting aye, motion carried.

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to approve final adoption of Ordinance No. 02-12-02.  Upon roll call, all present voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve second reading of Ordinance No. 02-12-03.  Upon roll call, all present voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve the following resolution:

RESOLUTION FOR ANNEXATION OF CERTAIN PROPERTY TO

THE CITY LIMITS OF THE CITY OF ABERDEEN

 

            BE IT RESOLVED by the Aberdeen City Commission, Brown County, Aberdeen, South Dakota that the Voluntary Petition to annex the following described property filed by Aberdeen Engineering Group, LLP and Loren D. Steele is hereby granted and the following described property is hereby added to the municipal boundaries of the City of Aberdeen, South Dakota and shall be within the city limits of said city.  Said property described as follows: 

 

            Lot 1 of “Helms Subdivision in the N ½ of the SW ¼ of Sec. 16, T123N-R63W of the 5th P.M., Brown County, South Dakota”, including all of the public right-of-way located adjacent thereto, said plat is recorded as Hanging Plat Number 1786-H, at the Register of Deeds of Brown County, South Dakota.

 

            BE IT FURTHER RESOLVED by the Aberdeen City Commission, Brown County, Aberdeen, South Dakota that the Mayor of the City of Aberdeen shall cause an accurate map of such territory together with a copy of this Resolution duly certified to be recorded in the Office of the Register of Deeds, Brown County.

HEARING – ALCOHOLIC BEVERAGE LICENSE

            This being the time and place set for a hearing on application for an alcoholic beverage license, no one was present to testify, recommendations for approval were received, Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign a Special One-Day Retail On-Off Sale Malt Beverage License for January 9, 2003 – Aberdeen Area Chamber of Commerce dba Verifications, 416 N. Production Street.  All present voting aye, motion carried.

DEDICATION

            A request from Leo Wanzek to dedicate sewer lines and manholes to the city located on Tenth Avenue, SW between Fourteenth Street South and Sixteenth Street South, Fourteenth Street South between Ninth Avenue, SW and Tenth Avenue, SW and Fifteenth Street South between Ninth Avenue, SW and Tenth Avenue, SW, was presented.  A resolution will be presented next week to dedicate said sewer lines and manholes.  No action taken.

PAY ESTIMATE

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign and approve payment for Pay Estimate #2 – Roof Improvements (BLDG-2002-2) to Grote Roofing, Inc. in the amount of $31,450.54.  Upon roll call, all present voting aye, motion carried.

            This being the time and place set for the continued hearing on New Retail On-Off Sale Malt Beverage License for Teigen Construction Inc. dba 1805 South Roosevelt Street; no one was present to testify, Commissioner Klabo moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign license, contingent upon inspections by the Fire and Health Departments.  Upon roll call, Commissioners Klabo, Pfeifer and Mayor Hopper voting aye, Commissioners Omland and Kirkpatrick voting nay, 3 ayes, 2 nays, motion carried.

COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 6:30 p.m., December 16, 2002, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Omland and Pfeifer.

            Mayor Hopper led the Pledge of Allegiance.

MINUTES

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve the minutes of December 9, 2002, as circulated.  All voting aye, motion carried.

PHONE SYSTEM – LIBRARY

            Pam Lingor, Library Director, was present to discuss a new phone system for the Alexander Mitchell Library.   A proposal from Northern Valley Communications to install a new system in the amount of $6,540.00 was presented.  Commissioner Pfeifer moved, Commissioner Klabo seconded to approve the request.  All voting aye, motion carried.

APPOINTMENT – BID BOARD

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to appoint Phillip Lookadoo as the Liaison to the BID Board.  All voting aye, motion carried.

CONTINUED – HEARING

            This being the time and place set for a continued Hearing on New Retail On-Off Sale Malt Beverage License for Teigen Construction Inc. dba 1805 South Roosevelt Street, Mayor Hopper opened the floor for comments.  Lloyd Hodgin was present to discuss his opinion of continuing the hearing until the planning Commission has a recommendation on the proposed school safety zone ordinance.  Lyle Orr was present to voice his concerns on the on-sale portion of the license application.  Cindy Heupel discussed information on teenage drinking and voiced opposition.  Becky Kuch, Teen Counselor, spoke against the application.  After further discussion and comments, Commissioner Kirkpatrick moved, Commissioner Omland seconded to postpone the hearing for one week until the Planning Commission makes recommendation on School Safe Zone.  Upon roll call, all voting aye, motion carried.

AGREEMENT

CREDIT CARD ACQUISITION AND USE POLICY

 

            WHEREAS:  The City of Aberdeen Board of Commissioners has determined that the City has a need for a credit card as authorized by SDCL 4-3-27,

 

            NOW, THEREFORE, BE IT RESOLVED:  The Finance Office (herein after referred to as the “designated official”) is hereby authorized to acquire and use credit cards for the purchase of certain necessities on behalf of and for the benefit of the City of Aberdeen, in accordance with the policies set out below.

 

            The credit card shall only be used for the purchase of meeting registration, motel room guarantees, or other purchases that cannot be accomplished by the issuance of a purchase order and billed directly to the city to be processed in the normal warrant process, unless it is more economically advantageous to pay by credit card.  The card may be used to pay for pre-authorized purchases through the Internet, if it is the only means of payment accepted by the vendor.  All purchases in excess of $2,500.00 must be pre-approved by the City Commission.

 

            The card may not be used to pay for meals that qualify for reimbursement through per diem or any item which does not directly benefit the City of Aberdeen.

 

            The credit card shall remain in the custody of the designated official at all times, except when entrusted to an employee for an authorized use.  In all cases where the credit card is used by any city employee, the card shall immediately be returned to the designated official, along with a copy of the receipt, and an invoice or other documentation stating what the card was used for.  The designated person shall immediately verify the purchase was necessary and to the benefit of the City of Aberdeen and submit the invoice to the Finance Office with appropriate account coding information.

 

            Any perks, credits or items of value earned because of the use of said cards shall only be used for the benefit of the City and not for that of any employee.  Except, frequent flier credits may accrue to the employee/official actually incurring the credit, in accordance with Official Opinion No. 90-04 of the SD Office of the Attorney General.

 

            All present voting aye, motion carried.

 

SET HEARING DATE

            Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to set a hearing date of December 23, 2002 at 6:30 p.m. for application for renewal of On-Sale Wine License for Lai Liu Inc. dba Hong Kong Restaurant, 1721 Sixth Avenue SE.  All present voting aye, motion carried.

ABERDEEN REGIONAL AIRPORT

            Commissioner Omland moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign Change Orders for AIP Project No. 3-46-0001-21:  #2 – Upper Plains Contracting, Inc. – decrease $103,047.04; #2 – Ringgenberg Electric – increase $9,936.00; #3 – Gray Construction Co. – increase - $17,246.00.  All present voting aye, motion carried.

            Commissioner Omland moved, Commissioner Pfeifer seconded to receive and place on file Aberdeen Regional Airport Fund Financial Statements as of December 31, 2001.  All present voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign and approve payment of pay estimates for AIP Project No. 3-46-0001-21: #7 – Upper Plains Contracting Inc. - $147,268.73; #8 – Gray Construction Co. - $182,425.50.  Upon roll call, all present voting aye, motion carried.

REQUESTS TO PURCHASE - POLICE

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve a request to purchase software for Teletype Terminal located in the Detective Division in the amount of $2,770.00.  All present voting aye, motion carried.

            Commissioner Omland moved, Commissioner Pfeifer seconded to approve a request to purchase new uniforms for the Police Department.  All present voting aye, motion carried.

RECOMMENDATION ON BIDS

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve the recommendation from the Chief of Police for leasing four patrol vehicles and one four wheel drive patrol vehicle as follows:  Low Bid – Lust Chevrolet – 4 – 2003 Chevrolet Impalas with the police package for $969.69 each – total of $3,878.76 a month – 1 year lease and 4-wheel drive Tahoe Police package leases for $814.23 a month – 2 year lease.  All present voting aye, motion carried.

PAY REQUEST

            Commissioner Omland moved, Commissioner Pfeifer seconded to approve a pay request for boring services on South Lloyd Street – K & H Electric in the amount of $5,278.50.  Upon roll call, all present voting aye, motion carried.

MONTROSE STREET CONSTRUCTION PROJECT (ST-2002-4)

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign Change Order #1 – Lien Transportation – increase $3,356.40.  All present voting aye, motion carried.

            Mayor Hopper discussed potential grants for improvements on Brown County Highway #19.  Commissioner Omland moved, Commissioner Klabo seconded to authorize the Mayor to sign grant application and approve the following resolution:

 

RESOLUTION OF FINANCIAL COMMITMENT, RESPONSIBILITY

FOR ROAD MAINTENANCE AND SUPPORT FOR PROJECT

            WHEREAS, the City of Aberdeen is applying for a Industrial Park Grant through the South Dakota Department of Transportation (SDDOT) for the City of Aberdeen; and

 

            WHEREAS, the SDDOT requires a 40 percent local match for the construction costs of a project up to a specified amount; and

 

            WHEREAS, the SDDOT requires the local government agency to be responsible for the maintenance of the improved road; and

 

            Whereas, THE City of Aberdeen is in full support of this project and grant application; and

 

            THEREFORE, BE IT RESOLVED that the City of Aberdeen will provide the local match needed to supplement the SDDOT grant.  This match will be 40 percent of the construction costs as shown in the grant application; and

 

            THEREFORE, BE IT ALSO RESOLVED that the City of Aberdeen will be responsible for the maintenance of the improved road; and

 

            THEREFORE, BE IT ALSO RESOLVED that the City of Aberdeen expresses their full support and cooperation to the road improvement project and the SDDOT Industrial Park Grant application.

WEB WATER

            Mayor Hopper discussed the letter received recently from the WEB Board of Directors.  He also read the letter of response from the Aberdeen City Commission to the WEB Board.  Commissioner Klabo and Omland expressed their disappointment that the WEB letter did not provide an acceptable offer to provide water to the City of Aberdeen.

COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 9:00 a.m., November 12, 2002, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Omland and Pfeifer.

            Mayor Hopper led the Pledge of Allegiance.

MINUTES

            Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve the minutes of November 4 and 6, 2002, as circulated.  All voting aye, motion carried.

PUBLIC HEARING

            This being the time and place set for a public hearing pertaining to a Community Development Block Grant (CDBG) for construction of a storm sewer and Aberdeen’s Community Development and Housing Needs, Ted Dickey was present to ask required questions and no one else was present to testify.  Commissioner Pfeifer moved, Commissioner Omland seconded to close the hearing.  All voting aye, motion carried.

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to approve the following resolution:

RESOLUTION

            Authorizing Community Development Block Grant to Assist the City of Aberdeen in the Construction of a new Storm Sewer for downtown Aberdeen.

 

            WHEREAS, the City of Aberdeen proposes to execute an application for $510,000 Community Development Block Grant funds to help fund repairs in flood recovery projects; and

 

            WHEREAS, the City of Aberdeen is eligible for Federal assistance for the proposed project; and

 

            WHEREAS, with the submission of the Community Development Block Grant application, The City of Aberdeen assures and certifies that all Community Development Block Grant program requirements will be fulfilled; and

 

            WHEREAS, the City of Aberdeen has held the required public hearing on November 12, 2002 for the Community Development Block Grant;

 

            WHEREAS, the City of Aberdeen is required to designate a certifying officer for the purpose of signing documents pertaining to this grant;

 

            WHEREAS, the City of Aberdeen is required to designate an environmental certifying officer for the purpose of signing required environmental documents pertaining to this grant;

 

            NOW, THEREFORE BE IT RESOLVED, that the Aberdeen City Commission, will be authorized to execute the Community Development Block Grant application for The City of Aberdeen; and

 

            AND BE IT FURTHER RESOLVED, that the Mayor of the Aberdeen City Commission, be hereby designated as the City of Aberdeen certifying officer for the purpose of signing correspondence, pay requests, and other required documents;

 

            AND BE IT FURTHER RESOLVED, that the Mayor of the Aberdeen City Commission, hereby designated as the City of Aberdeen’s environmental certifying officer for the purpose of signing correspondence and other required documents and forms.

 

            All present voting aye, motion carried.

ABERDEEN REGIONAL AIRPORT

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign Addendum to Airport Lease #62 with Mark Lehrkamp.  All voting aye, motion carried.

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve and authorize the Mayor to sign recommendation from the Airport Board to accept bid for 2002-2003 snow removal from Lien Transportation and Construction.  All voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve recommendation from the Airport Board to reject bids received for leasing 15.6 acres of land.  All voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign and approve payment for Pay Estimates for AIP Project #3-46-0001-21:  #6 for work on new terminal – Ringgenberg Electric - $8,115.71; #12 for engineering services – Helms & Associates - $25,922.48; #6 for work on new terminal – Upper Plains Contracting - $327,734.11; #7 for work on new terminal – Gray Construction Co. - $281,722.50.  Upon roll call, all voting aye, motion carried.

            BE IT RESOLVED by the Aberdeen City Commission, Brown County, Aberdeen, South Dakota, that the Petition to Vacate the Public Right-of-Way filed by D.P. Schneider of BN Leasing Corporation and Stanley E. Albrecht is hereby granted and the public right-of-ways are hereby vacated for the following described areas:

 

            A strip of public right of way running East and West located North of Railroad Ave SE between State St N and Dakota St N described as follows:
