the Board of Commissioners, Mayor Hopper presiding.
Present at roll call were Commissioners Kirkpatrick, Klabo,
Omland and Pfeifer.
Mayor Hopper led the Pledge of Allegiance. MINUTES
Commissioner Pfeifer moved, Commissioner Klabo seconded to
approve the minutes of January 22, 2002, with the following correction:
Page 12902 – change Mayor Hopper to Commissioner Pat Klabo led
the Pledge of Allegiance. All

Mayor Hopper read and proclaimed the week of January 27 through
February 2, 2002, as “Catholic Schools Week”. ZONING
BOARD DISCUSSION
Dean Marske, President of the Zoning Board of Adjustment, was
present to clarify the workings of the Zoning Board.

– GRANT PROGRAM
Ted Dickey, Northeast Council of Governments was present to
discuss South Dakota Division of Emergency Management Hazard Mitigation
Grant Program Preapplication. After
discussion, Commissioner Pfeifer moved, Commissioner Omland seconded to
approve and authorize the Mayor to sign application.

The Contract for services with Inter-Fluve, Inc. for Sediment
Transport Study in Moccasin Creek has been withdrawn per the City

approve and authorize the Mayor to sign Combined Election Agreement with
Brown County and the Aberdeen School District.

OF VOLUNTARY ANNEXATION
A Petition of Voluntary Annexation: Plat of Taylor’s Outlot No.
1 in the East ½ of the SE ¼ of Sec. 23, T123N-R64W of the 5th
P.M., Brown County, South Dakota and including all of the public right
of way located adjacent thereto, said plat is recorded as Hanging Plat
Number 354-B at the Register of Deeds of Brown County, SD (610 W.
Melgaard Road), was presented. Commissioner
Pfeifer moved, Commissioner Klabo seconded to refer this petition to the
City Attorney, City Engineer, and City Planning/Zoning Director for

FOR ANNEXATION OF CERTAIN PROPERTY TO THE CITY LIMITS OF THE CITY OF
ABERDEEN
BE IT RESOLVED by the Aberdeen City commission, Brown County,
Aberdeen, South Dakota that the voluntary Petition to annex the
following described property filed by Arthur Russo and Margaret H. Russo
is hereby granted and the following described property is hereby added
to the municipal boundaries of the City of Aberdeen, South Dakota and
shall be within the city limits of said city. Said property described as follows:
Lot 1 and Lot 2 of “Russo Addition to Aberdeen in the NW ¼ of
Sec. 12, T123N-R64W of the 5th P.M., Brown County, South
Dakota (includes replat of Outlot A vacated by this plat)” and

approve and authorize the Mayor to sign Purchase Agreement for Asphalt
Millings from South Dakota Department of Transportation.

This being the time and place
set for a hearing on proposed exchange of property between City and
Owners of Sunshine Park property, no one was present to testify, Mayor

resolution: RESOLUTION NO. 02-01-01 RWhereas, the City of Aberdeen, a South Dakota Municipal Corporation has previously declared surplus the following property:
Lots 1, 2, 3, 4, 5, 6, and 7,
Block 1, Mel-Ros Estates Sixth Addition to Aberdeen, according to the
plat thereof of record, Brown County, South Dakota; and
Whereas, the City of Aberdeen
is willing to accept land in trade for the above described property that
is legally described as follows (Hereinafter referred to as Sunshine
Park property):
Sunshine Park Addition to
Mel-Ros Estates of the SE ¼ of Section 19, Township 123 North, Range 63
West of Brown County, South Dakota, according to the plat thereof of
record; and
Whereas, the owners of
Sunshine Park property are willing to exchange their land with the City
of Aberdeen and the land previously described herein owned by the City,
under terms of a stipulated court settlement involving the City of
Aberdeen v. Timothy Rich, Thomas Tobin, Roger Huff, Huff Development
Corporation, a South Dakota Corporation, and SEA Corporation, a South

ACCEPTANCE
The Aberdeen Fire Department,
HazMat Division has been awarded a $84,184.27 grant through the US
Department of Justice Equipment Grant Program.
This is a 100 percent grant and no matching requirements.
Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to
accept this grant and authorize the Mayor to sign.

REQUEST
Commissioner Pfeifer moved,
Commissioner Omland seconded to approve a travel request for Gary Hagman
to attend Basic Airport Safety & Operations Specialist School in
Phoenix, Arizona from February 9 – 13, 2002.
