COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 6:30 p.m., March 31, 2003, Joint City/County meeting of the Board of Commissioners, Commissioner Pat Klabo presiding.  Present at roll call were Commissioners Kirkpatrick, Omland and Pfeifer.  Mayor Hopper was absent.

            County Commissioners present were Feickert, Fischbach and Wiese.  Commissioners Knecht and Hansen were absent.

ORDINANCE NO. 03-03-01-272

            Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve second reading of Ordinance No. 03-03-01.  Upon roll call, all present voting aye, motion carried.

            Commissioner Feickert moved, Commissioner Wiese seconded to approve second reading of Ordinance No. 03-03-01-272.  All present voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve final adoption of Ordinance No. 03-03-01.  Upon roll call, all present voting aye, motion carried.

            Commissioner Wiese moved, Commissioner Feickert seconded to approve final adoption of Ordinance No. 03-03-01-272.  All present voting aye, motion carried.

ORDINANCE NO. 03-03-02-273

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve second reading of Ordinance No. 03-03-02.  Upon roll call, all present voting aye, motion carried.

            Commissioner Feickert moved, Commissioner Wiese seconded to approve second reading of Ordinance No. 03-03-02-273.  All present voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve final adoption of Ordinance No. 03-03-02.  Upon roll call, all present voting aye, motion carried.

            Commissioner Wiese moved, Commissioner Feickert seconded to approve final adoption of Ordinance No. 03-03-02-273.  All present voting aye, motion carried.

            There being no further business before the Joint Commission, Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to adjourn to the regular City Commission meeting.  All present voting aye, motion carried.

MINUTES

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve the minutes of March 24, 2003, as circulated.  All present voting aye, motion carried.

BOARD APPOINTMENT

            Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve an appointment of Daniel Cybulski to the Housing and Redevelopment Commission for a 5 year term to expire December, 31, 2007.  All present voting aye, motion carried.

CONTINUED – ORDINANCES

            Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to continue for one week, Ordinance No. 03-03-04, Ordinance No. 03-03-05, and Ordinance No. 03-03-06.  All present voting aye, motion carried.

PARKING LEASE

            Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to approve and authorize the Mayor to sign a Lease of parking area from First United Methodist Church of Aberdeen.  All present voting aye, motion carried.

HEARING

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to deny an application for New Retail On-Off Sale Malt Beverage License for Bradley Thorstad and Jason Reif dba Generations Pub, 22 Second Avenue SE.  All present voting aye, motion carried.

SET HEARING DATE

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to set a hearing date of April 21, 2003 at 6:30 p.m. for Petitions to Rezone:  Rezone from Sec. 705 (R-3) to Sec. 706 (C-1) property described as: The E. 134’ of Lots 804 and 805 of Morning Heights Subdivision of Sec. 19, T123N-R63W, Brown County, South Dakota and extending to the center line of all public right-of-way located adjacent thereto.  (1512 – 10th Avenue SE); and Rezone from Sec. 705 (R-3) to Sec. 706 (C-1) and Sec. 711 (R-4) property described as: Lots 747 thru 752 and the N. 15.5’ of Lot 753 of Morning Heights Subdivision of Sec. 19, T123N-R63W, Brown County, South Dakota and extending to the center line of all public right-of-way located adjacent thereto.  (702, 706, and 710 South Roosevelt Street).  All present voting aye, motion carried.

RECOMMENDATION ON BIDS

            The following bids were received and opened for asphaltic concrete repair mixes for the 2003 construction year for the Street Department:  BITUMINOUS REPAIR MIX-3/8” (at Plant Site) – Lien Transportation – 200 T @ $34.50; Aberdeen Asphalt – 200 T @ $33.00; CLASS “G” TYPE II (at Plant Site) – Lien Transportation – 6500 T @ $25.50; Aberdeen Asphalt – 6500 T @ $27.00; Also quoted were Paver Rental Charges – Lien Transportation – Operated by City - $100; Mobilization - $100; Aberdeen Asphalt – Operated by City - $95; Mobilization - $75.  A detailed list of the bids is on file in the Finance Office.  Commissioner Kirkpatrick moved, Commissioner Omland seconded to award the bid to Lien Transportation and the option to rent the paver as needed.  All present voting aye, motion carried.

RECOMMENDATION ON BIDS

            The following bids were received and opened for Road Oil:  Koch Materials Company – total bid price - $102,300.00; Jebro, Inc. – total bid price - $106,164.00.  A detailed list of the bids is on file in the Finance Office.  Commissioner Pfeifer moved, Commissioner Omland seconded to award the bid to Koch Materials Company.  All present voting aye, motion carried.

RECOMMENDATION ON BIDS

            The following bids were received and opened for Watermain, Sewer Pipe and Castings:  TOTAL BID – SCHEDULE A:  Sioux Pipe & Equipment - $57,596.74; Dakota Supply Group - $55,189.09 (incomplete bid); Northern Water Works - $58,517.66; TOTAL BID – SCHEDULE B:  Sioux Pipe & Equipment - $9,746.92; Dakota Supply Group - $13,290.58; Milbank Winwater - $11,434.00; TOTAL BID – SCHEDULE C:  Sioux Pipe & Equipment - $6,604.26; Dakota Supply Group - $5,374.91; Northern Water Works - $5,639.41; Milbank Winwater - $5,440.82.  A detailed list of the bids is on file in the Finance Office.  Commissioner Kirkpatrick moved, Commissioner Omland seconded to award the bids as follows:  Schedule A – Sioux Pipe Inc. - $57,596.74; Schedule B – Sioux Pipe Inc. - $9,746.92; and Schedule C – Dakota Supply Group - $5,374.91.  All present voting aye, motion carried.

RECOMMENDATION ON BIDS

            The following bids were received and opened for 2003 Concrete Work:  JBS & Brewer Construction - $244,211.54; Wright & Sudlow - $244,283.00.  A detailed list of the bids is on file in the Finance Office.  Commissioner Kirkpatrick moved, Commissioner Omland seconded to award the low bid to JBS & Brewer Construction.  All present voting aye, motion carried.

RECOMMENDATION ON BIDS

            The following bids were received and opened on South Main & Lincoln Storm Sewer and Street Reconstruction Project:  Dahme Construction - $757,253.90;  and HF Jacobs & Son Construction Inc. - $856,163.06.  A detailed list of bids is on file in the Finance Office.  Commissioner Kirkpatrick moved, Commissioner Omland seconded to award the low bid to Dahme Construction.  All present voting aye, motion carried.

SET BID DATES

            Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to set a bid date of April 16, 2003 at 2:00 p.m. for two New Biosolids Application Tanks for the City Wastewater Treatment Plant.  All present voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to set a bid date of April 16, 2003 at 9:30 a.m. for North 5th Street Project #P2333(00) PCEMS 5178.  All present voting aye, motion carried.

APPROVE EASEMENT

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign and approve payment of additional easements for the 2nd Street Project as follows:  Harold & Laura Kraushar – 50.00; William & Patricia Johnson – 175.00; William or Jeanette Noyes – 175.00; Jane Ohlde – 10.00; Bradley R. Hoffer – 105.00; North Central Food Systems Inc. – 195.00.  Upon roll call, all present voting aye, motion carried.

PAY ESTIMATE

            Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign and approve payment for Pay Estimate #5 for widening of Conlin Pond to Dahme Construction in the amount of $78,721.56.  Upon roll call, all present voting aye, motion carried.  

PERMISSION TO SERVE

            Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to approve a request for permission to serve and permit consumption of alcoholic beverages at Wylie Park Pavilion on July 19, 2003 for 3M Club Picnic.  All present voting aye, motion carried.

STREET USE REQUESTS

            Commissioner Omland moved, Commissioner Pfeifer seconded to approve street use requests for March of Dimes and Aberdeen Family YMCA.  All present voting aye, motion carried.

DEPARTMENT REPORTS

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to receive and place on file the following department reports:  Aberdeen Regional Airport Board Minutes; Alexander Mitchell Library Minutes; Park & Recreation Board Minutes; Mayor’s Committee for People with Disabilities Minutes; Aberdeen Parking Board Minutes; Board of Zoning Adjustment Minutes; Aberdeen City Planning Commission Minutes; Brown County/Aberdeen City Planning Commission Minutes; and Riverside & Memorial Cemeteries Burial Report.  All present voting aye, motion carried.

FINANCIAL STATEMENT

            Commissioner Pfeifer moved, Commissioner Omland seconded to receive and place on file the Financial Statements for 2001 and 2002 for Aberdeen Area Convention and Visitor’s Bureau.  All present voting aye, motion carried.

OTHER

            Commissioner Klabo reminded the public that as of April 1, 2003, all sump pumps must be directed to discharge to the street rather than the sanitary sewer.

COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 6:30 p.m., March 24, 2003, Joint City/County meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Omland and Pfeifer.

ORDINANCE NO. 03-03-01-272

            An Ordinance amending Section 1001.4, known as the Zoning Ordinance of the City of Aberdeen, South Dakota, to amend a section regarding nonconforming uses of a structure, or structure and premises in combination is discontinued or abandoned, was presented.  Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve first reading of Ordinance No. 03-03-01.  Upon roll call, all voting aye, motion carried.

            Commissioner Feickert moved, Commissioner Wiese seconded to approve first reading of Ordinance No. 03-03-01-272.  All present voting aye, motion carried.

ORDINANCE NO. 03-03-02-273

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Section 701 (A-1) to Section 703 (R-1) property described as:  Lots 1 thru 15 of Plat of Lots 1 through 15, Volk’s Subdivision, located in the NE ¼ of Sec. 4, T123N-R64W of the 5th P.M., Brown County, South Dakota” and Lots 1A thru 15A of Plat of Lots 1A thru 15A, Volk’s Subdivision, located in the NE ¼ of Sec. 4, T123N-R64W, Brown County, South Dakota, and extending to the centerline of all public right-of-way located adjacent thereto, was presented.  Commissioner Klabo moved, Commissioner Pfeifer seconded to approve first reading of Ordinance No. 03-03-02.  Upon roll call, all voting aye, motion carried.

            Commissioner Feickert moved, Commissioner Wiese seconded to approve first reading of Ordinance No. 03-03-02-273.  All present voting aye, motion carried.

HAZARD MITIGATION PLAN

            Freddie Robinson discussed the FEMA requirement to have a Hazard Mitigation Plan in place to receive certain funding.  Plans included in this document would be used by the Feds to determine the level of funding FEMA would allow for some grants.  Discussion followed, no action was taken.

            There being no further business before the Joint Commission, Commissioner Pfeifer moved, Commissioner Klabo seconded that the meeting be adjourned to the Regular City Commission Meeting.  All voting aye, motion carried.

PROCLAMATION

            Mayor Hopper read and proclaimed the month of March as “Professional Social Work Month”.

REQUEST FOR FENCE ORDINANCE

            Peter Kilian was present to request fence ordinance variance to accommodate privacy fence.  No action was taken.

COUNSELORS – SCHOOLS

            Robin Erz was present to further discuss the Chemical Prevention Dependency Counselors proposed to be funded by the city, schools and state.  Commissioner Klabo moved, Commissioner Omland seconded to continue this issue until April 7, 2003.  All voting aye, motion carried.

APPOINTMENT

            Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to appoint four new members to the Business Improvement District (BID) Board:  Jennifer Slaight-Hansen; Len Ivey; Dale Bain and Todd Forkel.  All voting aye, motion carried.

NOMINATING PETITIONS

            Commissioner Klabo moved, Commissioner Omland seconded to receive and place on file the following nominating petitions that have been reviewed and determined to be legally sufficient:  Todd Forkel, Allen E. Gates and Julie J. Pfeifer.  Upon roll call, Commissioners Omland, Klabo, Kirkpatrick and Mayor Hopper voting aye, Commissioner Pfeifer abstaining, motion carried.

NOTICE OF FINDING

            Commissioner Klabo moved, Commissioner Pfeifer seconded to approve publication on March 25, 2003, Advertisement for Notice of Finding of no significant impact for the Aberdeen Water Supply and Treatment Improvements Project.  All voting aye, motion carried.

NOTICE OF AWARD

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign Notice of Award of $2,000,000.00 for Water Infrastructure from US Environmental Protection Agency.  All voting aye, motion carried.

DECLARE SURPLUS

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve a request to declare Police Dog surplus property so it can be given to the South Dakota Highway Patrol.  All voting aye, motion carried.

RECOMMENDATION ON QUOTES

            Quotes were received for Pressure Washers.  Commissioner Pfeifer moved, Commissioner Omland seconded to accept the department recommendation of purchasing two units in the amount of $4,898.00.  All voting aye, motion carried.

REQUEST TO PURCHASE

            A request to purchase Bearing Sleeves for Primary Basin at the Water Treatment Plant in the amount of $3,481.12 was presented.  Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve the request.  All voting aye, motion carried.

PLATS

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve the following plats:  Be it resolved by the Board of Commissioners of Aberdeen, South Dakota, that the plat showing “Koslowski Addition to the City of Aberdeen, South Dakota,” having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            “Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “Keller Addition to the City of Aberdeen, Brown County, South Dakota,” having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 5:15 p.m., March 17, 2003, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Omland and Pfeifer.

EXECUTIVE SESSION

            Commissioner Pfeifer moved, Commissioner Klabo seconded to move into executive session to discuss legal and personnel matters.  All voting aye, motion carried.

            Commissioner Omland moved, Commissioner Klabo seconded to move out of executive session.  All voting aye, motion carried.

            Mayor Hopper led the Pledge of Allegiance.

MINUTES

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve the minutes of March 10, 2003, with the following correction:  Add Aberdeen Builders Exchange to the Lottery Notices.  All voting aye, motion carried.

INTRODUCTION & SWEARING IN POLICE RESERVE

            Police Chief Ken Schwab introduced the Police Reserve Officers and they were sworn in by Judge Tony Portra. 

CONTINUED – ORDINANCE NO. 03-02-10

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve second reading of Ordinance No. 03-02-10, as amended.  Upon roll call, all voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve final adoption of Ordinance No. 03-02-10, as amended.  Upon roll call, all voting aye, motion carried.

CONTINUED – DEVELOPMENT OF MINI GOLF COURSE

            Discussion was held regarding the two proposals from private developers and the proposal from Park and Recreation Board to operate and develop a Mini Golf Course at Wylie Park.  After further discussion, Commissioner Pfeifer moved to reject all proposals and continue to operate mini-golf as is until next budget session.  Motion died for lack of a second.  Commissioner Kirkpatrick moved, Commissioner Omland seconded to refer the matter back to the Park and Recreation Board for further consideration of both bids and a future recommendation to the Commission.  All voting aye, motion carried.

APPOINTMENT

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve the appointment of Terry Ellingson to the position of Fire Department Shift Commander.  All voting aye, motion carried.

APPLICATION

            Commissioner Omland moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign application for 2002 Juvenile Accountability Incentive Block Grant and Notice of Award in the amount of $24,087.00.  All voting aye, motion carried.

REQUEST FOR INTERN

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize supplement to temporary salaries budget of $5,796.00 for a summer intern position in the City Planning and Zoning Department.  All voting aye, motion carried.

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 6:30 p.m., March 10, 2003, Joint City/County meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Omland and Pfeifer.

            County Commissioners present were Feickert, Fischbach and Wiese.  Commissioners Knecht and Hansen were absent.

ORDINANCE NO. 02-09-04-267

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve second reading of Ordinance No. 02-09-04.  Upon roll call, all voting aye, motion carried.

            Commissioner Wiese moved, Commissioner Feickert seconded to approve second reading of Ordinance No. 02-09-04-267.  All present voting aye, motion carried.

            Commissioner Omland moved, Commissioner Pfeifer seconded to approve final adoption of Ordinance No. 02-09-04.  Upon roll call, all voting aye, motion carried.

DRUG/ALCOHOL COUNSELOR DISCUSSION

            Jeff Mitchell, Career Planning Center, Robin Erz, State Prevention Coordinator and Roy Meyer, SD Department of Highway Safety, were present to discuss the city participating in the cost of a Drug/Alcohol Counselor in the school system.  No action was taken.

MAIN STREET PARKING LOT DISCUSSION

            Annette Gross of Annette’s Floral was present to express her concerns over the way the building was sold that she rents on Main Street and the demolition of 3 other buildings to make a parking lot.  Discussion followed, no action was taken.

ORDINANCE NO. 03-03-03 – NVC CABLE TELEVISION ORDINANCE

            Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to approve second reading of Ordinance No. 03-03-03.  Upon roll call, all voting aye, motion carried.

            Commissioner Klabo moved, Commissioner Omland seconded to approve final adoption of Ordinance No. 03-03-03.  Upon roll call, all voting aye, motion carried.

ABERDEEN REGIONAL AIRPORT

            Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to accept the recommendation from the Airport Board to accept low base bid of $30,827 plus $5,119 for three options (speed indicator, hand held bead gun and paint supply 2-60 gallon container) from Sherwin Williams/Graco Company for one Paint Striping Road Machine.  All voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign New Terminal Lease Agreement for TSA.  All voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve a travel request for Trent Anderson and Joel Weig to attend Annual Airport Rescue & Fire Fighting School.  All voting aye, motion carried.

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve and authorize the Mayor to sign and approve payment for Pay Estimates for AIP Project #3-46-0001-21: #8 – Upper Plains Contracting, Inc. - $154,457.12; and #11 – Gray Construction Co. - $238,467.45.  Upon roll call, all voting aye, motion carried.

AMENDMENT

            Commissioner Klabo moved, Commissioner Omland seconded to approve and authorize the Mayor to sign Amendment No. 1 to Agreement No. 712163 between SD Department of Transportation and the City of Aberdeen regarding North 5th Street Project and approve Utility Certification.  All voting aye, motion carried.

SET BID DATE

            Commissioner Omland moved, Commissioner Pfeifer seconded to set a bid date of March 26, 2003 at 2:00 p.m. for advertisement for bids for 2003 Road Oils; 2003 Aggregates; 2003 Watermains & Fittings, Manhole Covers & Inlet Frames & Grates and PVC Sewer Pipe; and 2003 Asphaltic Concrete and Surfacing Repair Mix.  All voting aye, motion carried.

CONTRACT

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve and authorize the Mayor to sign, contingent upon City Attorney’s review, a contract for one new Crysteel Hoist and one new Crysteel Truck Box – Northern Truck Equipment Corp.  All voting aye, motion carried.

ANNUAL REPORT

            Commissioner Pfeifer moved, Commissioner Klabo seconded to receive and place on file the South Dakota Library Network Annual Report and Fact Book.  All voting aye, motion carried.

LICENSE

            Commissioner Klabo moved, Commissioner Omland seconded to approve a Taxi Cab Driver License for Jesse L. Papke, contingent upon Police Department recommendation.  All voting aye, motion carried.

LOTTERY

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to receive and place on file a lottery notice for Northern State University Foundation.  All voting aye, motion carried.

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 5:45 p.m., March 3, 2003, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Omland and Pfeifer.

EXECUTIVE SESSION

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to move into executive session to discussion personnel matters.  All voting aye, motion carried.

ORDINANCE NO. 02-09-04-267

            An Ordinance amending Section 502, 707.3, 708.3, 710.3, and adding Section 1103 to Ordinance No. 1164, known as the Zoning Ordinance of the City of Aberdeen, South Dakota, to add definitions of words, to add sexually oriented businesses as a special exception which may be permitted in the (C-2) Highway Commercial District, (C-3) Central Business District and (I-2) Unrestricted Industrial District and to add adult uses ordinance, was presented.  Several local clergy were present in support of this ordinance.  Commissioner Klabo moved, Commissioner Kirkpatrick seconded to approve first reading of Ordinance No. 02-09-04.  Upon roll call, all voting aye, motion carried.

            Commissioner Hansen moved, Commissioner Wiese seconded to approve first reading of Ordinance No. 02-09-04-267.  All present voting aye, motion carried.

ORDINANCE NO. 02-09-05-268

            An Ordinance amending Section 502, 706.5, 707.2, 708.2, 710.2 and adding Section 1104 to Ordinance No. 1164, known as the Zoning Ordinance of the City of Aberdeen, South Dakota, to add definitions of words, to add all uses in the (C-1) Neighborhood Commercial District, (C-2) Highway Commercial District, (C-3) Central Business District and (I-2) Unrestricted Industrial District are subjected to requirements as defined in Section 1104.  School Safe Zone and to add a 300’ School Safe Zone Ordinance, was presented.  Several local clergy were present in support of this ordinance.  Commissioner Omland moved, Commissioner Pfeifer seconded to approve first reading of Ordinance No. 02-09-05.  Upon roll call, all voting aye, motion carried.

            Commissioner Wiese moved, Commissioner Hansen seconded to approve first reading of ordinance No. 02-09-05-268.  All present voting aye, motion carried.

SET HEARING DATE

            Commissioner Klabo moved, Commissioner Pfeifer seconded to set a hearing date of March 24, 2003 at 6:30 p.m. to Amend Zoning Ordinance No. 1164:  Amending Section 1001.4, known as the Zoning Ordinance of the City of Aberdeen, SD, to amend a section regarding nonconforming uses of a structure, or structure and premises in combination is discontinued or abandoned (Proposed Ord. No. 03-03-01-272); and Petition to Rezone from Sec. 701 (A-1) to Sec. 703 (R-1) property described as:  Lots 1 thru 15 of Plat of Lots 1 through 15, Volk’s Subdivision, located in the NE ¼ of Sec. 4, T123N-R64W of the 5th P.M., Brown County, South Dakota and Lots 1 A thru 15A of Plat of Lots 1A thru 15A, Volk’s Subdivision, located in the NE ¼ of Sec. 4, T123N-R64W, Brown County, South Dakota, and extending to the centerline of all public right-of-way located adjacent thereto (Proposed Ord. No. 03-03-02-273).  All voting aye, motion carried.

            Commissioner Wiese moved, Commissioner Hansen seconded to set a hearing date of March 24, 2003 at 6:30 p.m. on the above mentioned amendment and petition to rezone.  All present voting aye, motion carried.

            There being no further business before the Joint Commission, Commissioner Omland moved, Commissioner Kirkpatrick seconded to adjourn to the Regular City Commission Meeting.  All voting aye, motion carried.

FINANCIAL REPORT

            Commissioner Pfeifer moved, Commissioner Omland seconded to receive and place on file the 2002 Annual Unaudited Financial Report for the City of Aberdeen, SD.  All voting aye, motion carried.

FUNDING AGREEMENT

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to approve and authorize the Mayor to sign Funding Agreement with USGS for Operation and Maintenance of Stream Gages.  All voting aye, motion carried.

ELM LAKE AGREEMENT

            Commissioner Omland moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign Elm Lake Watershed Restoration Grant Agreement between SDDENR and the City.  Upon roll call, Mayor Hopper, Commissioners Klabo, Kirkpatrick and Omland voting aye, Commissioner Pfeifer voting nay, 4 ayes, 1 nay, motion carried.

SET BID DATES
