COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 5:30 p.m., July 28, 2003, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Forkel, Klabo and Omland.  Commissioner Kirkpatrick was absent.

            Mayor Hopper led the Pledge of Allegiance.

MINUTES

            Commissioner Forkel moved, Commissioner Omland seconded to approve the minutes of July 21 and 22, 2003, as circulated.  All present voting aye, motion carried.

ORDINANCE NO. 03-07-03

            Commissioner Klabo moved, Commissioner Omland seconded to approve second reading of Ordinance No. 03-07-03.  Upon roll call, all present voting aye, motion carried.

            Commissioner Omland moved, Commissioner Forkel seconded to approve final adoption of Ordinance No. 03-07-03.  Upon roll call, all present voting aye, motion carried.

REQUEST

            Commissioner Klabo moved, Commissioner Forkel seconded to approve a request from Aberdeen Area Chamber of Commerce to change the Special One-Day Retail On-Off Sale Malt Beverage License for August 14, 2003 at the Airport to August 21, 2003.  All present voting aye, motion carried.

HEARING

            This being the time and place set for a hearing on applications for Transfers of Retail On-Sale Liquor, Package Off-Sale Liquor, and Retail On-Sale Wine Licenses from Refuge Lounge Inc. dba Refuge Lounge, 715 Lancelot Drive to Wild Oats, L.L.C. dba Wild Oats Sports Bar, 322 South Main Street, no one was present to testify, Commissioner Omland moved, Commissioner Forkel seconded to approve and authorize the Mayor to sign contingent upon final inspections by Health and Fire Departments.  All present voting aye, motion carried.

REQUEST

            Commissioner Klabo moved, Commissioner Omland seconded to approve a request for Teen Court Volunteers to attend a National Youth Court Conference in Washington, D.C., using JAIBG Funds to pay travel expenses.  All present voting aye, motion carried.

PETITION TO VACATE

            Commissioner Klabo moved, Commissioner Forkel seconded to refer to the City Attorney, Engineer and Planning/Zoning Director for review, the petition to vacate public right-of-way:  a 16’ wide public alley located east of South Washington Street between Third Avenue SE and Fourth Avenue SE.  All present voting aye, motion carried.

BOND

            Commissioner Klabo moved, Commissioner Omland seconded to receive and place on file an Excavator Bond for Dustin Usselman.  All present voting aye, motion carried.

REQUEST

            Commissioner Forkel moved, Commissioner Omland seconded to approve a street use request for Bill Gerdes.  All present voting aye, motion carried.

PAY ESTIMATES

            Commissioner Omland moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign and approve payment for pay estimates:  #3 – Final – work on Montrose Street – Lien Transportation - $5,656.07; #4 – work on South Main and Lincoln Sewer/Street – Dahme Construction - $430,479.88; #4 – work on North 5th Street project – T & R Contracting - $222,803.10.  Upon roll call, all present voting aye, motion carried.

PAY REQUEST

            Commissioner Forkel moved, Commissioner Omland seconded to approve payment of Final Pay Request for production of recycling video to Kaleidoscope Media in the amount of $2,482.40.  Upon roll call, all present voting aye, motion carried.

LOTTERY

            Commissioner Klabo moved, Commissioner Omland seconded to receive and place on file lottery notices for Glacial Lakes Regional Chili Cook-Off; Roncalli Booster Club; and Make A Wish Foundation of South Dakota.  All present voting aye, motion carried.

DEPARTMENT REPORTS

            Commissioner Omland moved, Commissioner Forkel seconded to receive and place on file the following department reports:  Aberdeen Regional Airport Board Minutes; Alexander Mitchell Library Board Minutes; Aberdeen Parking Board Minutes; Board of Zoning Adjustment Minutes and Riverside and Memorial Cemeteries Burial Report.  All present voting aye, motion carried.

            Commissioner Klabo moved, Commissioner Omland seconded to approve the following audited claims for services, supplies, repairs and maintenance:  United Parcel Service 57.06; Qwest 128.55; Wells Fargo Bank, NA 986,037.50; Painters Touch 1,225.77; Dacotah Bank 540.00.   Upon roll call, all present voting aye, motion carried.

            Commissioner Omland moved, Commissioner Forkel seconded to approve second reading of Ordinance No. 03-07-01.  Upon roll call, all present voting aye, motion carried.

ORDINANCE NO. 03-07-02-282

            Commissioner Omland moved, Commissioner Forkel seconded to approve second reading of Ordinance No. 03-07-02.  Upon roll call, all present voting aye, motion carried.

            Commissioner Knecht moved, Commissioner Wiese seconded to approve second reading of Ordinance No. 03-07-02-282.  All voting aye, motion carried.

COMMISSIONERS PROCEEDINGS

            Commissioner Forkel moved, Commissioner Kirkpatrick seconded to approve the minutes of July 14, 2003, as circulated.  All voting aye, motion carried.

PUBLIC HEARING – RESOLUTION NO. 03-07-01 R

            This being the time and place set for a public hearing regarding an intent to set a method of valuation for an occupation tax within the Business Improvement District, no one was present to testify, Mayor Hopper closed the hearing.

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve the following resolution:

RESOLUTION NO. 03-07-01 R

RESOLUTION OF INTENT

 

            WHEREAS, the Aberdeen City Commission previously passed Resolution 00-08-02R creating the boundaries of a Business Improvement District; and

 

            WHEREAS, the Aberdeen City Commission previously passed a Resolution of Intent 01-01-02R setting out the purposes allowed by the Business Improvement District; and

 

            WHEREAS, the Resolution of Intent 01-01-02 R included a method to raise revenue for the Business Improvement District based on a special assessment based upon valuation of property; and

 

            WHEREAS, the method of raising revenue for the Business Improvement District shall be fair and equitable; and

 

            WHEREAS, the Business Improvement District is intending to change the method of how revenue is raised to a general occupation tax based upon square footage of the owner’s and user’s place of business according to the footprint of the said property;

 

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF ABERDEEN, SOUTH DAKOTA THAT:

 

            The method of raising revenue for the Business Improvement District created by Resolution of Intent 01-01-02R shall be by general occupation tax based upon the square footage of the owner’s or user’s place of business according to the footprint of the said property located within the district rather than by special assessment based upon the valuation of the owner’s property.

 

            All voting aye, motion carried.

 

MINIATURE GOLF COURSE AT WYLIE PARK

            Rob Keil and Bruce Johnson, Parks, Recreation & Forestry Board Members, were present to discuss the options available for construction and operation of a miniature golf course at Wylie Park.  After considerable discussion, Commissioner Klabo moved, Commissioner Forkel seconded to accept Al Novstrup’s proposal to privately construct and operate mini golf at Wylie Park.  All voting aye, motion carried.

ORDINANCE NO. 03-07-04

            Commissioner Forkel moved, Commissioner Omland seconded to approve second reading of Ordinance No. 03-07-04.  Upon roll call, all voting aye, motion carried.

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to approve final adoption of Ordinance No. 03-07-04.  Upon roll call, all voting aye, motion carried.

ORDINANCE NO. 03-07-05

            Commissioner Kirkpatrick moved, Commissioner Forkel seconded to approve second reading of Ordinance No. 03-07-05.  Upon roll call, all voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve final adoption of Ordinance No. 03-07-05.  Upon roll call, all voting aye, motion carried.

ORDINANCE NO. 03-07-06

            Commissioner Omland moved, Commissioner Klabo seconded to approve second reading of Ordinance No. 03-07-06.  Upon roll call, all voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Forkel seconded to approve final adoption of Ordinance No. 03-07-06.  Upon roll call, all voting aye, motion carried.

ORDINANCE NO. 03-07-03

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Section 706 (C-1) and Section 711 (R-4) to Section 707 (C-2) property described as: Lot 1 of P & F First Morning Heights Subdivision in Aberdeen, South Dakota and extending to the centerline of all public right-of-way located adjacent thereto (708 S. Roosevelt Street), was presented.  Commissioner Klabo moved, Commissioner Omland seconded to approve first reading of Ordinance No. 03-07-03.  Upon roll call, all voting aye, motion carried.

HEARING

            This being the time and place set for a hearing on application for Special One-Day On-Off Sale Retail Malt Beverage License for August 14, 2003: Aberdeen Area Chamber of Commerce dba Aberdeen Regional Airport, 4740 – 6th Avenue SE, no one was present to testify, Commissioner Klabo moved, Commissioner Omland seconded to approve and authorize the Mayor to sign application contingent upon Health Departments recommendation.  All voting aye, motion carried.

COMPREHENSIVE PLANNING

            A request to seek Comprehensive Planning Consultant to assist in developing a Comprehensive Plan for the City and its 3-mile planning and zoning jurisdiction, was presented.  Commissioner Kirkpatrick moved, Commissioner Forkel seconded to approve the request.  All voting aye, motion carried.

AGREEMENT

            Commissioner Omland moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign Reimbursement Agreement with the Transportation Security Administration for law enforcement services at the Airport.  All voting aye, motion carried.

DIRECT DEPOSIT

            Commissioner Kirkpatrick moved, Commissioner Forkel seconded to approve the City of Aberdeen – Policy #019 – Direct Deposit.  All voting aye, motion carried.

CONTRACT

            Commissioner Forkel moved, Commissioner Omland seconded to approve and authorize the Mayor to sign contract with Upper Plains for 2nd Street North Water and Wastewater Piping.  All voting aye, motion carried.

REQUEST TO PURCHASE

            Commissioner Omland moved, Commissioner Forkel seconded to approve a request to purchase a Video Projector from CDWG for $3,750.00.  All voting aye, motion carried.

BOND

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to receive and place on file an excavator bond for Marti Rathert dba Rathert Electric.  All voting aye, motion carried.

SET BID DATE

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to set a bid date of August 6, 2003 at 2:00 p.m. for Roadway Deicing Salt for 2003-2004.  All voting aye, motion carried.

AMENDMENT

            Commissioner Klabo moved, Commissioner Omland seconded to approve and authorize the Mayor to sign Amendment No. 2 to Banner Engineering Services Agreement for design and construction of City Water Treatment Plant.  All voting aye, motion carried.

PLATS

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve the following plats:  Be it resolved by the Board of Commissioners of Aberdeen, South Dakota, that the plat showing Wika Addition in the SW ¼ of Sec. 27, T. 124N., R. 64 W. of the 5th P.M., Brown County, South Dakota, having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            Be it resolved by the Board of Commissioners of Aberdeen, South Dakota that the plat showing Artz Addition to the City of Aberdeen, South Dakota, having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            Be it resolved by the Board of Commissioners of Aberdeen, South Dakota, that the plat showing CCK Addition to the City of Aberdeen, South Dakota, having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

SOUTH 5TH STREET IMPROVEMENTS

            Commissioner Omland moved, Commissioner Forkel seconded to approve and authorize the Mayor to sign Change Order #B3 (Final) – Muth Electric, Inc. – increase of $696.50.  All voting aye, motion carried.

            Commissioner Omland moved, Commissioner Forkel seconded to approve and authorize the Mayor to sign and approve payment of Pay Estimate #B5 (final) – Muth Electric in the amount of $12,803.99.  Upon roll call, all voting aye, motion carried.

PAY ESTIMATE

            Commissioner Forkel moved, Commissioner Kirkpatrick seconded to approve and authorize the Mayor to sign and approve payment of Pay Estimate #2 for work on 3rd Avenue SW Project to Upper Plains Contracting in the amount of $294,885.54.  Upon roll call, all voting aye, motion carried.

LICENSE

            Commissioner Klabo moved, Commissioner Omland seconded to approve a transient merchant license for Fabian Seafood Company.  All voting aye, motion carried.

            WHEREAS, the City of Aberdeen, Brown County, South Dakota is governed by a commission form of government with five commissioners as allowed under SDCL Title 9, Chapter 9; and

 

            WHEREAS, SDCL 9-9-18 through 9-9-24, inclusive, outlines the areas of responsibility for each commission member under the five-commissioner form of municipal government and requires assignment of commission member duties by an annual resolution;

 

            NOW, THEREFORE, BE IT RESOLVED that the areas of responsibility and duties for the Aberdeen City Commission be as follows:

 

            Mayor, Thomas L. A RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION FOR A GRANT UNDER SECTION 5311 OF THE SURFACE TRANSPORTATION ASSISTANCE ACT

 

            WHEREAS, the U.S. Department of Transportation is authorized to make grants to states through the Federal Transit Administration (FTA) to support capital and operating assistance projects for nonurbanized public transportation systems Section 5311 of the Surface Transportation Assistance Act, and;

 

            WHEREAS, the South Dakota Department of Transportation, Division of Fiscal and Public Assistance, Office of Air Rail and Transit has been designated by the Governor to administer Section 5311, and;

 

            WHEREAS, the contract for financial assistance will impose certain obligations upon the applicant, including provision by it of the local share of project costs;

 

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF ABERDEEN:

 

            That David Osborn is authorized to execute and file an application on behalf of Aberdeen Ride Line with the South Dakota Department of Transportation to aid in the financing of capital and/or operating assistance projects pursuant to Section 5311 of the Surface Transportation Assistance Act.
