COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 6:30 p.m., February 24, 2003, Joint City/County meeting of the Board of Commissioners, Commissioner Pat Klabo presiding.  Present at roll call were Commissioners Kirkpatrick, Omland and Pfeifer.  Mayor Hopper was absent.

            County Commissioners present were Feickert, Fischbach and Wiese.  Commissioners Knecht and Hansen were absent.

ORDINANCE NO. 03-02-01-265

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Sec. 701 (A-1) to Sec. 707 (C-2) property described as:  “Schumaker Lot 1 in NW 1/4 , Sec. 23, T123N-R63W of the 5th P.M., Brown County, South Dakota” and extending to the centerline of all public right-of-way located adjacent thereto.  (Intersection of Highway 12 East and 192nd Ave., ½ mile East on South side), was presented.  Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve first reading of Ordinance No. 03-02-01.  Upon roll call, all present voting aye, motion carried.

            Commissioner Wiese moved, Commissioner Feickert seconded to approve first reading of Ordinance No. 03-02-01-265.  All present voting aye, motion carried.

ORDINANCE NO. 03-02-02-266

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Sec. 701 (A-1) to Sec. 714 (M-AG) property described as:  “The SW ¼ of Sec. 10, T123N-R63W and extending to the centerline of all public right-of-way located adjacent thereto, except plat of “Evergreen East Second Addition in the SW ¼ of Sec. 10, T123N-R63W of the 5th P.M., Brown County, South Dakota”, except plat of “Lien Acres in the SW ¼ of Sec. 10, T123N-R63W of the 5th P.M., Brown County, South Dakota,” except plat of “Hamilton’s First Addition in SW ¼, Sec. 10, T123N-R63W of the 5th P.M., Brown County, South Dakota” and except plat of “Evergreen East Addition in the SW ¼ of Sec. 10, T123N-R63W of the 5th P.M., Brown County, South Dakota” (NE of the intersection of 132nd St. and 391st Avenue), was presented.  Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve first reading of Ordinance No. 03-02-02.  Upon roll call, all present voting aye, motion carried.

            Commissioner Feickert moved, Commissioner Wiese seconded to approve first reading of Ordinance No. 03-02-02-266.  All present voting aye, motion carried.

ORDINANCE NO. 03-02-05-269

            An Ordinance amending Section 502 and 707.3 and 708.3, known as the Zoning Ordinance of the City of Aberdeen, South Dakota, to add definition of crematorium and to add crematoriums as a special exception which may be permitted in the (C-2) Highway Commercial District and (C-3) Central Business District”, was presented.  Attorney Gregg Magera representing the Carlsen’s spoke in favor of the crematorium citing it as a service necessary in Aberdeen.  Kathy Buechler and Gloria Wilson, residents, spoke against the location wanting greater distance from their homes and possibly in an industrial area.  After considerable discussion, Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve first reading of Ordinance No. 03-02-05.  Upon roll call Commissioners Kirkpatrick, Klabo and Pfeifer voting aye, Commissioner Omland voting nay, 3 ayes, 1 nay, motion carried.

            Commissioner Wiese moved, Commissioner Feickert seconded to approve first reading of Ordinance No. 03-02-05-269.  All present voting aye, motion carried.

ORDINANCE NO. 03-02-06-270

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Sec. 701 (A-1), Sec. 704 (R-2) and Sec. 710 (I-2) to Sec. 710 (I-2) property described as:  Hub City Livestock Lot 1, Young’s Lot 1 and Young’s Lot 2 of “Hub City Livestock Second Addition in E ½ Sec. 26, T123N-R64W of 5th P.M., Brown County, South Dakota” and extending to the centerline of all public right-of-way located adjacent thereto.  (Intersection of 5th St. S. and Melgaard Rd. SW, ½ mile South on West side), was presented.  Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to approve first reading of Ordinance No. 03-02-06.  Upon roll call, all present voting aye, motion carried.

            Commissioner Feickert moved, Commissioner Wiese seconded to approve first reading of Ordinance No. 03-02-06-270.  All present voting aye, motion carried.

ORDINANCE NO. 03-02-08-271

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Sec. 701 (A-1) to Sec. 704 (R-2) property described as:  Lots 1 and 2 of “Munger First Addition in the SW ¼ of Sec. 28, T123N-R63W of the 5th P.M., Brown County, South Dakota” and extending to the centerline of all public right-of-way located adjacent thereto.  (3/4 of a mile S. of Intersection of Melgaard Rd. SE and Melgaard Rd. S.); AND TO REZONE CERTAIN DESCRIBED PROPERTY FROM SEC. 701 (A-1) TO SEC. 714 (M-AG) PROPERTY DESCRIBED AS:  Lot 3 “Munger First Addition in the SW ¼ of Sec. 28, T123N-R63W of the 5th P.M., Brown County, South Dakota”, Lot 4 of “Airport Addition (includes replat of Preston O.L. 1, Anderson O.L. 1 and Anderson O.L. 2) in the SW ¼ of Sec. 28, T123N-R63W of the 5th P.M., Brown County, South Dakota” and extending to the centerline of all public right-of-way located adjacent thereto, was presented.  Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve first reading of Ordinance No. 03-02-08.  Upon roll call, all present voting aye, motion carried.

            Commissioner Wiese moved, Commissioner Feickert seconded to approve first reading of Ordinance No. 03-02-08-271.  All present voting aye, motion carried.

            There being no further business before the Joint Commission, Commissioner Omland moved, Commissioner Pfeifer seconded to adjourn to the regular City Commission Meeting.  All voting aye, motion carried.

            Commissioner Klabo led the Pledge of Allegiance.

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve the minutes of February 18, 2003, as circulated.  All present voting aye, motion carried.

ORDINANCE NO. 03-02-09

            Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve second reading of Ordinance No. 03-02-09.  Upon roll call, all present voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve final adoption of Ordinance No. 03-02-09.  Upon roll call, all present voting aye, motion carried.

ORDINANCE NO. 03-02-10

            Commissioner Pfeifer moved, Commissioner Omland seconded to continue for one week second reading and final adoption of Ordinance No. 03-02-10.  Upon roll call, all present voting aye, motion carried.

ORDINANCE NO. 03-02-03

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Sec. 707 (C-2) to Sec. 705 (R-3) property described as:  Lot 1 of “Holm Second Addition to the City of Aberdeen, South Dakota” and extending to the centerline of all public right-of-way located adjacent thereto (619 South Lawson Street), was presented.  Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve first reading of Ordinance No. 03-02-03.  Upon roll call, all present voting aye, motion carried.

ORDINANCE NO. 03-02-04

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Sec. 703 (R-1), Sec. 704 (R-2), and Sec. 705 (R-3) to Sec. 704 (R-2) property described as:  Lots 1, 2 and 3, Block 1 of “Forest Acres Ninth Addition to the City of Aberdeen, Brown County, South Dakota” and extending to the centerline of all public right-of-way located adjacent thereto (610 Melgaard Rd. SW, 1729 S. 7th St., & 601 17th Avenue SW), was presented.  Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve first reading of Ordinance No. 03-02-04.  Upon roll call, all present voting aye, motion carried.

ORDINANCE NO. 03-02-07

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Sec. 704 (R-2) to Sec. 704 (R-2) and Sec. 711 (R-4) property described as:  Lots 1 thru 4, Block 10 of “Kwasniewski addition to Ashwood Heights Subdivision in the City of Aberdeen, Brown County, South Dakota”, Lots 1 thru 8 and Lots 11 thru 14, Block 10 of Lots 1-16, Block 10, Ashwood Heights Subdivision to the City of Aberdeen, Brown County, South Dakota” and extending to the centerline of all public right-of-way located adjacent thereto (SE corner of intersection of Roosevelt St. N. and Birchwood Lane), was presented.  Commissioner Pfeifer moved, Commissioner Omland seconded to approve first reading of Ordinance No. 03-02-07.  Upon roll call, all present voting aye, motion carried.

PETITION TO VACATE

            Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve request by petitioner to withdraw petition to vacate public right-of-way:  A 16’ wide public alley located between Main Street South and First Street South and Railroad Avenue SW and First Avenue SW.  All present voting aye, motion carried.

CONTRACT

            Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to approve and authorize the Mayor to sign Air Monitoring Contract between the City and SD Department of Environment and Natural Resources.  All present voting aye, motion carried.

CHANGE ORDER

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign Change Order #4, AIP Project No. 3-46-0001-21 for Gray Construction Company, an increase in the amount of $26,372.00.  Upon roll call, all present voting aye, motion carried.

EASEMENT

            Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to approve and authorize the Mayor to sign Electric Utility Easement to NWPS for moving electrical lines underground that are adjacent to parking lot directly west of Citizen’s Building.  All present voting aye, motion carried.

LAND PURCHASE & PAYMENT

            Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign land purchase for expansion of Conlin Holding Pond and purchase agreement with the Church of God for 3.11 acres of land and payment for that land in the amount of $92,000.00.  Upon roll call, all present voting aye, motion carried.

APPROVE WORK ON POND

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve Dahme Construction to work on Conlin Pond Excavation Project.  All present voting aye, motion carried.

NORTHWEST DRAINAGE PROJECT

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve and authorize the Mayor to sign and approve payment for Change Order #1 – Dahme Construction – increase - $11,062.25; and Pay Estimate #3 – Dahme Construction - $42,935.40.  Upon roll call, all present voting aye, motion carried.

PAY ESTIMATE

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign and approve payment of Pay Estimate #4 – South 5th Street Project – Muth Electric in the amount of $17,331.80.  Upon roll call, all present voting aye, motion carried.

CONTRACTS & BONDS

            Commissioner Omland moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign, contingent upon City Attorney’s review, the contracts and bonds for Sodium Chlorite Solution – Altivia Corporation; one 2003 New Way Viper Packer Body – Olympic Sales, Inc.; and Polymer – Pristine Hydrochemical Inc.  All present voting aye, motion carried.

TRAVEL REQUESTS

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve travel requests for Daniel Ostrander to attend the American Mosquito Control Association Annual Meeting and Randy Majeske to Weed & Seed Grant Training.  All present voting aye, motion carried.

LOTTERY NOTICE

            Commissioner Omland moved, Commissioner Pfeifer seconded to receive and place on file a lottery notice from Native American Student Association (NASA).  All present voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to receive and place on file the following department reports:  Aberdeen Regional Airport Board Minutes; Alexander Mitchell Library Minutes; Park & Recreation Board Minutes; Mayor’s Committee for People with Disabilities Minutes; Board of Zoning Adjustment Minutes; Aberdeen City Planning Commission Minutes; Brown County/Aberdeen City Planning Commission Minutes; and Riverside & Memorial Cemeteries Burial Report.  All present voting aye, motion carried.

ORDINANCE NO. 03-02-09

            Ordinance No. 03-02-09 – that Section 2-61 of the Revised Ordinances, City of Aberdeen, South Dakota, is hereby amended (Appointment of Officers), was presented.  Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve first reading of Ordinance No. 03-02-09.  Upon roll call, all voting aye, motion carried.

ORDINANCE NO. 03-02-10

            Ordinance No. 03-02-10 – That Section 31-25 of the Revised Ordinances, City of Aberdeen, South Dakota, is hereby amended (Use of Water), was presented.  Commissioner Pfeifer moved, Commissioner Klabo seconded to approve first reading of Ordinance No. 03-02-10.  Upon roll call, all voting aye, motion carried.

AGREEMENT

            Commissioner Omland moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign Project Skills Work Experience Agreement with the City and South Dakota Department of Human Services.  All voting aye, motion carried.

AUTHORIZE TO SIGN

            A DOJ Special Appropriation – “After the Bell” Program Supervisor Contract for services between the City and the Aberdeen Family YMCA, was presented.  Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Finance Officer to sign.  All voting aye, motion carried.

SURPLUS PROPERTY

            A request from the Public Works Department to declare the following Fixed Assets Surplus Property – 1995 Ford Truck with New Way Packer Body; 1984 John Deere Motor Grader; and 1996 Elgin 3-Wheel Self-Propelled Street Sweeper, was presented.  All voting aye, motion carried.

RECOMMENDATION ON BID

            The following bids were received for Traffic Marking Paint:  Vogel Paint – Item 1 - $7,445.99, Item 2 - $11,737.00, Item 3 - $2,550.00; Vogel Paint, Alt. Bid – Item 1 - $5,336.10, Item 2 - $8,651.50; Lafarge Road Marking – Item 1 - $5,918.99, Item 2 - $9,170.59.  Commissioner Kirkpatrick moved, Commissioner Omland seconded to award  Item 1 and Item 2  (paint)  to Lafarge Road Marking and Item 3 (beads) to Vogel Paint.  All voting aye, motion carried.

RECOMMENDATION ON BID

            The following bids were received for One (1) 2003 Single Axle Truck Cab and Chassis, Box and Hoist for the Public Works Utility Division:  CAB & CHASSIS: Crawford Trucks - $44,180, with trade $34,900; Wallworks Truck Center - $41,170, with trade $31,170; Wallworks Truck Center - $42,336, with trade $32,336; DUMP BODY & HOIST:  Drake Equipment Company - $7,719; Northern Truck Equipment - $7,995; Safety Service - $8,895; Sanitation Products - $8,838.  A detailed tabulation is on file at the Finance Office.  Wastewater Treatment Plant would like the trade in and is willing to pay the difference of $10,000.  Commissioner Kirkpatrick moved, Commissioner Klabo seconded to award the Cab and Chassis to Wallwork Truck Center in the amount of $42,336.00 and the Dump Body & Hoist to Northern Truck Equipment in the amount of $7,995.00.  All voting aye, motion carried.

REQUEST TO PURCHASE

            A request to purchase large meters for the Public Works/Utility Water Division in the amount of $14,000.00, was presented.  Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to approve the request.  All voting aye, motion carried.

CONTRACT & BONDS

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign contract and bonds for One New Holland Model RG-170 Motor Grader – JD Evans, Inc., contingent upon City Attorneys review.  All voting aye, motion carried.

PAY ESTIMATE

            Commissioner Klabo moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign and approve payment for Pay Estimate #4 – Engineering Services at WTP – Banner Associates in the amount of $14,766.00.  Upon roll call, all voting aye, motion carried.

LOTTERY

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to receive and place on file lottery notices for South Dakota Taxidermist Association and CHS Music Boosters.  All voting aye, motion carried.

COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 6:30 p.m., February 10, 2003, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Omland and Pfeifer.

            Mayor Hopper led the Pledge of Allegiance.

MINUTES

            Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to approve the minutes of February 3, 2003, as circulated.  All voting aye, motion carried.

CONTINUED – PERMISSION TO PURCHASE

            A request for permission to purchase two (2) Patrol Vehicles currently leased by the Police Department, was presented.  Commissioner Pfeifer moved, Commissioner Omland seconded to approve the request.  All voting aye, motion carried.

SPECIAL PROJECTS GRANT

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve and authorize the Mayor to sign FY 2001 EDI – Special Projects Grant Agreement and Assistance Award from the US Department of Housing and Urban Development.  All voting aye, motion carried.

REQUEST TO PURCHASE

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve a request to purchase two (2) firewall appliances to install on the network to protect from unauthorized access for the Computer Department.  All voting aye, motion carried.

ELM LAKE WATERSHED

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve the city sponsorship of the Elm Lake Watershed Restoration Project Implementation Plan.  All voting aye, motion carried.

SET BID DATE

            Commissioner Klabo moved, Commissioner Omland seconded to set a bid date of February 28, 2003 at 2:00 p.m. for advertisement for bids for Paint Striping Road Machine for Aberdeen Regional Airport and Public Works Sign Department.  All voting aye, motion carried.

RECOMMENDATION ON BIDS

            Bids for One Rubber-Tired Front-End Loader for the Airport were opened and publicly read.  Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve the recommendation from the Airport Board to accept the low bid of $109,949.00 from DMI .  All voting aye, motion carried.

 

PAY ESTIMATE

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign and approve payment for Pay Estimate #10 for AIP Project #3-46-0001-21 – Gray Construction in the amount of $224,419.50.  Upon roll call, all voting aye, motion carried.

CONTRACT

            Commissioner Klabo moved, Commissioner Omland seconded to approve and authorize the Mayor to sign, contingent upon City Attorney review, the contract for chemicals with Cal-Pacific Carbon, LLC.  All voting aye, motion carried.

LICENSE

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve an Advertising/Sign Hanging License for Lamar Advertising with an effective date of January 1 through December 31, 2003.  All voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Klabo seconded to set a hearing date of March 3, 2003 at 6:30 p.m. for Amending Sec. 502, 707.3, 708.3, 710.3 and adding Sec. 1103 to Ordinance No. 1164, to add definitions of words, to add sexually oriented businesses as a special exception which may be permitted in the (C-2) Highway Commercial District, (C-3) Central Business District and (I-2) Unrestricted Industrial District and to add Adult Uses Ordinance.  Amending Sec. 502, 706.5, 707.2, 708.2, 710.2 and Adding Sec. 1104 to Ordinance No. 1164, to add definitions of words, to add all uses in the (C-1) Neighborhood Commercial District, (C-2) Highway Commercial District, (C-3) Central Business District and (I-2) Unrestricted Industrial District are subjected to requirements as defined in Sec. 1104.  School Safe Zone and to add a 300’ School Safe Zone Ordinance.  All voting aye, motion carried.

            Commissioner Wiese moved, Commissioner Hansen seconded to set a hearing date of March 3, 2003 at 6:30 p.m. for the above amendments.  All present voting aye, motion carried.

HOMES ARE POSSIBLE INC. (HAPI)

            Dennis Pelkofer, Bruce Jones and Sister Janice Klein were present to give background, assistance criteria and goals for the program Homes Are Possible Inc.  They requested a letter of support from the City and also a letter to change the 1949 Federal Housing Act Law which would make Aberdeen eligible.  Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign both letters of support.  All voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign applicable documents for BNSF Easement for South Fifth Street Roadway Construction in the amount of $2,500.00.  All voting aye, motion carried.

            Commissioner Klabo moved, Commissioner Omland seconded to approve and authorize the Mayor to sign Change Order #1 – Muth Electric – increase of $6,299.00.  All voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign and approve payment of Pay Estimate #3 – Muth Electric in the amount of $10,692.72.  Upon roll call, all voting aye, motion carried.
