meeting of the Board of Commissioners, Mayor Hopper presiding.
Present at roll call were Commissioners Kirkpatrick, Klabo and
Omland. Commissioner
Pfeifer was absent.
County Commissioners present were Fischbach, Wiese and Hansen.
Commissioners Knecht and Feickert were absent. ORDINANCE
NO. 03-01-01-264
An Ordinance amending Ordinance No. 1164 to Rezone certain
described property from Sec. 710 (I-2) to Sec. 714 (M-AG) property
described as: Lot 2 of
“Bourdon’s First Subdivision in NE ¼ of Sec. 21, T123N-R64W of the
5th P.M., Brown County, South Dakota” and extending to the
centerline of all public right-of-way located adjacent thereto (38499
– 133rd Street), was presented.
Commissioner Kirkpatrick moved, Commissioner Klabo seconded to
approve first reading of Ordinance No. 03-01-01-264.
Upon roll call, all present voting aye, motion carried.
Commissioner Hansen moved, Commissioner Wiese seconded to approve
first reading of Ordinance No. 03-01-01-264.
All present voting aye, motion carried.
There being no further business before the Board, Commissioner
Omland moved, Commissioner Klabo seconded to recess to the regular

Commissioner Omland moved, Commissioner Klabo seconded to approve
the minutes of January 21, 2003, as circulated.

Commissioner Pat Klabo announced that Janel Ellingson would be
acting as Superintendent of the Aberdeen Water Treatment Plant, in the
absence of Lt. Colonel Rick Wahlen, who has been called to active
service in the U.S. Reserves. No

RECOGNITIONS
Mayor Hopper recognized and congratulated Terry Roettele for
receiving his Class I Wastewater Treatment Operation Certification; and
read Certificates of Appreciation for Healthy and Dedicated year in 2002
and Years of Service Awards for 2002.

AGREEMENT
Commissioner Klabo moved, Commissioner Omland seconded to approve
and authorize the Mayor to sign Engineering Agreement for Pretreatment
Clarifier Renovation. All

Commissioner Kirkpatrick moved, Commissioner Omland seconded to
approve and authorize the Mayor to sign contracts for snow removal and
wrecker service for Parcel Erickson Texaco and Howard’s Service.

A request to accept Professional Services quote of $4,952.00 from
Utility Services Associates for locating leaks within our Water
Distribution System, was presented.

Commissioner Omland moved, Commissioner Kirkpatrick seconded to
approve and authorize the Mayor to sign and approve payment of Pay
Estimate #3 – Design Services for 2nd Street Project –
Helms & Associates in the amount of $27,010.14.

Commissioner Kirkpatrick moved, Commissioner Omland seconded to
approve the following plats: “Be

County, South Dakota, having been examined, is hereby approved in

thereof.”
“Be it resolved by the City Commission of Aberdeen, South
Dakota, that the plat showing “Rolling Hills Village Second Addition
to the City of Aberdeen,” having been examined is hereby approved in
accordance with the provisions of SDCL of 1967, Chapter 11-3, and any
amendments thereof.”
“Be it resolved by the City Commission of Aberdeen, South
Dakota, that the plat showing Beyers Highland Park Addition in the NW ¼

Dakota, having been examined, is hereby approved in accordance with the

the Board of Commissioners, Mayor Hopper presiding.
Present at roll call were Commissioners Kirkpatrick, Klabo,
Omland and Pfeifer.

Commissioner Pfeifer moved, Commissioner Omland seconded to
approve the Commission Minutes of January 13, 2003, with the following
correction: to include approval of Commission Minutes from January 6,

FIFTH STREET BIKE PATH DISCUSSION
Homeowners were present to voice their opposition to the bike
path included in the North Fifth Street Project.
Sarah Pastian, Bill Daschle and Annie Falk expressed their
concerns. No action was taken.
Commissioner Omland left the meeting at 9:35 a.m. NORTHEAST
COUNCIL OF GOVERNMENTS
Commissioner Pfeifer moved, Commissioner Klabo seconded to
approve the following resolution: RESOLUTION NO. 03-01-03R Authorizing Environmental Protection Agency Grant Application To Assist With
Improvements To The Water Treatment System in Aberdeen, South Dakota WHEREAS, the City of Aberdeen proposes to execute an application for $2,000,000 Environmental Protection Agency funds to assist in the improvements to the Water Treatment System for the City of Aberdeen; and
WHEREAS, the City of Aberdeen is eligible for Federal assistance
for the proposed project; and
WHEREAS, with the submission of the Environmental Protection
Agency grant application, the City of Aberdeen assures and certifies
that all Environmental Protection Agency grant program requirements will
be fulfilled; and
WHEREAS, the City of Aberdeen is required to designate a
certifying officer for the purpose of signing documents pertaining to
this grant; and
WHEREAS, the City of Aberdeen is required to designate an
environmental certifying officer for the purpose of signing required
environmental documents pertaining to this grant;
NOW, THEREFORE BE IT RESOLVED, that the Mayor of the City of
Aberdeen, will be authorized to execute the Environmental Protection
Agency grant application for the City of Aberdeen; and
AND BE IT FURTHER RESOLVED, that the Mayor of the City of
Aberdeen, be hereby designated as the City’s certifying officer for
the purpose of signing correspondence, pay requests, and other required documents;
AND BE IT FURTHER RESOLVED, that the Mayor of the City of
Aberdeen, be hereby designated as the city’s environmental certifying
officer for the purpose of signing correspondence and other required
documents and forms.
All present voting aye, motion carried. Commissioner Klabo moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign, contingent upon City Attorney’s review, NECOG Agreement for EPA Administrative Assistance. All present voting aye, motion carried.

approve and authorize Mayor’s signature on grant application to be
resubmitted to South Dakota Department of Transportation, the Industrial
Access Grant Project Update. All

approve and authorize the Mayor to sign Economic Development Initiative
Special Projects (EDI-SP) Grant Application through Veterans Affairs –

Division; and One New 2003 Single Axle Truck Cab and Chassis, Box and
Hoist for Public Works Department Utility Division.

OF PUBLIC NOTICE
Water Treatment Plant Superintendent Rick Wahlen spoke on the
recent public notice circulated in the Midland Press concerning
turbidity test violations at the Treatment Plant.
No health risks were associated with the turbidity limits.
The turbidity limits were exceeded from a small oil spill which
was contained prior to release to the water distribution system. COMBINED

approve and authorize the Mayor to sign Combined Notice of Finding of no
significant impact and Notice of Intent to request funds for
Community/Health and Fitness Center and Childcare Center. All

HEARING
This being the time and place set for a public hearing on
Proposed Project and Funding to construct additional Water Treatment
Facilities and the renovation of the existing Water Treatment Plant,
Mayor Hopper opened the floor for comments.
Dave Odens, Banner Associates, Inc., spoke on the proposed
upgrades to the Plant and Erving Podoll spoke about Aberdeen’s future
with concerns to water. No one else present to testify, the hearing was closed.
Commissioner Klabo moved, Commissioner Omland seconded to approve
the following resolution: RESOLUTION NO. 03-01-02R Authorizing
State Revolving Fund (SRF) Signatory For
the City of Aberdeen WHEREAS, the City of Aberdeen is proposing to construct a water treatment plant, collection and transmission lines, replace water meters, repair a water tower, create an irrigation system, and repair existing and create additional wells throughout the city; and
WHEREAS, the City of Aberdeen is applying for a Drinking water
State Revolving Fund (DWSRF) loan in an amount up to, but not exceeding
$14,460,000; and
WHEREAS, the City of Aberdeen needs to authorize a DWSRF
signatory.
NOW THEREFORE, BE IT RESOLVED that the City of Aberdeen make
application to the South Dakota Department of Environment and Natural
Resources for a DWSRF loan in an amount up to, but not exceeding
$14,460,000 at an interest rate of 3.5% for a term of up to 20 years.
The security pledged toward repayment will be a revenue bond; and
BE IT FURTHER RESOLVED that the Mayor of the City of Aberdeen be
the authorized signatory for all loan related documents, including the
application and pay requests.

OF ACCEPTANCE OF UTILITY IMPROVEMENTS WHEREAS, there has been filed with the city of Aberdeen, South Dakota, a Petition by the Developer to accept the operation and maintenance of Sewer Improvements, and;
WHEREAS, said improvements have been inspected by the City and
the Developer’s engineer and find them to meet the minimum City
Standards, and
BE IT RESOLVED by the Aberdeen City Commission, Aberdeen, Brown
County, South Dakota that the improvements were made in legally platted
right-of-way known as a portion of 10th Avenue SW, 15th
Street South, and 14th Street South, more particularly
described as follows:
Sanitary Sewer located on Tenth Avenue Southwest between
