COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 5:30 p.m., May 24, 2004, Joint City/County meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Forkel, Klabo, Omland and Richardson.

            County Commissioners present were Knecht, Fischbach, Wiese and Hansen.  Commissioner Feickert was absent.

ORDINANCE NO. 04-05-01-293

            An Ordinance amending Subsection B of Section 5 of Part II of Ordinance No. 1164, as amended, known as the Zoning Ordinance of the City of Aberdeen, South Dakota, adding Subsection 7. Portable Signs, was presented.  Commissioner Omland moved, Commissioner Forkel seconded to approve first reading of Ordinance No. 04-05-01.  Upon roll call, all voting aye, motion carried.

            Commissioner Fischbach moved, Commissioner Wiese seconded to approve first reading of Ordinance No. 04-05-01-293.  All present voting aye, motion carried.

ORDINANCE NO. 04-05-04-294

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Section 701 (A-1) to Section 714 (M-AG) property described as:  The South 891’ of the NE ¼, Sec. 28, T124N-R64W, except the east 660’ of the South 660’, to be platted and known as Lots 1 and 2 of “Cole Subdivision in the NE ¼ of Sec. 28, T124N-R64W of the 5th P.M., Brown County, South Dakota”. Lots 1, 2 and 4 of “Lots 1-14, Ham’s East Richmond Road Subdivision in the SE ¼ of Sec. 28, T124N-R64W” and extending to the centerline of all public right-of-way located adjacent thereto, was presented.  Commissioner Klabo moved, Commissioner Richardson seconded to approve first reading of Ordinance No. 04-05-04.  Upon roll call, all voting aye, motion carried.

            Commissioner Hansen moved, Commissioner Wiese seconded to approve first reading of Ordinance No. 04-05-04-294.  All present voting aye, motion carried.

            There being no further business before the Joint Commission, Commissioner Omland moved, Commissioner Forkel seconded to adjourn to the regular City Commission Meeting.  All voting aye, motion carried.

EXECUTIVE SESSION

            Commissioner Richardson moved, Commissioner Klabo seconded to move into executive session to discuss personnel.  All voting aye, motion carried.

            Commissioner Richardson moved, Commissioner Klabo seconded to move out of executive session.  All voting aye, motion carried.

            Mayor Hopper led the Pledge of Allegiance.

 

MINUTES

            Commissioner Forkel moved, Commissioner Richardson seconded to approve the minutes of May 17, 2004, as circulated.  All voting aye, motion carried.

RECOGNITION

            Don Whittlinger, VFW, presented Shift Commander Roger Bortnem with a plaque naming him as National Firefighter of the Year by the VFW.

ANNIVERSARY CELEBRATION

            A delegation from Columbia, SD, presented a resolution challenging two delegates from the Aberdeen City Commission to a ‘paintball duel’ with two delegates from Columbia at 4:00 p.m. on June 19, 2004, for rights to the county seat for the weekend as part of Columbia’s 125th Anniversary.  Commissioner Omland moved, Commissioner Forkel seconded to accept the challenge.  All voting aye, motion carried.

EMERGENCY PURCHASE

            A request from Dan Ostrander, City Forester, for permission to purchase three new Grizzly ULV applicators for adult mosquito control, with 50% matching grant monies from the State of South Dakota Department of Health, was presented.  Commissioner Richardson moved, Commissioner Forkel seconded to approve the request.  All voting aye, motion carried.

CONTINUED – HEARING

            This being the time and place set for a hearing on Renewal of Alcoholic Beverage Licenses, no one was present to testify, recommendations for approval were received, Commissioner Omland moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign Renewal of Retail On-Off Sale Malt Beverage Licenses – Munchies Inc. dba Munchies, 2301 6th Avenue SE and Treinta Inc. dba C-Express, 2303 6th Avenue SE.  All voting aye, motion carried.

            Commissioner Klabo moved, Commissioner Forkel seconded to continue for one week to correct fire code violations, the Renewal of Retail On-Off Sale Malt Beverage License for NPC International Inc. dba Pizza Hut #2767, 405-5th Avenue NW.  All voting aye, motion carried.

ORDINANCE NO. 04-05-07

            Commissioner Klabo moved, Commissioner Omland seconded to approve second reading of Ordinance No. 04-05-07.  Upon roll call, all voting aye, motion carried.

            Commissioner Forkel moved, Commissioner Richardson seconded to approve final adoption of Ordinance No. 04-05-07.  Upon roll call, all voting aye, motion carried.

            Commissioner Richardson moved, Commissioner Omland seconded to approve second reading of Ordinance No. 04-05-08.  Upon roll call, all voting aye, motion carried.

ORDINANCE NO. 04-05-09

            Commissioner Richardson moved, Commissioner Omland seconded to approve second reading of Ordinance No. 04-05-09.  Upon roll call, all voting aye, motion carried.

ORDINANCE NO. 04-05-02

            Commissioner Richardson moved, Commissioner Forkel seconded to deny possible first reading of Ordinance No. 04-05-02.  All voting aye, motion carried.

ORDINANCE NO. 04-05-03

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Section 706 (C-1)/Section 711 (R-4)/Section 707 (C-2) to Section 706 (C-1)/Section 711 (R-4) property described as: Lot 4 of “Walz First Addition to the City of Aberdeen, Brown County, South Dakota” and extending to the centerline of all public right-of-way located adjacent thereto, was presented.  Commissioner Richardson moved, Commissioner Forkel seconded to approve first reading of Ordinance No. 04-05-03.  Upon roll call, all voting aye, motion carried.

ORDINANCE NO. 04-05-05

            An Ordinance amending Ordinance No. 1164 to rezone certain described property from Section 707 (C-2) to Section 705 (R-3) property described as: The East 47’ of Lots 5 and 6, Block 14 of “Highland Park Addition to Aberdeen” and extending to the centerline of all public right-of-way located adjacent thereto, was presented.  Commissioner Richardson moved, Commissioner Forkel seconded to approve first reading of Ordinance No. 04-05-05.  Upon roll call, all voting aye, motion carried.

COMPREHENSIVE PLAN

            Commissioner Richardson moved, Commissioner Forkel seconded to approve and authorize the Mayor to sign Amendment to Comprehensive Plan and supplement budget for amendments.  All voting aye, motion carried.

APPROVE RELOCATION OF PARKS, RECREATION & FORESTRY

            Commissioner Forkel moved, Commissioner Richardson seconded to approve the transition plan to relocate Aberdeen Recreation and Cultural Center from 612 – 10th Avenue SE to the Central Complex; move all functions in 2004 or as soon as possible as outlined in memo; and any further improvements would have to come to subsequent City Commission meetings.  Upon roll call, all voting aye, motion carried.

PERMISSION TO PURCHASE

            A request from the Police Department for permission to purchase a 2000 Dodge Stratus for $5,975.00 from the SD Federal Surplus in Huron, was presented.  Commissioner Omland moved, Commissioner Richardson seconded to approve the request.  All voting aye, motion carried.

PERMISSION TO SERVE & CONSUME

            A request from the Investment Centers for permission to serve and permit the consumption of alcoholic beverages at the Wylie Park Pavilion on June 10, 2004 for a Client Appreciation Picnic, was presented.  Commissioner Richardson moved, Commissioner Forkel seconded to approve the request.  All voting aye, motion carried.

PLATS

            Commissioner Forkel moved, Commissioner Richardson seconded to approve the following plats:  Be it resolved by the Board of Commissioners of Aberdeen, South Dakota, that the plat showing “Blocker Addition to the City of Aberdeen, South Dakota,” having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “D & G EIGHTH SUBDIVISION IN ROOSEVELT CRYSTALS SUBDIVISION IN ABERDEEN, SOUTH DAKOTA,” having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing ‘COURTYARD SUITES SUBDIVISION IN ABERDEEN, SOUTH DAKOTA”, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “Thurston’s Addition to Prairiewood Village in the NE ¼ of Section 33, T124N R63W of the 5th P.M., Brown County, South Dakota, having been examined is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            Commissioner Richardson moved, Commissioner Omland seconded to approve the following plats with stipulations as recommended by the Planning Commission:  Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing “Jones Commercial Park Subdivision in SE ¼ Sec. 16-T123N-R63W of 5th P.M., Brown County, South Dakota” having been examined, is hereby approved in accordance with provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing Cole Subdivision in the NE ¼ of Section 28 T124N-R64W of the 5th P.M., Brown County, South Dakota, having been examined, is hereby approved in accordance with the provisions of SDCL 11-3, and any amendments thereof.

            Commissioner Klabo moved, Commissioner Omland seconded to approve and authorize the Mayor to sign and approve payment of Pay Est. #18 – Engineering Services for WTP Improvements – Banner Associates - $39,069.38; Pay Est. #1 – Work on Third Avenue SW St. Improvements – B & B Contracting - $117,093.11.  Upon roll call, all voting aye, motion carried.

            Mayor Hopper congratulated Elissa Grossell for being named Best Young Reporter of the Year; noted Police Chief Interviews will be held in June; expressed sympathy to the Hurlbert family on the passing of Hollis, former City Commissioner; and discussed a new business downtown oriented towards youth.

            Kathie Allstot updated the Commission on the tree replacement in the old cemetery.

            BE IT RESOLVED by the Aberdeen City Commission, Brown County, Aberdeen, South Dakota that the Petition to Vacate the Public Right-of-Way filed by Bill Roth for Avera St. Luke’s is hereby granted and the public right-of-way is hereby vacated for the following described areas:

 

A public alley, 16’ wide, 75’ North and South, located East of State Street South, between vacated Fourth Avenue Southeast and vacated Fifth Avenue Southeast, described as follows:  West of and adjacent to the West lot line of Lots 6, 7 and 8, East of and adjacent to the East lot line of Lots 17, 18 and 19, Block 96 of “Hagerty’s & Lloyd’s Addition to Aberdeen, Brown County, Dakota Territory”, said plat is recorded as Hanging Plat Number 8 at the Register of Deeds of Brown County, South Dakota.

ACCEPT PROPOSAL

            Recommendation to accept a proposal from Rockwell Company for SCADA System Technical Support and make payment of $1,619.00 for the Tech Support to Border States Electric Supply was presented.  Commissioner Klabo moved, Commissioner Omland seconded to accept proposal and approve payment.  Upon roll call, all voting aye, motion carried.

DISCUSSION - LIBRARY USE FEES
Robert Gloss was present to discuss the library fees charged to county residents outside the city limits. No action was taken.

PRESENTATION - FORMS OF GOVERNMENT
Dennis Maloney presented the panel’s findings and recommendations in report form and explained their actions. After discussion, Commissioner Richardson moved, Commissioner Klabo seconded to accept the report and place it on file. All voting aye, motion carried.

A Resolution establishing priorities for the STIP-Urban Construction Program

WHEREAS, the Transportation Efficiency Act (TEA-21) substantially affects highway funding based on the Functional Classification of highways and streets; and

WHEREAS, the U.S. Department of Transportation has set forth policies and procedures for identifying a communities priorities for the STIP-Urban Construction Program; and

WHEREAS, the City of Aberdeen Board of Commissioners annually establishes it’s priorities for the STIP-Urban Construction Program;
NOW, THEREFORE BE IT RESOLVED, that the following are the City’s priorities for the years 2005 to 2009, to wit:

RESOLUTION NO. 04-05-02 R
BRIDGE REINSPECTION PROGRAM RESOLUTION
FOR USE WITH SDDOT RETAINER CONTRACTS

WHEREAS, Title 23, Section 151, United States Code and Title 23, Part 650, Subpart C, Code of Federal Regulations, requires initial inspection of all bridges and reinspection at intervals not to exceed two years.

THEREFORE, the City of Aberdeen is desirous of participating in the Bridge Inspection Program using Bridge Replacement funds.

The City of Aberdeen requests SDDOT to hire Hofland Engineering, Consulting Engineers, for the inspection work. SDDOT will secure federal approvals, make payments to the Consulting Engineer for inspection services rendered, and bill the City for 20% of the cost. The City of Aberdeen will be responsible for the required 20% matching funds.

There are a total of 9 bridges in the City of Aberdeen that require inspection.

RECOMMENDATION ON BIDS
Bid opening for the Well Project for the Water Treatment Plant was opened and publicly read. Low bid for Bid Schedule 1 was Lako Drilling, Inc. of Arthur, ND. Low Bid for Bid Schedule 2 was B & B Contracting of Aberdeen, SD. Commissioner Klabo moved, Commissioner Richardson seconded to award the bid as recommended by Banner Associates and the Water Treatment Superintendent. All voting aye, motion carried. A detailed bid tabulation is on file in the Finance Office.

REQUEST
A request to purchase material from Milbank Win Water for the watermain break under the Burlington Northern Railroad Crossing on Main Street was presented. Commissioner Richardson moved, Commissioner Forkel seconded to approve the request. All voting aye, motion carried.

PRE-BUDGET SESSIONS
Commissioner Forkel discussed an outline of meetings to preliminarily review the 2005 budget sessions. No action was taken.

REQUEST FOR SURPLUS AND SET PUBLIC AUCTION
A request to declare various city property items as surplus and to set a public auction sale date of May 7, 2004 at 5:30 p.m. at the Public Works Shop was presented. Commissioner Omland moved, Commissioner Richardson seconded to approve the request. All voting aye, motion carried.
