COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 6:30 p.m., October 29, 2001, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Omland and Pfeifer.

            The Pledge of Allegiance was led by Mayor Hopper.

MINUTES

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve the minutes of October 22 and 23, 2001, with the following correction:  “Page 12824 – SET HEARING DATE – PETITION – change hearing date to November 13, 2001 at 9:00 a.m.”  All voting aye, motion carried.

AMENDMENT

            Commissioner Klabo moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign Wastewater Treatment Plant Digester Cover Contract Amendment.  All voting aye, motion carried.

COMMUNITY CULTURAL PLAN

            Lori Ryman, Aberdeen Area Arts Council, was present to discuss the Community Cultural Plan.  Commissioner Pfeifer moved, Commissioner Klabo seconded to receive and place the plan on file.  All voting aye, motion carried.

PROPOSED ORDINANCES FOR AIRPORT CODE REVISIONS

            Ordinance No. 01-10-06 – That the Revised Ordinances, City of Aberdeen, South Dakota, is hereby amended by adding a section, to be numbered 8-2 Purpose of Airport, was presented.  Commissioner Pfeifer moved, Commissioner Klabo seconded to approve first reading of Ordinance No. 01-10-06.  Upon roll call, all voting aye, motion carried.

            Ordinance No. 01-10-07 – That the Revised Ordinances, City of Aberdeen, South Dakota, is hereby amended by adding a section, to be numbered 8-3 Penalty for Violation, was presented.  Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve first reading of Ordinance No. 01-10-07.  Upon roll call, all voting aye, motion carried.

            Ordinance No. 01-10-08 – That the Revised Ordinances, City of Aberdeen, South Dakota, is hereby amended by adding a section, to be numbered 8-4 Airport Rules Generally, was presented.  Commissioner Klabo moved, Commissioner Pfeifer seconded to approve first reading of Ordinance No. 01-10-08.  Upon roll call, all voting aye, motion carried.

            Ordinance No. 01-10-09 – That the Revised Ordinances, City of Aberdeen, South Dakota, is hereby amended by adding a section, numbered 8-100 Operator’s Conduct on Airport Property, was presented.  Commissioner Pfeifer moved, Commissioner Omland seconded to approve first reading of Ordinance No. 01-10-09.  Upon roll call, all voting aye, motion carried.

            Ordinance No. 01-10-10 – That the Revised Ordinances, City of Aberdeen, South Dakota, is hereby amended by revising a section, numbered 8-40 Radio Equipment, was presented.  Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve first reading of Ordinance No. 01-10-10.  Upon roll call, all voting aye, motion carried.

            Ordinance No. 01-10-11 – That section 8-59 Traversing on the Airport Proper of the Revised Ordinances, City of Aberdeen, South Dakota is hereby amended, was presented.  Commissioner Pfeifer moved, Commissioner Klabo seconded to approve first reading of Ordinance No. 01-10-11.  Upon roll call, all voting aye, motion carried.

            Ordinance No. 01-10-12 – That section 8-63 Hours of Darkness of the Revised Ordinances, City of Aberdeen, South Dakota, is hereby amended, was presented.  Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve first reading of Ordinance No. 01-10-12.  Upon roll call, all voting aye, motion carried.

            Ordinance No. 01-10-13 – That section 8-64 Emergencies of the Revised Ordinances, City of Aberdeen, South Dakota, is hereby amended, was presented.  Commissioner Pfeifer moved, Commissioner Omland seconded to approve first reading of Ordinance No. 01-10-13.  Upon roll call, all voting aye, motion carried.

            Ordinance No. 01-10-14 – That the Revised Ordinances, City of Aberdeen, South Dakota, is hereby amended by adding a section, to be numbered 8-83 Removal of Vehicles by Airport Personnel, was presented.  Commissioner Klabo moved, Commissioner Omland seconded to approve first reading of Ordinance No. 01-10-14.  Upon roll call, all voting aye, motion carried.

AGREEMENT – AIRPORT

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve and authorize the Mayor to sign Aberdeen Regional Airport #3-46-0001-21-2001 State Financial Assistance Agreement with South Dakota Department of Transportation – Office of Aeronautics.  All voting aye, motion carried.

SET HEARING DATE

            Commissioner Klabo moved, Commissioner Kirkpatrick seconded to set a hearing date of November 13, 2001 at 9:00 a.m. for applications for renewal of alcoholic beverage licenses:  RENEWAL OF RETAIL ON-SALE LIQUOR LICENSE – Veterans of Foreign Wars dba VFW Club, 821 Circle Drive; Loyal Order of Moose Lodge #590 dba 410 Ninth Avenue SW; The Circus Lounge Inc. dba The Circus Sports Bar & Grill, 14 Third Avenue SE; RENEWAL OF PACKAGE OFF-SALE LIQUOR LICENSE – Nash Finch Company dba Econofoods #487, 2424 Sixth Avenue SE; Ken’s Supermarket Inc. dba Ken’s Fairway Foods, 2105 Sixth Avenue SE; RENEWAL OF RETAIL ON-SALE WINE LICENSE – Lai Liu Inc. dba Hong Kong Restaurant, 1721 Sixth Avenue SE.  All voting aye, motion carried.

SET BID DATE

            Commissioner Pfeifer moved, Commissioner Omland seconded to set a bid date of November 21, 2001 at 2:00 p.m. for advertisement for bids for SW Drainage Improvements Project.  All voting aye, motion carried.

AGREEMENTS

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign Letting, Financial and Maintenance/Encroachment Agreements between City of Aberdeen and South Dakota Department of Transportation:  Second Street Overpass (0664) Agreement and US #12 Project (0569) Agreement.  All voting aye, motion carried.

RECOMMENDATION – MOCCASIN CREEK

            Three firms submitted proposals on the Conceptual Study of a low-flow channel for the Moccasin Creek.  After telephone interviews, it is recommended Interfluve, Inc., be offered the study contingent upon concurrence with the SDDENR.  Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve the recommendation.  All voting aye, motion carried.         

SURPLUS – BIKES

            Commissioner Klabo moved, Commissioner Pfeifer seconded to continue for one week the Police Department’s requests to declare bikes surplus property.  All voting aye, motion carried.

CONTRACTS

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve and authorize the Mayor to sign the following contracts, contingent upon City Attorney’s review:  snow removal/hauling snow – Dabbert Trucking; snow removal/plowing/hauling snow – Ludwig Trucking; snow removal/plowing snow – Lout Construction; snow removal/wrecker service – Eddie’s Northside Phillips 66.  All voting aye, motion carried.

PAY REQUEST

            Commissioner Klabo moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign and approve payment for Pay Request #3 – WWTP Digestor Cover Replacement – KHC Construction in the amount of $39,506.88.  Upon roll call, all voting aye, motion carried.

LICENSES

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve a Transient Merchant License for Robert L. Cummins; and a Taxi Cab Driver License for John Blank.  All voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve a Taxi Cab Driver License for Ernie Dinger, contingent upon Police Department recommendation.  All voting aye, motion carried.

LOTTERY

            Commissioner Pfeifer moved, Commissioner Omland seconded to continue for one week a lottery notice for Coni L. Stoner Benefit.  All voting aye, motion carried.

            Commissioner Omland moved, Commissioner Klabo seconded to approve the following audited claims for services, supplies, repairs and maintenance:  United Parcel Service 97.37; First American Administrators 32,477.48; Qwest 23.88; John Rosemond 3,500.00.  Upon roll call, all voting aye, motion carried.

LICENSE

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve a Sidewalk Contractor License for Hofer Brothers Construction, LLC.  All voting aye, motion carried.

            There being no further business before the Board, Commissioner Pfeifer moved, Commissioner Klabo seconded that the meeting be adjourned until 8:45 a.m., October 30, 2001, for a Joint City/County Meeting.  All voting aye, motion carried.

COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 6:30 p.m., October 22, 2001, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Omland and Pfeifer.

MINUTES

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve the minutes of October 15, 2001, as circulated.  All voting aye, motion carried.

HEARING ON BID ASSESSMENT

            This being the time and place set for a hearing on the Bid Assessment, Mayor Hopper opened the hearing for comments.  Members of the BID Board spoke in favor of the $45,000 assessment.  Jim Gohn spoke in opposition and presented letters and petitions in opposition of the assessment.  After further discussion, Commissioner Klabo moved, Commissioner Pfeifer seconded to receive and place on file the petitions and letters in opposition.  All voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to table any action on the hearing.  All voting aye, motion carried.

GRANT

            Commissioner Klabo moved, Commissioner Pfeifer seconded to approve the Gates Library Foundation Grant.  All voting aye, motion carried.

PEDESTRIAN CROSSING – SIMMON’S ELEMENTARY

            Information regarding the discussions on the pedestrian crossing across the railroad tracks near Simmon’s Elementary was presented by City Engineer Bobzien.  After discussion, Commissioner Pfeifer moved, Commissioner Klabo seconded to authorize pursuing an allocation of Rail Safety Funding or Transportation Enhancement Funding through the South Dakota Department of Transportation.  All voting aye, motion carried.

 SOLICIT BIDS

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve the solicitation of bids for a protection system for the Front Reception Area in the Police Department.  All voting aye, motion carried.

BUDGET SUPPLEMENT

            A  request from the Fire Department for a $3,180.00 supplement to their budget for travel expenses to Annual Aircraft Rescue Firefighting Training on November 27 and 28, 2001, was presented.  Commissioner Pfeifer moved, Commissioner Klabo seconded to approve the request.  All voting aye, motion carried.

LEASE

            Commissioner Klabo moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign and approve payment for a Snow Dumping Lease Agreement with Don Gisi for $250.00 and Joanne Bollwerk for $250.00.  Upon roll call, all voting aye, motion carried.

ABERDEEN REGIONAL AIRPORT

            Commissioner Omland moved, Commissioner Kirkpatrick seconded to approve a request for Quest Development and Construction to remodel Terminal Building.  All voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve a request to purchase a Lift Station Motor for $3,117.65.  All voting aye, motion carried.

ABERDEEN WATER TREATMENT PLANT

            Rick Wahlen, Water Treatment Superintendent, spoke on where the City is on meeting State and Federal requirements.  He will also be setting up water sampling table on first floor of the Municipal Building so the public can taste four different samples of water.

CONTRACTS

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve and authorize the Mayor to sign, contingent upon city Attorney’s review, contracts for snow removal/hauling snow/wrecker service:  Kevin Bourdon Trucking; A-1 Sanitation; Dick’s Westside 66 and Habeck Garage dba Towing Plus.  All present voting aye, motion carried.

RECOMMENDATION ON BIDS

            Bids were received and publicly opened on October 3, 2001, for One New Rubber Tire Front End Loader for the Street Department.  A detailed list is on file in the Finance Office.  Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve the low trade-in bid from Piorier Equipment in the amount of $79,500.00.  All present voting aye, motion carried.

COMMISSIONERS PROCEEDINGS

            City Commission Chambers, Municipal Building, 123 South Lincoln, Aberdeen, South Dakota, 5:45 p.m., October 1, 2001, regular meeting of the Board of Commissioners, Mayor Hopper presiding.  Present at roll call were Commissioners Kirkpatrick, Klabo, Omland and Pfeifer.

EXECUTIVE SESSION

            Commissioner Klabo moved, Commissioner Omland seconded to move into executive session to discuss legal matters.  All voting aye, motion carried.

            Commissioner Pfeifer moved, Commissioner Kirkpatrick seconded to move out of executive session.  All voting aye, motion carried.

            The Pledge of Allegiance was led by Mayor Hopper.

MINUTES

            Commissioner Pfeifer moved, Commissioner Omland seconded to approve the minutes of September 24 & 25, 2001, as circulated.  All voting aye, motion carried.

PROCLAMATION

            Mayor Hopper read and proclaimed the month of October 2001 as “Spinal Health Month”.

ORDINANCE NO. 01-09-01

            Commissioner Kirkpatrick moved, Commissioner Omland seconded to approve second reading of Ordinance No. 01-09-01.  Upon roll call, all voting aye, motion carried.

            Commissioner Klabo moved, Commissioner Pfeifer seconded to approve final adoption of Ordinance No. 01-09-01.  Upon roll call, all voting aye, motion carried.

ORDINANCE NO. 01-10-05

            An Ordinance amending Sec. 26-92 (2) of the Revised Ordinances of the City of Aberdeen No. 1567 as amended to change designation of snow emergency routes, was presented for first reading.  Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve first reading of Ordinance No. 01-10-05.  Upon roll call, all voting aye, motion carried.

HEARING

            This being the time and place set for a hearing on transfers of Package Off-Sale Liquor and Retail On-Off Sale Malt Beverage Licenses from Marshalls’ Starlite Inc. dba Starlite Truckstop & Café, 602 S. Highway #281 to I-90 Fuel Services, Inc. dba Starlite Truckstop, 602 S. Highway #281. Brian Shefield representing I-90 Fuel Services, Inc. was present.  No one was present to testify in opposition.  Commissioner Klabo moved, Commissioner Omland seconded to approve and authorize the Mayor to sign the transfer.  All voting aye, motion carried.

 

LEGAL OPINION ON WEB REQUEST

            City Attorney Mark Anderson explained the initiative and referendum process and stated the Commission did not have the authority to hold an election, but petitions signed by 5% of the registered voters in the municipality would allow an election.  No action was taken.

REIMBURSEMENT

            City Engineer noted the receipt from the Federal Government for reimbursement of $8,562.11 for repairing Willow Dam retaining wall damage.  No action was taken.

CONTRACT & BOND

            Commissioner Klabo moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign contract and bond for Library Asbestos Abatement Project – KMB Diversified Services, contingent upon City Attorney’s review.  All voting aye, motion carried.

            Commissioner Kirkpatrick moved, Commissioner Klabo seconded to approve the following plats:  Be it resolved by the City Commission of Aberdeen, South Dakota, that the plat showing JEWETT’S FIRST ADDITION IN ABERDEEN, SOUTH DAKOTA, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-6, and any amendments thereof.

            Be it resolved by the City Commission of Aberdeen, South Dakota, that the Plat showing Maplewood Addition to Ashwood Heights Subdivision, City of Aberdeen, Brown County, South Dakota, having been examined, is hereby approved in accordance with the provisions of SDCL of 1967, Chapter 11-3, and any amendments thereof.

            All voting aye, motion carried.

PAYMENT REQUESTS

            Commissioner Kirkpatrick moved, Commissioner Pfeifer seconded to approve the following Payment Requests:  Upper Plains Contracting - $2,727.23; and NRG Company Inc. - $2,505.15.  Upon roll call, all voting aye, motion carried.

PAY ESTIMATE

            Commissioner Klabo moved, Commissioner Pfeifer seconded to approve and authorize the Mayor to sign and approve payment for Pay Estimate #1 – NE Drainage Stormwater Holding Pond (SS-2001-2) – Halstead’s Inc. in the amount of $31,814.67.  Upon roll call, all voting aye, motion carried.

LICENSES

            Commissioner Pfeifer moved, Commissioner Klabo seconded to approve sidewalk contractor licenses for Dustin Usselman and Scott Suedmeier.  All voting aye, motion carried.

            Commissioner Klabo moved, Commissioner Omland seconded to approve a Taxi Driver License for Kerry L. Vinsant, contingent upon Police Department approval.  All voting aye, motion carried.
