COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 6:30 p.m., January 27, 2003, Joint City/County meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo and Omland.  Commissioner Pfeifer was absent.

            County Commissioners present were Fischbach, Wiese and Hansen.  Commissioners Knecht and Feickert were absent.

ORDINANCE NO. 03-01-01-264

            An Ordinance amending Ordinance No. 1164 to Rezone certain described property from Sec. 710 (I-2) to Sec. 714 (M-AG) property described as:  Lot 2 of “Bourdon’s First Subdivision in NE ¼ of Sec. 21, T123N-R64W of the 5th P.M., Brown County, South Dakota” and extending to the centerline of all public right-of-way located adjacent thereto (38499 – 133rd Street), was presented.  Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve first reading of Ordinance No. 03-01-01-264.  Upon roll call, all present voting aye, motion carried.

            Commissioner Hansen moved, Commissioner Wiese seconded to approve first reading of Ordinance No. 03-01-01-264.  All present voting aye, motion carried.

            There being no further business before the Board, Commissioner Omland moved, Commissioner Klabo seconded to recess to the regular Commission Meeting.  All present voting aye, motion carried.

            Mayor Hopper led the Pledge of Allegiance.

MINUTES

            Commissioner Omland moved, Commissioner Klabo seconded to approve the minutes of January 21, 2003, as circulated.  All present voting aye, motion carried.

ANNOUNCEMENT

            Commissioner Pat Klabo announced that Janel Ellingson would be acting as Superintendent of the Aberdeen Water Treatment Plant, in the absence of Lt. Colonel Rick Wahlen, who has been called to active service in the U.S. Reserves.  No action was taken.

EMPLOYEE RECOGNITIONS

            Mayor Hopper recognized and congratulated Terry Roettele for receiving his Class I Wastewater Treatment Operation Certification; and read Certificates of Appreciation for Healthy and Dedicated year in 2002 and Years of Service Awards for 2002.  No action was taken.

HEARING – ALCOHOLIC BEVERAGE LICENSES

            This being the time and place set for a hearing, no one was present to testify, Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign applications, contingent upon inspections by Health Department:  SPECIAL ONE-DAY RETAIL ON-OFF SALE MALT BEVERAGE LICENSES – February 13, 2003 – Aberdeen Area Chamber of Commerce dba Flooring America, 302 South 2nd Street; March 13, 2003 – Aberdeen Area Chamber of Commerce dba Presentation College Strode Center, 1500 N. Main Street; SPECIAL ONE-DAY RETAIL ON-OFF SALE MALT BEVERAGE LICENSE – February 22, 2003 – Whitetails Unlimited dba Yelduz Shrine Mosque, 802 S. Main Street; TRANSFER RETAIL ON-OFF SALE MALT BEVERAGE LICENSE – From Lonnie Frost & Jeff Ell dba Jackpot Casino, 1111 Sixth Ave. SW to JeffLon Corporation dba Jackpot Casino, 1111 Sixth Ave. SW.  All present voting aye, motion carried.

            This being the time and place set for a hearing, no one was present to testify, Commissioner Klabo moved, Commissioner Kirkpatrick seconded to approve and authorize the Mayor to sign contingent upon final inspections by Health and Fire Departments, the following applications:  NEW RETAIL ON-OFF SALE MALT BEVERAGE LICENSE – Sergio Aguirre dba Mazatlan Mexican Restaurant, 1 South First Street; NEW RETAIL ON-SALE WINE LICENSE – Sergio Aguirre dba Mazatlan Mexican Restaurant, 1 South First Street.  All present voting aye, motion carried.

DOJ SPECIAL APPROPRIATION

            Commissioner Omland moved, Commissioner Klabo seconded to approve and authorize the Project Director to sign DOJ Special Appropriation – Contract for Services between the City of Aberdeen and Aberdeen Family YMCA.  All present voting aye, motion carried.

ENGINEERING AGREEMENT

            Commissioner Klabo moved, Commissioner Omland seconded to approve and authorize the Mayor to sign Engineering Agreement for Pretreatment Clarifier Renovation.  All present voting aye, motion carried.

CONTRACTS

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign contracts for snow removal and wrecker service for Parcel Erickson Texaco and Howard’s Service.  All present voting aye, motion carried.

REQUEST TO ACCEPT QUOTE

            A request to accept Professional Services quote of $4,952.00 from Utility Services Associates for locating leaks within our Water Distribution System, was presented.  Commissioner Klabo moved, Commissioner Omland seconded to approve the request.  All present voting aye, motion carried.

PAY ESTIMATE

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve and authorize the Mayor to sign and approve payment of Pay Estimate #3 – Design Services for 2nd Street Project – Helms & Associates in the amount of $27,010.14.  Upon roll call, all present voting aye, motion carried.

PLATS

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve the following plats:  “Be it resolved by the Board of Commissioners of Aberdeen, South Dakota, that the plat showing “Schmidt First Addition to the City of Aberdeen, South Dakota,” having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.”

            “Be it resolved by the Board of Commissioners of Aberdeen, South Dakota, that the plat showing “Munger First Addition in the SW ¼ of Sec. 28, T. 123N., R. 63 W. of the 5th P.M., Brown County, South Dakota,” having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.”

            “Be it resolved by the Board of Commissioners of Aberdeen, South Dakota, that the plat showing “Bollwerk Addition in the SW ¼ of Sec. 3, T. 123 N., R. 64 W. of the 5th P.M., Brown County, South Dakota,” having been examined is approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.”

            “Be it resolved by the Board of Commissioners of Aberdeen, South Dakota, that the plat showing “Lock Addition in the SW ¼ of Sec. 3, T. 123 N., R. 64 W. of the 5th P.M., Brown County, South Dakota,” having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.”

            “Be it resolved by the Board of Commissioners of Aberdeen, South Dakota, that the plat showing “Dombrowe Lot 1 in the NE ¼ of Sec. 34, T. 123 N., R. 64 W. of the 5th P.M., Brown County, South Dakota,” having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.”

            “Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “LUDWIG’S FIRST SUBDIVISION IN SE ¼ SEC. 33-T124N-R64W OF 5TH P.M., BROWN COUNTY, SOUTH DAKOTA”, having been examined, is hereby approved in accordance with provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            All present voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve the following plats with stipulations:  “Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing Wagner’s Second Addition to Aberdeen in the NW ¼ of Section 23-T123N-R64W of the 5th P.M., Brown County, South Dakota, having been examined, is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof.”

            “Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “Rolling Hills Village Second Addition to the City of Aberdeen,” having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.”

            “Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing Beyers Highland Park Addition in the NW ¼ of Section 23-T123N-R64W of the 5th P.M., Brown County, South Dakota, having been examined, is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof.”

            All present voting aye, motion carried.

LICENSES

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve a Master Plumber License for Christopher B. Bullock, contingent upon Building Official’s recommendation.  All present voting aye, motion carried.

            Commissioner Klabo moved, Commissioner Omland seconded to approve, with contingencies, a Taxi Cab Driver License for Chad A. Madsen.  All present voting aye, motion carried.

LOTTERY

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to receive and place on file the following lottery notices:  Safe Harbor Foundation; Lincoln Elementary School; OM Tiffany PTA; and NSU Foundation.  All present voting aye, motion carried.

DEPARTMENT REPORTS

            Commissioner Klabo moved, Commissioner Omland seconded to receive and place on file department reports for Aberdeen Regional Airport Board Minutes; Alexander Mitchell Library Minutes; Park & Recreation Board Minutes; Mayor’s Committee for People with Disabilities Minutes; Board of Zoning Adjustment Minutes; and Riverside & Memorial Cemeteries Burial Report.  All present voting aye, motion carried.

COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 9:00 a.m., January 21, 2003, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Omland and Pfeifer.

            Mayor Hopper led the Pledge of Allegiance.

MINUTES

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve the Commission Minutes of January 13, 2003, with the following correction:  to include approval of Commission Minutes from January 6, 2003.  All voting aye, motion carried.

NORTH FIFTH STREET BIKE PATH DISCUSSION

            Homeowners were present to voice their opposition to the bike path included in the North Fifth Street Project.  Sarah Pastian, Bill Daschle and Annie Falk expressed their concerns.  No action was taken.

            Commissioner Omland left the meeting at 9:35 a.m.

NORTHEAST COUNCIL OF GOVERNMENTS

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve the following resolution:

RESOLUTION NO. 03-01-03R

 

Authorizing Environmental Protection Agency Grant Application To Assist

With Improvements To The Water Treatment System in Aberdeen, South Dakota

 

            WHEREAS, the City of Aberdeen proposes to execute an application for $2,000,000 Environmental Protection Agency funds to assist in the improvements to the Water Treatment System for the City of Aberdeen; and

 

            WHEREAS, the City of Aberdeen is eligible for Federal assistance for the proposed project; and

 

            WHEREAS, with the submission of the Environmental Protection Agency grant application, the City of Aberdeen assures and certifies that all Environmental Protection Agency grant program requirements will be fulfilled; and

 

            WHEREAS, the City of Aberdeen is required to designate a certifying officer for the purpose of signing documents pertaining to this grant; and

 

            WHEREAS, the City of Aberdeen is required to designate an environmental certifying officer for the purpose of signing required environmental documents pertaining to this grant;

 

            NOW, THEREFORE BE IT RESOLVED, that the Mayor of the City of Aberdeen, will be authorized to execute the Environmental Protection Agency grant application for the City of Aberdeen; and

 

            AND BE IT FURTHER RESOLVED, that the Mayor of the City of Aberdeen, be hereby designated as the City’s certifying officer for the purpose of signing correspondence,  pay requests, and other required documents;

 

            AND BE IT FURTHER RESOLVED, that the Mayor of the City of Aberdeen, be hereby designated as the city’s environmental certifying officer for the purpose of signing correspondence and other required documents and forms.

 

            All present voting aye, motion carried.

 

            Commissioner Klabo moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign, contingent upon City Attorney’s review, NECOG Agreement for EPA Administrative Assistance.  All present voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to approve and authorize Mayor’s signature on grant application to be resubmitted to South Dakota Department of Transportation, the Industrial Access Grant Project Update.  All present voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign Economic Development Initiative Special Projects (EDI-SP) Grant Application through Veterans Affairs – Housing and Urban Development.  All present voting aye, motion carried.

ABERDEEN FIRE DEPARTMENT

            Commissioner Klabo moved, Commissioner Pfeifer seconded to receive and place on file the 2002 Ambulance Call Summary and the 2002 Aberdeen Fire & Rescue Run Report.  All present voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign the 2002 In-State Forest Fire Suppression Agreement.  All present voting aye, motion carried.

SURPLUS

            A request to declare 310 – 2nd Avenue SW surplus property to be deeded to Brown County, was presented.  Commissioner Pfeifer moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign Quit Claim Deed.  All present voting aye, motion carried.

SET BID DATE

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to set a bid date of February 5, 2003 at 2:00 p.m. for advertisements for bids for Rubber-Tired Front-End Loader for Aberdeen Regional Airport; Pavement Marking Paint for Public Works Department Traffic Control Division; and One New 2003 Single Axle Truck Cab and Chassis, Box and Hoist for Public Works Department Utility Division.  All present voting aye, motion carried.

CONTRACTS

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign, contingent upon City Attorney’s review, contracts for chemicals and activated carbon for Hawkins Inc. dba Hawkins Water Treatment Group and Carbonusa, LLC.  All present voting aye, motion carried.

COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 6:00 p.m., January 13, 2003, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Omland and Pfeifer.

EXECUTIVE SESSION

            Commissioner Omland moved, Commissioner Pfeifer seconded to move into executive session to discuss legal matters.  All voting aye, motion carried.

            Commissioner Klabo moved, Commissioner Pfeifer seconded to move out of executive session.  All voting aye, motion carried.

EXPLANATION OF PUBLIC NOTICE

            Water Treatment Plant Superintendent Rick Wahlen spoke on the recent public notice circulated in the Midland Press concerning turbidity test violations at the Treatment Plant.  No health risks were associated with the turbidity limits.  The turbidity limits were exceeded from a small oil spill which was contained prior to release to the water distribution system.

COMBINED NOTICE OF FINDING

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign Combined Notice of Finding of no significant impact and Notice of Intent to request funds for Community/Health and Fitness Center and Childcare Center.  All voting aye, motion carried.

RESIGNATION

            Commissioner Pfeifer moved, Commissioner Klabo seconded to receive and place on file the resignation of Len Scherr from the BID Board of Directors effective immediately.  All voting aye, motion carried.

APPOINTMENTS

            Commissioner Omland moved, Commissioner Pfeifer seconded to appoint Scott Cunningham to the Home Rule Task Force.  All voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Omland seconded to appoint Jon Webb to the BID Board of Directors.  All voting aye, motion carried.

PUBLIC HEARING

            This being the time and place set for a public hearing on Proposed Project and Funding to construct additional Water Treatment Facilities and the renovation of the existing Water Treatment Plant, Mayor Hopper opened the floor for comments.  Dave Odens, Banner Associates, Inc., spoke on the proposed upgrades to the Plant and Erving Podoll spoke about Aberdeen’s future with concerns to water.  No one else present to testify, the hearing was closed.

            Commissioner Klabo moved, Commissioner Omland seconded to approve the following resolution:

RESOLUTION NO. 03-01-02R

Authorizing State Revolving Fund (SRF) Signatory

For the City of Aberdeen

 

            WHEREAS, the City of Aberdeen is proposing to construct a water treatment plant, collection and transmission lines, replace water meters, repair a water tower, create an irrigation system, and repair existing and create additional wells throughout the city; and

 

            WHEREAS, the City of Aberdeen is applying for a Drinking water State Revolving Fund (DWSRF) loan in an amount up to, but not exceeding $14,460,000; and

 

            WHEREAS, the City of Aberdeen needs to authorize a DWSRF signatory.

 

            NOW THEREFORE, BE IT RESOLVED that the City of Aberdeen make application to the South Dakota Department of Environment and Natural Resources for a DWSRF loan in an amount up to, but not exceeding $14,460,000 at an interest rate of 3.5% for a term of up to 20 years.  The security pledged toward repayment will be a revenue bond; and

 

            BE IT FURTHER RESOLVED that the Mayor of the City of Aberdeen be the authorized signatory for all loan related documents, including the application and pay requests.

 

            All voting aye, motion carried.

 

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign an Agreement with Northeast Council of Governments (NECOG) to administer DWSRF Loan, contingent upon City Attorney review.  All voting aye, motion carried.

ORDINANCE NO. 03-01-02

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve second reading of Ordinance No. 03-01-02.  Upon roll call, all voting aye, motion carried.

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve final adoption of Ordinance No. 03-01-02.  Upon roll call, all voting aye, motion carried.

ABERDEEN REGIONAL AIRPORT

RESOLUTION NO. 03-01-01 R

RESOLUTION OF ACCEPTANCE OF UTILITY IMPROVEMENTS

 

            WHEREAS, there has been filed with the city of Aberdeen, South Dakota, a Petition by the Developer to accept the operation and maintenance of Sewer Improvements, and;

 

            WHEREAS, said improvements have been inspected by the City and the Developer’s engineer and find them to meet the minimum City Standards, and

 

            BE IT RESOLVED by the Aberdeen City Commission, Aberdeen, Brown County, South Dakota that the improvements were made in legally platted right-of-way known as a portion of 10th Avenue SW, 15th Street South, and 14th Street South, more particularly described as follows:

 

            Sanitary Sewer located on Tenth Avenue Southwest between Fourteenth Street South and Sixteenth Street South, Fourteenth Street South between Ninth Avenue Southwest and Tenth Avenue Southwest and Fifteenth Street South between Ninth Avenue Southwest between Ninth Avenue Southwest and Tenth Avenue Southwest, located in the NW ¼ of 23-123N-64W in Aberdeen, Brown County, South Dakota.

            BE IT FURTHER RESOLVED that the City of Aberdeen will accept the operation and maintenance of said sewer improvements from this date.

STANDARD POLICIES & PROCEDURES

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve and authorize the Mayor and Commissioners to sign the revision to Bereavement Leave Policy #010.  All voting aye, motion carried.

HEARING – MALT BEVERAGE LICENSE

            This being the time and place set for a hearing on application for New Retail On-Off Sale Malt Beverage License for LOM, Inc. dba S & S Bar & Lounge, 5 South Main Street, approval for recommendation was received, Brad Thorstad was present to support the license, Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign the license.  All voting aye, motion carried.

JOINT COOP AGREEMENT

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign the 2003 Joint Cooperative Agreement with Northeast Council of Governments.  All voting aye, motion carried.

SET JOINT HEARING DATE

            Commissioner Klabo moved, Commissioner Omland seconded to set a joint hearing date of January 27, 2002 at 6:30 p.m. for Petition to Rezone – From Sec. 710 (I-2) to Sec. 714 (M-AG) property described as: Lot 2 of “Bourdon’s First Subdivision in NE ¼ of Sec. 21, T123N-R64W of the 5th P.M., Brown County, South Dakota” and extending to the centerline of all public right-of-way located adjacent thereto. POLICE CONTRACT WITH NSU

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve and authorize the Mayor to sign Police Services Contract with the City and Northern State University.  All voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve a request to declare two (2) low band radios surplus property and to donate radios to the Department of Game, Fish and Parks.  All voting aye, motion carried.

PAY REQUEST

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to approve payment of Pay Request for maintenance of Stream Gaging System – USGS in the amount of $11,400.00.  Upon roll call, all voting aye, motion carried.

PAY ESTIMATE

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign and approve payment for Pay Estimate #2 – South 5th Street Project – Muth Electric in the amount of $40,196.29.  Upon roll call, all voting aye, motion carried.

            Commissioner Klabo moved, Commissioner Omland seconded to approve a Master Electrician license for Allan R. Johnson.  All voting aye, motion carried.
