COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 6:30 p.m., January 28, 2002, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Omland and Pfeifer.

            Mayor Hopper led the Pledge of Allegiance.

MINUTES

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve the minutes of January 22, 2002, with the following correction:  Page 12902 – change Mayor Hopper to Commissioner Pat Klabo led the Pledge of Allegiance.  All voting aye, motion carried.

PROCLAMATION

            Mayor Hopper read and proclaimed the week of January 27 through February 2, 2002, as “Catholic Schools Week”.

ZONING BOARD DISCUSSION

            Dean Marske, President of the Zoning Board of Adjustment, was present to clarify the workings of the Zoning Board.  No action was taken.

APPLICATION – GRANT PROGRAM

            Ted Dickey, Northeast Council of Governments was present to discuss South Dakota Division of Emergency Management Hazard Mitigation Grant Program Preapplication.  After discussion, Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign application.  All voting aye, motion carried.

CONTINUED – CONTRACT FOR SERVICES

            The Contract for services with Inter-Fluve, Inc. for Sediment Transport Study in Moccasin Creek has been withdrawn per the City Engineer.  Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to approve withdrawal of contract.  All voting aye, motion carried.

ORDINANCE NO. 02-01-04

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve second reading of Ordinance No. 02-01-04.  Upon roll call, all voting aye, motion carried.

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to approve final adoption of Ordinance No. 02-01-04.  Upon roll call, all voting aye, motion carried.

APPLICATION FOR RENEWAL

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign Renewal of Retail On-Sale Wine License for Vega Gonzalez Inc. dba Guadalajara Mexican Restaurant, 3015 Sixth Avenue SE #3.  All voting aye, motion carried.

SET HEARING DATE

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to set a hearing date of February 11, 2002 at 6:30 p.m. for Transfer of Retail On-Off Sale Malt Beverage License from Kerry R. Engelmann dba Jackpot Casino, 1111 Sixth Avenue SW to Lonnie Frost and Jeff Ell dba Jackpot Casino, 1111 Sixth Avenue SW.  All voting aye, motion carried.

EMPLOYEE RECOGNITION

            Mayor Hopper read and recognized City Employees for Years of Service Awards for 2001 and Certificates of Appreciation for a Healthy and Dedicated Year in 2001.

COMBINED ELECTION AGREEMENT

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign Combined Election Agreement with Brown County and the Aberdeen School District.  All voting aye, motion carried.

PETITION OF VOLUNTARY ANNEXATION

            A Petition of Voluntary Annexation: Plat of Taylor’s Outlot No. 1 in the East ½ of the SE ¼ of Sec. 23, T123N-R64W of the 5th P.M., Brown County, South Dakota and including all of the public right of way located adjacent thereto, said plat is recorded as Hanging Plat Number 354-B at the Register of Deeds of Brown County, SD (610 W. Melgaard Road), was presented.  Commissioner Pfeifer moved, Commissioner Klabo seconded to refer this petition to the City Attorney, City Engineer, and City Planning/Zoning Director for review and recommendation.  All voting aye, motion carried.

RECOMMENDATIONS ON BID

            The following bid for one (1) 5th Wheel Trailer was opened and publicly read:  Specialty Manufacturing Company, Inc. - $22,449.00.  Commissioner Pfeifer moved, Commissioner Omland seconded to award the bid to Specialty Manufacturing Company, Inc.  All voting aye, motion carried.

JOINT FUNDING AGREEMENT

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign the Joint Funding Agreement with U.S. Geological Survey.  All voting aye, motion carried.

CONSULTING AGREEMENT

            Commissioner Omland moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign a Consulting Agreement for leak detection with Utility Services Associates.  All voting aye, motion carried.

TRAVEL REQUEST

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve a travel request for Dan Ostrander, Jack Ness, Steven Thompson and Pat Doschadis to attend the Great Plains Green Expo in Sioux Falls, SD on February 4 – 6, 2002.  All voting aye, motion carried.

PAY ESTIMATE

            Commissioner Klabo moved, Commissioner Omland seconded to approve and authorize the Mayor to sign and approve payment for Pay Estimate #9 – Banner Associates in the amount of $378.50.  Upon roll call, all voting aye, motion carried.

PAY REQUEST

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve payment for pay request to Phillystran, Inc. in the amount of $9,381.40.  Upon roll call, all voting aye, motion carried.

LOTTERY NOTICES

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to receive and place on file the following lottery notices:  South Dakota Ducks Unlimited State Convention; Dakota Plains Chapter of the Rocky Mountain Elk Foundation; Whitetails Unlimited; Friends of the NRA; Aberdeen Area Courage Day Camp; NSU Phi Beta Lambda; Good Shepherd Lutheran/Peer Ministry; Aberdeen Area Chamber of Commerce; and South Dakota Northeastern Walleye Club.  All voting aye, motion carried.

JOINT MEETING

            Commissioner Klabo moved, Commissioner Omland seconded to continue the Joint City/County Meeting until 8:45 a.m., January 29, 2002, due to a lack of quorum of County Commissioners.  All voting aye, motion carried.

            There being no further business before the Board, Commissioner Pfeifer moved, Commissioner Klabo seconded that the meeting be adjourned.  All voting aye, motion carried.

            Brown County Courthouse, 25 Market Street, Aberdeen, South Dakota, 8:45 a.m., January 29, 2002, Joint City/County Meeting of the Board of Commissioners, Commissioner Klabo presiding.  Present at roll call were Commissioners Kirkpatrick and Pfeifer.  Commissioner Omland and Mayor Hopper were absent.

            County Commissioners present were Knecht, Fischbach and Hansen.  Commissioners Feickert and Wiese were absent.

ORDINANCE NO. 02-01-01-247

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Sections 701 (A-1) 714 (M-AG) to Section 714 (M-AG) property described as: The South 1,495.34’ of the West 1,166.59’ of the SW ¼ of Sec. 25, T124N-R64W of the 5th P.M., Brown County, South Dakota to be platted and known as Lot 1 of “Arlt’s First Add. In the SW ¼ of Sec. 25, T124N-R64W of the 5th P.M., Brown County, South Dakota” and extending to the centerline of all public right of way located adjacent thereto (12884 – 387th Avenue), was presented for first reading.  Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to approve first reading of Ordinance No. 02-01-01.  Upon roll call, all present voting aye, motion carried.

            Commissioner Hansen moved, Commissioner Knecht seconded to approve first reading of Ordinance No. 02-01-01-247.  All present voting aye, motion carried.

ORDINANCE NO. 02-01-02-248

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Section 701 (A-1) to Section 714 (M-AG) property described as: Lot 1 and Lot 2 of “Kimbler Addition in Government Lot 1 and the East 6 Rods of Government Lot 2 in the NE ¼ of Sec. 5, T123N-R63W of the 5th P.M., Brown County, South Dakota” and extending to the centerline of all public right of way located adjacent thereto, except for area currently zoned (A-2) Green Belt District (1 Mile W. of Prairiewood Village Subdiv. on Br.             Commissioner Knecht moved, Commissioner Hansen seconded to approve first reading of Ordinance No. 02-01-02-248.  All present voting aye, motion carried.

ORDINANCE NO. 02-01-03-249

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Section 701 (A-1) to Section 714 (M-AG) property described as: The North 593’ of the West 650.83’ of the SW ¼ of Sec. 19, T123N-R62W, to be platted and known as Lot 1 of “Kempf Addition in the SW ¼ of Sec. 19, T123N-R62W of the 5th P.M., Brown County, South Dakota” and extending to the centerline of all public right of way located adjacent thereto (13358 – 394th Avenue), was presented for first reading.

            Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve first reading of Ordinance No. 02-01-03.  Upon roll call, all present voting aye, motion carried.

            Commissioner Knecht moved, Commissioner Hansen seconded to approve first reading of Ordinance No. 02-01-03-249.  All present voting aye, motion carried.

ORDINANCE NO. 02-01-04

                An Ordinance amending Ordinance No. 1164 to Rezone certain described property from Sec. 710 (I-2) to Sec. 705 (R-3) property described as: Lot 17 and Lot 18, Block 67 of Hagerty and Lloyd’s Addition to Aberdeen Corrected Plat and extending to the centerline of all public right of way located adjacent thereto (501 First Avenue SE), was presented.  Commissioner Omland moved, Commissioner Pfeifer seconded to approve first reading of Ordinance No. 02-01-04.  Upon roll call, all present voting aye, motion carried.

                Commissioner Pfeifer moved, Commissioner Omland seconded to set a hearing date of February 4, 2002 at 6:30 p.m. for applications for alcoholic beverage licenses: Transfer of Retail On-Sale Liquor License from TT Investments dba TT Investments, 5 South Main Street to S & S, LLC dba S & S Bar & Lounge, 5 South Main Street; and Special One-Day Retail On-Off Sale Malt Beverage License – February 23, 2002 – Whitetails Unlimited dba Yelduz Shrine Mosque, 802 South Main street.  All present voting aye, motion carried.

AGREEMENT

                Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign Purchase Agreement with Phillystran, Inc. for 78,000 feet of  wildlife deterrent line for the Airport.  All present voting aye, motion carried.

PLATS

                Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve the following plats:  Be it resolved by the Board of Commissioners of Aberdeen, South Dakota, that the plat showing “Feickert’s Subdivision in the SE ¼ of Sec. 8, T. 123 N., R. 64 W. of the 5th P.M., Brown County, South Dakota,” having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3 and any amendments thereof.”

                Be it resolved by the Board of Commissioners of Aberdeen, South Dakota, that the plat showing “Super 8 East Addition to the City of Aberdeen, South Dakota”, having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

                Be it resolved by the City commission of Aberdeen, South Dakota, that the plat showing “Tomek’s First Subdivision in Aberdeen, South Dakota”, having been examined, is hereby approved provisions of SDCL of 1967, Chapter 11-6, and any amendments thereof.

                Commissioner Kirkpatrick moved, Commissioner Omland seconded to set a bid date of February 13, 2002, at 2:00 p.m. for advertisements for bids of One New Front Deck Mower – Public Works Dept./Street Division; One New Refuse Collection Unit – Public Works Dept./Solid Waste Division and One New Motor Grader – Public Works Dept./Street Division.   All present voting aye, motion carried.

REQUEST TO PURCHASE

                A request to purchase a Controller in the amount of $6,000.00 for the Wastewater Treatment Plant was presented.  Commissioner Pfeifer moved, Commissioner Omland seconded to approve the request.  All present voting aye, motion carried.

PAY ESTIMATE

                Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign and approve payment for Pay Estimate #2 to Dahme Construction in the amount of $484,664.17 for work on the Southwest Drainage Improvements.  Upon roll call, all present voting aye, motion carried.

TRAVEL

                Commissioner Pfeifer moved, Commissioner Omland seconded to approve a travel request for Ed Rombs and Scott Bader to attend the South Dakota Building Officials Annual Institute Days in Sioux Falls, SD on February 25 – 27, 2002.  All present voting aye, motion carried.

LICENSES

                Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve Master Electrician and Master Plumber licenses for Max Davidson.  All present voting aye, motion carried.

LOTTERY

                Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to receive and place on file the lottery notices for NSU Foundation and Native American Student Association.  All present voting aye, motion carried.

COMMISSIONERS PROCEEDINGS

                City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 5:30 p.m., January 14, 2002, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Omland and Pfeifer.

EXECUTIVE SESSION

                Commissioner Klabo moved, Commissioner Omland seconded to move into executive session to discuss legal matters.  All voting aye, motion carried.

                Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to move out of executive session and into a Joint City/County Commission Meeting.  All voting aye, motion carried.

                County Commissioners present were Fischbach, Wiese and Hansen.  Commissioner Knecht and Feickert were absent.

ORDINANCE NO. 01-12-02-246

                Commissioner Klabo moved, Commissioner Omland seconded to approve second reading of Ordinance No. 01-12-02.  Upon roll call, all voting aye, motion carried.

                Commissioner Hansen moved, Commissioner Wiese seconded to approve second reading of Ordinance No. 01-12-02-246.  All present voting aye, motion carried.

                Commissioner Omland moved, Commissioner Pfeifer seconded to approve final adoption of Ordinance No. 01-12-02.  Upon roll call, all voting aye, motion carried.

                Commissioner Wiese moved, Commissioner Hansen seconded to approve final adoption of Ordinance No. 01-12-02-246.  All present voting aye, motion carried.

RESOLUTION NO. 02-01-02 R

                Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve the following resolution:

 

RESOLUTION NO. 02-01-02 R

RESOLUTION FOR ANNEXATION OF CERTAIN PROPERTY TO THE CITY LIMITS OF THE CITY OF ABERDEEN

 

                BE IT RESOLVED by the Aberdeen City commission, Brown County, Aberdeen, South Dakota that the voluntary Petition to annex the following described property filed by Arthur Russo and Margaret H. Russo is hereby granted and the following described property is hereby added to the municipal boundaries of the City of Aberdeen, South Dakota and shall be within the city limits of said city.  Said property described as follows:

 

                Lot 1 and Lot 2 of “Russo Addition to Aberdeen in the NW ¼ of Sec. 12, T123N-R64W of the 5th P.M., Brown County, South Dakota (includes replat of Outlot A vacated by this plat)” and including all of the public right of way located adjacent thereto, said plat is recorded as Hanging Plat Number 1671 at the Register of Deeds of Brown County, South Dakota.

 

                BE IT FURTHER RESOLVED by the Aberdeen City Commission, Brown County, Aberdeen, South Dakota that the Mayor of the City of Aberdeen shall cause an accurate map of such territory together with a copy of this Resolution duly certified to be recorded in the Office of the Register of Deeds, Brown County.

 

                All voting aye, motion carried.

BOARD APPOINTMENT

                Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to reappoint Francis E. Brink to the Housing and Redevelopment Commission for a five year term to expire December 31, 2006.  All voting aye, motion carried.

                Commissioner Pfeifer moved, Commissioner Omland seconded to set a bid date of January 30, 2002 at 2:00 p.m. for advertisements for bids for one – 2002 Commercial Van for the Public Works Meter Division; one – 2002 Skid Steer Loader for the Public Works Utility Division; Pavement Marking Paint for the Public Works Traffic Control Division and Deepening of Conlin Pond for NE Drainage Project.  All voting aye, motion carried.

AMENDMENT

                Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve and authorize the Mayor to sign Amendment #1 to Letting, Financial and Maintenance/Encroachment Agreement with the South Dakota Department of Transportation for Project NH 0012(38)289-PCEMS 0569.  All voting aye, motion carried.

REQUEST FOR CITY PARTICIPATION FOR IMPROVEMENTS

                A request for the City to participate in the improvements for 15th Avenue NE was presented.  Commissioner Pfeifer moved, Commissioner Omland seconded to approve the request.  All voting aye, motion carried.

ABERDEEN REGIONAL AIRPORT

                Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign Airport Advertising Agreement with Promoco Advertising.  All voting aye, motion carried.

                Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign Purchase Agreement for Asphalt Millings from South Dakota Department of Transportation.  All voting aye, motion carried.

                Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign Commercial Aviation Net Ground Leases – Lease #23 with Quest Aviation and Lease #8 with Aberdeen Flying Service.  All voting aye, motion carried.

ORDINANCE NO. 01-12-02-246

            Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign Joint Operating Agreement between Aberdeen Rideline and Brown County Area Foster Grandparent Program for transportation services.  All voting aye, motion carried.

            Commissioner Hansen moved, Commissioner Wiese seconded to approve and sign Joint Operating Agreement between Aberdeen Rideline and Brown County Area Foster Grandparent Program.  All present voting aye, motion carried.

HEARING – RESOLUTION NO. 02-01-01 R

            This being the time and place set for a hearing on proposed exchange of property between City and Owners of Sunshine Park property, no one was present to testify, Mayor Hopper closed the hearing.  Commissioner Omland moved, Commissioner Pfeifer seconded to approve the following resolution:

RESOLUTION NO. 02-01-01 R

            Whereas, the City of Aberdeen, a South Dakota Municipal Corporation has previously declared surplus the following property:

            Lots 1, 2, 3, 4, 5, 6, and 7, Block 1, Mel-Ros Estates Sixth Addition to Aberdeen, according to the plat thereof of record, Brown County, South Dakota; and

            Whereas, the City of Aberdeen is willing to accept land in trade for the above described property that is legally described as follows (Hereinafter referred to as Sunshine Park property):

            Sunshine Park Addition to Mel-Ros Estates of the SE ¼ of Section 19, Township 123 North, Range 63 West of Brown County, South Dakota, according to the plat thereof of record; and

            Whereas, the owners of Sunshine Park property are willing to exchange their land with the City of Aberdeen and the land previously described herein owned by the City, under terms of a stipulated court settlement involving the City of Aberdeen v. Timothy Rich, Thomas Tobin, Roger Huff, Huff Development Corporation, a South Dakota Corporation, and SEA Corporation, a South Dakota Corporation, Brown County Civil File No. 98-553; and

            Whereas, the owners of Sunshine Park are a group of individuals, specifically, Douglas J. Eisenbeisz, Roberta L. Eisenbeisz, David F. Renelt, Annette T. Renelt, Dana E. Randall, Rebecca Randall, Gregory E. Nielson, Shelly M. Nielson, Randy L. Giedt, Leigh A. Giedt, Mark S. Zerr, Teri L. Zerr, Jeffrey L. Heupel, and Sandra K. Heupel, will accept individual lots in exchange for their ownership of Sunshine Park; and

            Whereas, all the properties have been previously appraised and as a part of the stipulated court settlement the exchange of properties will occur without any additional transfer of money;

            It is hereby Resolved by the Aberdeen City Commission that the Mayor of the City of Aberdeen is hereby authorized to sign deeds transferring the following properties to the following individuals:

Lot 1 Block 1, Mel-Ros Estates Sixth Addition to Aberdeen, according to the plat thereof of record, Brown County South Dakota, to Jeffrey L. Heupel and Sandra K. Heupel;

PETITION FOR VOLUNTARY ANNEXATION

            A Petition of Voluntary Annexation for Russo Addition to Aberdeen in the NW ¼ of Section 12, T123N-R64W of the 5th P.M., Brown County, South Dakota (1710 North Main Street), was presented.  Commissioner Kirkpatrick moved, Commissioner Omland seconded to refer this petition to the City Attorney, City Engineer, and City Planning/Zoning Director for review and recommendation.  All voting aye, motion carried.

CONTRACTS

GRANT ACCEPTANCE

            The Aberdeen Fire Department, HazMat Division has been awarded a $84,184.27 grant through the US Department of Justice Equipment Grant Program.  This is a 100 percent grant and no matching requirements.  Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to accept this grant and authorize the Mayor to sign.  All voting aye, motion carried.

TRAVEL REQUEST

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve a travel request for Gary Hagman to attend Basic Airport Safety & Operations Specialist School in Phoenix, Arizona from February 9 – 13, 2002.  All voting aye, motion carried.

            There being no further business before the Board, Commissioner Pfeifer moved, Commissioner Klabo seconded that the meeting be adjourned.  All voting aye, motion carried.
