COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 8:45 a.m., May 27, 2003, Joint City/County meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Omland and Pfeifer.

            County Commissioners present were Knecht, Feickert, Wiese and Hansen.  Commissioner Fischbach was absent.

CONTINUE HEARING ON PETITIONS TO REZONE

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to continued Joint Hearing to June 23, 2003 at 5:30 p.m. on the following petitions to rezone:  REZONE FROM SECTION 704 (R-2) TO SECTION 707 (C-2) PROPERTY DESCRIBED AS:  “Lot 7, NE ¼ of NE ¼ of Sec. 22, T123N-R64W” and “Lot 8, NE ¼ of NE ¼ of Sec. 22, T123N-R64W” (850 S.             Commissioner Knecht moved, Commissioner Wiese seconded to continue Joint Hearing to June 23, 2003 at 5:30 p.m. on the above Petitions to Rezone.  All present voting aye, motion carried.

            There being no further business before the Joint Commission, Commissioner Omland moved, Commissioner Pfeifer seconded that the meeting be adjourned to the regular City Commission Meeting.  All voting aye, motion carried.

            Mayor Hopper led the Pledge of Allegiance.

MINUTES

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve the minutes of May 19, 2003 as circulated.  All voting aye, motion carried.

CONTINUED – HEARING

            This being the time and place set for continued hearing on Renewal of On-Off Sale Malt Beverage License for Bonn Express LLC dba Lucky Spot Casino, 801 North Highway 281, no one was present to testify, recommendations for approval were received, Commissioner Pfeifer moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign license.  All voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve the following resolution:

 

RESOLUTION NO. 03-05-05 R

A RESOLUTION CERTIFYING SUPPORT OF THE RESTORATION OF THE HISTORIC BURLINGTON NORTHERN SANTA FE RAILROAD DEPOT BUILDING AND COMPLIANCE WITH LOCAL ZONING AND PLANNING REGULATIONS

 

            WHEREAS, the Milwaukee Road Depot (now known as the Burlington Northern Santa Fe Railroad Depot), constructed in 1911, is one of Aberdeen’s most significant historical and urban symbols, and

 

            WHEREAS, the Depot served as the center for the regional rail network, providing the only transcontinental passenger service available in South Dakota with up to fourteen scheduled passenger trains per day, and

 

            WHEREAS, the Depot building has been certified to contribute to the significant of the historic district for the purpose of rehabilitation by the United States Department of the Interior National Park Service “Historic Preservation Certification”, and

 

            WHEREAS, the Depot building was placed on the National Register of Historic Places on September 20, 1977, and

 

            WHEREAS, the Tom and Danielle Aman Foundation plans a complete and comprehensive restoration of the historic Deport to include the Native American Cultural and Community Center, James Valley Railroad Model Railroad Club, tourist information center, Wells Fargo Express Station display, and a gift shop, and

 

            WHEREAS, an application for a Transportation Enhancement Project grant will be made to the South Dakota Department of Transportation for the Restoration Project,

 

            NOW, THEREFORE BE IT RESOLVED by the Aberdeen City Commission, Brown County, South Dakota, that the Aberdeen City Commission does support the Restoration Project and will act as sponsor of the Restoration Project to certify compliance with local zoning and planning regulations, maintenance of the project and payment of any required local match for the Transportation Enhancement Project Grant.

 

            All voting aye, motion carried.

            This being the time and place set for a hearing on Renewal of On-Off Sale Malt Beverage License for Lai Liu Inc. dba Hong Kong Restaurant, 1721 SE 6th Avenue, no one was present to testify, Commissioner Klabo moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign contingent upon final inspections by the Health and Fire Departments.  All voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to continue for one week to complete final inspections by Fire Department the Renewal of On-Off Sale Malt Beverage Licenses for NPC International Inc. dba Pizza Hut #2767, 405 NW 5th Avenue and P & M Enterprizes Inc. dba R & A Bar, 9 South Main Street.  All voting aye, motion carried.

RESIGNATIONS

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to accept the resignation of Parking Board Members Scott Johnston and Dick Westra.  All voting aye, motion carried.

APPOINTMENT

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to appoint Aberdeen Downtown Association members Dale Bain and Char Cornelius to the Parking Board.  All voting aye, motion carried.

ABERDEEN REGIONAL AIRPORT

            Commissioner Omland moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign Wildlife Hazard Management Plan Agreement with Bill Antonides dba Gander Island Consulting Services, Inc.  All voting aye, motion carried.

            Commissioner Klabo moved, Commissioner Omland seconded to advertise request for proposals for Café Operation at the Aberdeen Regional Airport on June 11, 2003 at 10:00 a.m. at City Hall.  All voting aye, motion carried.

REQUEST TO HIRE

            Commissioner Omland moved, Commissioner Klabo seconded to approve a request to hire three additional employees for the Fire Department.  All voting aye, motion carried.

RENEWAL APPLICATION

            Commissioner Klabo moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign and approve payment for renewal application from SD DENR to operate solid waste disposal facility and application renewal fee of $500.00 payable to SD DENR.  All voting aye, motion carried.

CONTRACT

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign contract documents from Banner Associates, Inc. – plans and specifications for Aberdeen Water Plant Pretreatment Clarifier Renovation.  All voting aye, motion carried.

FIREWORKS DISPLAY

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign Fireworks Public Display Permit for Aberdeen Parks & Recreation Department for fireworks display on July 4, 2003 at Wylie Park.  All voting aye, motion carried.

STREET LIGHT POLES

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve a request from Traffic Control Department to purchase two new 40 foot street light poles.  All voting aye, motion carried.

PLATS

            Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve the following plats:  Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “Nelson-Bean Addition to the City of Aberdeen, Brown County, South Dakota”, having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “Pomplun’s First Subdivision in Aberdeen, South Dakota”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            Commissioner Klabo moved, Commissioner Pfeifer seconded to approve payment of the following pay requests:  Two Biosolids Application Tanks – Plains Agri-Sales - $42,587.00; Ordway Fencing Materials – Melius Fencing - $3,000.12.  Upon roll call, all voting aye, motion carried.

LOTTERY

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to receive and place on file lottery notices for Aberdeen Aqua Addicts Water Ski Team and Parents of Special Olympians-Aberdeen Chapter.  All voting aye, motion carried.

COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 6:30 p.m., May 19, 2003, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Klabo, Omland and Pfeifer.  Commissioner Kirkpatrick was absent.

MINUTES

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve the minutes of May 12, 2003.  All present voting aye, motion carried.

REQUEST FOR SUPPORT

            A request for support from the City in applying for a grant through the South Dakota Department of Transportation for restoration of the Milwaukee Road Depot Station was presented.  Heidi Kramer and Robin Vallie, representatives from Aman Foundation/Blackstone LLC were present to give information and answer questions.  After discussion, Commissioner Omland moved, Commissioner Pfeifer seconded to support the project.  All present voting aye, motion carried.

RESOLUTION NO. 03-05-04 R

            Resolution No. 03-05-04 R – Resolution giving approval to certain drinking water facilities improvements; giving approval to the issuance and sale of revenue bonds to finance, directly or indirectly, the improvements to the facilities; approving the form of the loan agreements and the revenue bonds and pledging certain revenues and collateral to secure the payment of the revenue bonds; and creating special funds and accounts for the administration of funds for operation of the system and retirement of the revenue bonds, was presented.  Commissioner Klabo moved, Commissioner Omland seconded to approve Resolution No. 03-05-04 R.  Upon roll call, all present voting aye, motion carried.

DECLARE SURPLUS

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve a request to declare two 1995 Ford Ride Line Buses as surplus property.  All present voting aye, motion carried.

ABERDEEN REGIONAL AIRPORT

            Commissioner Omland moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign Professional Services Agreement with Helms & Associates for AIP Project #3-46-0001-23-03.  All present voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign the renewal of Hangar Lease #56 with Mike Sommers.  All present voting aye, motion carried.

DECLARE SURPLUS

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve a request from the Engineering Department to declare a Blueprint Machine as surplus property.  All present voting aye, motion carried.

CHANGE ORDERS

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign Change Order #1 for the Third Avenue SW Project – Upper Plains Contracting Inc. – increase of $14,915.10.  All present voting aye, motion carried.

            Commissioner Omland moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign and approve payment for Change Order #2 and Pay Estimate #7 (Final) for NE Aberdeen Drainage – HF Jacobs & Son Construction – increase of $3,744.99.  Upon roll call, all present voting aye, motion carried.

PAY ESTIMATES

            Commissioner Klabo moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign and approve payment for Pay Estimate #3 – Engineering Services for WWTP Ammonia Removal – Banner Associates in the amount of $6,950.15; and Pay Estimate #7 – Engineering Services for Water Treatment Plant – Banner Associates in the amount of $37,140.00.  Upon roll call, all present voting aye, motion carried.

TRAVEL REQUEST

            Commissioner Omland moved, Commissioner Pfeifer seconded to approve a travel request for Brent Koens to attend Basic School Resource Officer Training in Sioux Falls, SD.  All present voting aye, motion carried.

STREET USE

            Commissioner Klabo moved, Commissioner Omland seconded to approve the following street use requests:  Aberdeen Area Humane Society Dog Walk; Aberdeen Downtown Association Pig Out; Kosel Auction and Becky Woehl Block Party.  All present voting aye, motion carried.

EXECUTIVE SESSION

            Commissioner Omland moved, Commissioner Klabo seconded to move into executive session to discuss legal matters.  All voting aye, motion carried.

RESOLUTION TO VACATE PUBLIC RIGHT-OF-WAY

 

            BE IT RESOLVED by the Aberdeen City Commission, Brown County, Aberdeen, South Dakota that the Petition to Vacate the Public Right-of-Way filed by John Y. Osborn and Robert K. Osborn is hereby granted and the public right-of-ways are hereby vacated for the following described areas:

 

            Public right-of-way located West of and South of the Village Bowl, described as: Public right-of-way platted as Lots B and C of “Lowe’s Subdivision of Lot H2 in the SW ¼ of Sec. 11, T123N-R64W, said plat is recorded as Hanging Plat 402B, at the Register of Deeds of Brown County, South Dakota.

RESOLUTION OF ACCEPTANCE OF UTILITY IMPROVEMENTS

 

            WHEREAS, there has been filed with the City of Aberdeen, South Dakota, a Petition by the Developer to accept the operation and maintenance of a Sanitary Sewer Lift Station; and

 

            WHEREAS, said improvements have been inspected by the City and find them to meet the minimum City Standards; and

 

            BE IT RESOLVED by the Aberdeen City Commission, Aberdeen, Brown County, South Dakota that the improvements were made on legally recorded easements leading to platted right-of-way known as a portion of North 5th St. more particularly described as follows:

 

            Sanitary Sewer Lift Station on a Permanent Easement on Block 1, Presentation Heights Addition to Aberdeen, located in the NW ¼ of Section 12, T123N, R64W in Aberdeen, Brown County, South Dakota,

 

            BE IT FURTHER RESOLVED that the City of Aberdeen will accept the operation and maintenance of this sanitary sewer lift station from this date.

SUBDIVISION VARIANCE

            Doris Price was present to discuss her request for a subdivision variance.  After discussion, Commissioner Pfeifer moved, Commissioner Omland seconded to approve a variance to subdivision regulations to allow a 50’ wide lot along a public street with proper platting being completed, understanding that the Zoning Board of Adjustment must review any building requests and determine whether setback variances are appropriate.  All voting aye, motion carried.

CONTRACT & BONDS

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to approve and authorize the Mayor to sign contract and bonds for North 5th Street Improvements – T & R Contracting, Inc., contingent upon City Attorney’s review.  All voting aye, motion carried.

SET BID DATE

            Commissioner Pfeifer moved, Commissioner Klabo seconded to set a bid date of May 28, 2003 at 2:00 p.m. for advertisements for bids for Concrete Parking Lot Repair.  All voting aye, motion carried.

RECOMMENDATION ON BIDS

            The following bids for 2,000 ton crushed chip seal aggregate was opened on May 7, 2003:  Lien Transportation - $38,500.00; L.G. REQUEST TO ACCEPT QUOTE

            Commissioner Omland moved, Commissioner Klabo seconded to approve a request for permission to accept a quote of $9,250.000 from Johnson Controls to replace the Digester Boiler Methane Burner at the Wastewater Plant.  All voting aye, motion carried.

CONTRACTS AND BONDS

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign the contracts and bonds for one 3,750 gal. and one 3,350 gal. biosolids application tanks – Plains Agri-Sales LLC; and crushed gravel base course and pea gravel – Lien Transportation Co.  All voting aye, motion carried.

DECLARE SURPLUS – SET AUCTION DATE

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve the request to declare various city property items as surplus and set public auction date of Friday, May 16, 2003 at 5:30 p.m. at the Public Works shop.  All voting aye, motion carried.

TRAVEL REQUESTS

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve travel requests for Mike Thompson, Sean Johnson, Rob Senger, and Rob Johnsen to attend the 2003 SD State Fire School on June 5 - 7, 2003 at Belle Fourche, SD; and Dennis Kornder to attend concept programming in Merriam, Kansas on May 20 - 23, 2003.  All voting aye, motion carried.

STREET USE REQUEST

PIPELINE LICENSE CONTRACT

RESOLUTION NO. 03-05-02 R

            WHEREAS, the South Dakota Department of Transportation is causing preparation of plans, data, and information in accordance with South Dakota Department of Transportation guidelines for construction of Project No. NH 0281(64) 195 within the City of Aberdeen and,

            WHEREAS, certain action on the part of the City becomes necessary to the subsequent construction of said project.

            THEREFORE, BE IT RESOLVED, by the City Commission of the City of Aberdeen, duly assembled this 5th day of May, 2003, that the City will move and/or adjust, or will cause to be moved and/or adjusted, any and all utilities, whether publicly or privately owned, lying on the path of or conflicting with the construction of said project(s) within the limits of said City.

            (1)            The moves and/or adjustments will be accomplished at no cost to the State of

                        South Dakota and will be coordinated with the construction of said project.

            (2)            The Finance Officer is hereby directed to mail the original of this resolution,

            There being no further business before the Board, Commissioner Pfeifer moved, Commissioner Klabo seconded that the meeting be adjourned.  All voting aye, motion carried.
