City Commission Chambers, Municipal Building, 123 South Lincoln,
Aberdeen, South Dakota, 6:30 p.m., October 29, 2001, regular meeting of
the Board of Commissioners, Mayor Hopper presiding.
Present at roll call were Commissioners Kirkpatrick, Klabo,
Omland and Pfeifer.
The Pledge of Allegiance was led by Mayor Hopper. MINUTES
Commissioner Kirkpatrick moved, Commissioner Omland seconded to
approve the minutes of October 22 and 23, 2001, with the following
correction: “Page 12824
– SET HEARING DATE – PETITION – change hearing date to November
13, 2001 at 9:00 a.m.” All
voting aye, motion carried. AMENDMENT
Commissioner Klabo moved, Commissioner Pfeifer seconded to
approve and authorize the Mayor to sign Wastewater Treatment Plant
Digester Cover Contract Amendment.

CULTURAL PLAN
Lori Ryman, Aberdeen Area Arts Council, was present to discuss
the Community Cultural Plan. Commissioner
Pfeifer moved, Commissioner Klabo seconded to receive and place the plan

ORDINANCES FOR AIRPORT CODE REVISIONS
Ordinance No. 01-10-06 – That the Revised Ordinances, City of
Aberdeen, South Dakota, is hereby amended by adding a section, to be
numbered 8-2 Purpose of Airport, was presented.
Commissioner Pfeifer moved, Commissioner Klabo seconded to
approve first reading of Ordinance No. 01-10-06.
Upon roll call, all voting aye, motion carried.
Ordinance No. 01-10-07 – That the Revised Ordinances, City of
Aberdeen, South Dakota, is hereby amended by adding a section, to be
numbered 8-3 Penalty for Violation, was presented.
Commissioner Kirkpatrick moved, Commissioner Omland seconded to
approve first reading of Ordinance No. 01-10-07.

Ordinance No. 01-10-08 – That the Revised Ordinances, City of
Aberdeen, South Dakota, is hereby amended by adding a section, to be
numbered 8-4 Airport Rules Generally, was presented.

approve first reading of Ordinance No. 01-10-08.

Ordinance No. 01-10-09 – That the Revised Ordinances, City of
Aberdeen, South Dakota, is hereby amended by adding a section, numbered
8-100 Operator’s Conduct on Airport Property, was presented.

approve first reading of Ordinance No. 01-10-09.

Ordinance No. 01-10-10 – That the Revised Ordinances, City of
Aberdeen, South Dakota, is hereby amended by revising a section,
numbered 8-40 Radio Equipment, was presented.

approve first reading of Ordinance No. 01-10-10.

Ordinance No. 01-10-11 – That section 8-59 Traversing on the
Airport Proper of the Revised Ordinances, City of Aberdeen, South Dakota
is hereby amended, was presented. Commissioner

Ordinance No. 01-10-12 – That section 8-63 Hours of Darkness of

Ordinance No. 01-10-14 – That the Revised Ordinances, City of

first reading of Ordinance No. 01-10-14.

Commissioner Pfeifer moved, Commissioner Klabo seconded to
approve and authorize the Mayor to sign Aberdeen Regional Airport
#3-46-0001-21-2001 State Financial Assistance Agreement with South
Dakota Department of Transportation – Office of Aeronautics.

approve and authorize the Mayor to sign Letting, Financial and
Maintenance/Encroachment Agreements between City of Aberdeen and South

– MOCCASIN CREEK
Three firms submitted proposals on the Conceptual Study of a
low-flow channel for the Moccasin Creek.
After telephone interviews, it is recommended Interfluve, Inc.,
be offered the study contingent upon concurrence with the SDDENR.

approve the recommendation. All

ON BID ASSESSMENT
This being the time and place set for a hearing on the Bid
Assessment, Mayor Hopper opened the hearing for comments.
Members of the BID Board spoke in favor of the $45,000
assessment. Jim Gohn spoke
in opposition and presented letters and petitions in opposition of the
assessment. After further
discussion, Commissioner Klabo moved, Commissioner Pfeifer seconded to
receive and place on file the petitions and letters in opposition.

Information regarding the discussions on the pedestrian crossing
across the railroad tracks near Simmon’s Elementary was presented by
City Engineer Bobzien. After

authorize pursuing an allocation of Rail Safety Funding or
Transportation Enhancement Funding through the South Dakota Department
of Transportation. All

OPINION ON WEB REQUEST
City Attorney Mark Anderson explained the initiative and
referendum process and stated the Commission did not have the authority
to hold an election, but petitions signed by 5% of the registered voters
in the municipality would allow an election.

City Engineer noted the receipt from the Federal Government for
reimbursement of $8,562.11 for repairing Willow Dam retaining wall
damage. No action was
